A RESOLUTION RATIFYING) BY A FOUR -FIFTHS AFFIRMATIVE VOTE OF THE CITY COMMISSION, THE CITY MANAGER'S EMERGENCY PROVISION OF TWENTY-FOUR HOUR DAILY, SEVEN DAYS PER WEEK, ARMED SECURITY GUARD SERVICES WITH MARKED COMPANY CARS AND WITH RADIOS FOR ONE MONTH, FROM NOVEMBER 8, 1986 THROUGH DECEMBER 8, 1986, FROM THE FLOYD PROTECTION CORPORATION, A BLACK MINORITY VENDOR, AT A COST OF $7,068, FUNDS THEREFOR BEING AVAILABLE FROM THE 1986-87 LEASED PROPERTY MAINTENANCE FUND; FURTHER AUTHORIZING THE CITY MANAGER TO EXTEND THIS SERVICE FOR A PERIOD NOT TO EXCEED ONE MONTH AT A TIME UNTIL SUCH TIME AS THE CITY'S POLICE MINI -STATION, CURRENTLY LOCATED AT THE CULMER/OVERTOWN COMMUNITY CENTER IS RELOCATED TO THE OVERTOWN SHOPPING CENTER, AT WHICH TIME, THE CITY MANAGER SHALL REQUEST THE CITY COMMISSION'S APPROVAL TO FORMALLY ADVERTISE FOR BIDS FOR TWELVE - HOURS DAILY, SEVEN DAYS PER WEEK, SECURITY SERVICES. WHEREAS, the City of Miami has assumed responsibility for the Overtown Shopping Center, pending the outcome of litigation regarding the rightful ownership of the Shopping Center; and WHEREAS, it has been brought to the City's attention and the City Manager has made written findings that certain security hazards exist at the Center which threaten the welfare and safety of shopping center tenants, customers, and the Overtown Community -at -Large and which req•.ire the presence of professional security personnel on a 24-hour basis; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The City Manager's written finding that there was emergency action needed to provide security services at the Overtown Shopping Center for the period of November 8, 1986 through December 8, 1986 by the Floyd Protection Corporation, a black minority vendor, at a cost of $7,068 is hereby ratified, approved and confirmed. Section 2. The Purchasing Agent is hereby authorized by a four -fifths vote of the City Commission to issue purchase orders in a manner consistent with proper purchasing practices in order to meet this emergency need with funding therefor being allocated from the 1986-87 Leased Property Maintenance Fund. The City Manager is hereby authorized to extend this service for a period not to exceed one month at a time until such time as the City's Police Mini -Station currently located at the Culmer/Overtown Community Center is relocated to the Overtown Shopping Center; and at that time the City Manager shall request the City Commission's approval to formally advertise for bids for twelve -hours daily, seven days per week, security services. Odio / City Manager j /J RECOMMENDATION 54 DATE DEC,` 51966 FILE SU9JEC- Resolution Ratifying Emergency Action by the City Manager to Provide REFERENCES 24-Hour Armed Guard Service at the Overtown Shopping ENCLOSURES Center It is respectfully recommended that the City Commission adopt the attached resolution ratifying, approving and confirming an emergency action of the City Manager to provide 24-hour, 7-days per week rotating guard service with marked company cars and with radios at the Overtown Shopping Center for one month, from November 8, 1986 to December 8, 1986, at a cost of $7,068, funds for which are available from the 1986-87 Leased Property Maintenance Fund to the Floyd Protection Corp, a Black minority vendor. Also respectfully recommended is your approval to extend this guard service until such time as the City of Miami Police Mini -station, currently located at the Culmer/Overtown Community Center, can be relocated to the Overtown Shopping Center. At such time, we will prepare a request to the City Commission to formally advertise for bids for 12-hour, seven days a week armed security guard services with marked company cars and with radios. Background The General Services Administration Department was assigned the responsibility for the interim management of the Overtown Shopping Center. As a result of the termination of the City's lease with the Overtown Economic Development Corporation, the Department of Development assumed management responsibility of the Overtown Shopping Center. As a result of claim of lien proceedings, legal action is still pending regarding rightful ownership of the Shopping Center. Upon request by the Department of Development, the Department of General Services Administration analyzed the scope of services required to make physical improvements to the facility, to provide custodial services, and to provide for its secure protection until the issue of ownership had been resolved. However, in the interim, the review of these requirements and subsequent notification from tenants, including the Dade County Youth and Family Development Office, regarding their immediate security, safety and welfare, and their intention to effectuate the required improvements and services 86-1011 c r Honorable Mayor and Members of the City Commission -2- at cost to the City, prompted the City Manager to determine an emergency award of this purchase to be an appropriate action. The scope of work involved was beyond the resources of the General Services Administration Department. Numerous complaints regarding vandalism, the use of drugs, and threats to the security of tenants and customers/clients of current lessees prompted the need for immediate, emergency action by the City of Miami. Resultantly, emergency authorization was provided to the Department of General Services Administration to secure the guard services herein described and to begin the process of moving the City's Police Mini -station from the Culmer/Overtown Community Center (a Dade County Facility) to the Overtown Shopping Center. It is anticipated that move will be completed within thirty (30) days of this request. The General Services Administration analyzed telephone quote bids from three (3) minority vendors and determined the Floyd Protection Corp. to be the lowest responsible and responsive bidder. The City Manager determined the emergency award to be an appropriate action. W ams, Director REFERENCES Shopping Center General Services Administration ENCLOSURES: Request We are requesting your approval to secure, repair, guard and provide custodial services, on an emergency basis, at the Overtown Shopping Center. Background Earlier, you approved our request to negotiate contracts with Black vendors to make required repairs to the security system and to provide guard and custodial services and at the Overtown Shopping Center. In the process of drawing up the agreements, we were advised by the Law Department that we were required to solicit proposals from three (3) vendors for each service, rank each and present the firms to you for your approval before we could proceed with our negotiations.. This process could have taken as long as a month or so. Owing to the critical nature of the security and custodial needs which have been expressed in the attached correspondence from tenants at the shopping center, we have decided to request your approval to secure the services needed on an emergency basis. It is our opinion that the conditions described at the center constitute a threat to the safety, welfare and lives of the tenants, customers and clients of the Center, as well as to the community -at -large.
