J-86-1059 12/2/86 RESOLUTION NO. 86r101() A RESOLUTION RATIFYING, APPROVING AND CONFIRMING, BY A 4/5THS AFFIRMATIVE VOTE OF THE MEMBERS OF THE CITY COMMISSION, THE ACTION OF THE CITY MANAGER IN FINDING THE CONSTRUCTION OF A 2-1/2 FT. HIGH BARRIER WALL AT FIRE STATION NO. 5 TO BE AN EMERGENCY PURCHASE AND IN AUTHORIZING THE ISSUANCE OF AN EMERGENCY PURCHASE ORDER FOR THE CONSTRUCTION OF SAID WALL TO GROUP IV CONSTRUCTION, INC. TO THE DEPARTMENT OF GENERAL SERVICES ADMINISTRATION AT A TOTAL PROPOSED COST OF $9,813.00; ALLOCATING FUNDS THEREFOR FROM THE 1986-87 OPERATING BUDGET. WHEREAS, pursuant to public notice, seales bids were received October 22, 1986 for the construction of a 2-1/2 ft. barrier wall at Fire Station No. 5 to the Department of General Services Administration; and WHEREAS, invitations were mailed to thirty one (31) potential vendors and five (5) bids were received; and WHEREAS, funds for this construction were available in the 1986-87 Operating Budget; and WHEREAS, the urgency to complete this construction is to provide protection from potential collisions by vehicles traveling on N.W. 12th Avenue as such an incident happened a few months ago and caused structural damage to the east side concrete wall; and WHEREAS, there is a real possibility of serious injury and/or fatality to Fire Department personnel that are housed dormitory -style just behind the east side wall; and WHEREAS, the City Manager and the Director of the Department of General Services Administration recommend that the bid received from Group IV Construction, Inc. be accepted as the lowest responsible and responsive bid; and CITY COMMISSION MEETING OF DEC 11 1986 sowualq 486-1010 WHEREAS, the City Manager has made a written finding that a valid emergency need existed, as the safety of City personnel is of upmost importance; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. By an affirmative vote of four fifths (4/5ths) of the Members of the City Commission, the City Manager's written finding, that the construction of a 2-1/2 ft. high barrier wall at Fire Station No. 5 constitutes an emergency, is hereby ratified. Section 2. The City Manager's action in authorizing the Chief Procurement Officer to issue a Purchase Order to Group IV Construction Inc. in the amount of $9,813.00 for the Department of General Services Administration with funds allocated from the 1986-87 Operating Budget, is hereby ratified, approved and confirmed. BACKGROUND: The General Services Administration Department, analyzed the bids submitted, pursuant to Bid. No. 86-87-009. The lowest responsible, responsive bidder was Group IV Construction, Inc.. A recent accident at this location , wherein an automobile collided with the east wall, next to the personnel dormitory, caused structural damage. The possibility of future accidents which could result in serious injury to fire department personnel caused the City Manager to determine emergency award of this contract and issuance of an emergency purchase order to be an appropriate action. Due to the urgency to complete the construction of a 2'h ft. high barrier wall at Fire Station No. 5 to provide protection from potential collisions by vehicles traveling on N.W. 12th Avenue, we find it impractical to comply with the formal award require- ments of the City Commission. Approximately 1� months ago, an automobile collided with Fire Station No. 5 and caused structural damage to the east side concrete wall. There is a real possibility of serious injury and/or fatality to Fire Department personnel that are housed dormitory - style just behind the east side wall. Group IV Construction Inc. submitted the lowest acceptable bid which conformed to specifications at a total cost of $9,813.00. Funds are available in the 1986-87 Internal Services Fund, Property Maintenance Division, Repair and Maintenance Services - Outside. It is our recommendation that the formal award process be waived and procurement of this project be handled on an emergency basis to be ratified by the City Commission at a later date.
