HomeMy WebLinkAboutR-86-1016J-86-1008 11/24/86 RESOLUTION NO A RESOLUTION AUTHORIZING AN INCREASE IN THE CONTRACT AMOUNT OF $100,000 IN THE CONTRACT BETWEEN THE CITY OF MIAMI, FLORIDA AND WILLIAMS PAVING COMPANY, INC. DATED MARCH 79 1986 FOR THE CONSTRUCTION OF DOWNTOWN HIGHWAY IMPROVEMENT - PHASE I SAID FUNDS TO BE PROVIDED FROM FUNDS ALREADY ALLOCATED TO THE PROJECT; FURTHER RATIFYING THE CITY MANAGERS WRITTEN FINDING THAT THE HEREIN INCREASE RESULTED FROM EMERGENCY CIRCUMSTANCES BY AN AFFIRMATIVE VOTE OF FOUR/FIFTHS OF THE MEMBERS OF THE CITY COMMISSION, AND ADOPTING THE FINDING' AND CONCLUSIONS SET FORTH IN THE PREAMBLE OF THIS RESOLUTION. WHEREAS, there exist a contract dated March 7, 1986 between the City of Miami, Florida and Williams Paving Company, Inc. for the construction of Downtown Highway Improvement - Phase I; and WHEREAS, an increase in contract of $100,000 is required to cover the cost of street lighting conduit installation and the construction of asphalt base in lieu of limerock base; and WHEREAS, the City Manager has made a written finding that a valid emergency exist for the increase; and WHEREAS, the Director of the Department of Public Works recommends the increase in contract to cover the additional costs, and WHEREAS, funds to cover the increase are available from money already allocated to the project; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. After a properly advertised public hearing, the finding of the City Manager set forth in the preamble to this resolution is hereby ratified by an affirmative vote of four/fifths of the City Commission, and adopted as if fully set forth in this section. RECOMMENDATION: It is respectfully recommended that the City Commission adopt the attached resolution authorizing an increase in contract amount of $100,000 in the contract between the City of Miami, Florida and Williams Paving Company, Inc. for Downtown Highway Improvement Phase I; said funds to be provided from funds already allocated to the project; further ratifying the City Manager's written finding that the herein increase resulted from emergency circumstances by an affirmative vote of 4/5 of the members of the City Commission and adopting the findings and conclusions set forth in the preamble of this resolution. BACKGROUND: The Department of Public Works has analyzed the situation and has determined that there is a need to adopt legislation which will increase the contract amount on this project by $100,000. Because of Florida Power & Light's refusal to install underground conduits to serve the new street light system on the streets to be rebuilt under this contract, the City was forced to authorize our contractor on the site to proceed with the installation of the conduit. We have determined that the cost of this conduit installation will be approximately $60,000 depending on actual measurement of the conduit installation. Under an agreement reached between the City and Florida Power & Light, the City will be due a total or partial reimbursement of this cost from Florida Power & Light at some future date. 8�--101E� t 1 • Additionally the contract let to Williams Paving Company for construction of the project was let on the basis of employing an 8" limerock base for the streets to be rebuilt. Alternate bids for the construction of a 6" thick asphalt base were received, but because the cost of the asphalt base was approximately $72,000 higher than the limerock base, the decision to employ limerock base was made and a contract was awarded accordingly. After beginning of construction we have determined that it is far more practical to employ the asphalt base rather than the limerock base because many existing utilities would be disturbed by the construction of the limerock base. Additionally limerock base construction is more time consuming than the construction of asphalt base which would add to the inconvenience of the merchants and the general public. The contractor also prefers to construct asphalt base rather than limerock base and the Public Works Department is in negotiation with them to do -so. It is Public Works Department's estimation that they can negotiate an agreement with the contractor for him to construct the asphalt base for approximately one half of the additional cost reflected by the bid item or an additional $35,000. The sum of these two additional costs amount to $95,000 and more than deplete the $85,000 cash allowance provided in the contract. The project is very complex, being the first time in recent history that downtown streets have been completely rebuilt, and it is essential to do smooth completion of the project that the cash allowance be reestablished. The attached resolution would accomplish this. Funds for the proposed increase are available from the General Obligation Bond Fund already allocated to the project. FLORIDA INTEROFFICE MEMORANDUM DATE: nrr IF 1986 FILE: B-4498 SUBJECT: DOWNTOWN HIGHWAY IMPROVEMENT PHASE I Emergency Need for Increase REFERENCES: in Contract Amount ENCLOSURES: Based on information supplied to me by the Director of the Department of Public Works I have found that there exists an emergency need for an increase in contract amount of $100,000 in the contract between the City of Miami and Williams Paving Company, Inc. for the construction of Downtown Highway Improvement - Phase I. The reason for the emergency need is as follows: The installation of underground conduit to serve the new street lighting originally anticipated to be installed by Florida Power & Light and the anticipated additional cost to construct the new street with asphalt base instead of limeroek base will more than deplete the cash allowance for the project. An increase in the contract amount is necessary to replenish the cash allowance without dealy so that funds will be available to cover items of extra work that are expected to arise.
