HomeMy WebLinkAboutR-86-0989J-86-1004 11/21/86 RESOLUTION NO. 867989 A RESOLUTION ALLOCATING FUNDS IN AN AMOUNT NOT TO EXCEED $30,000 FROM THE 1986-87 OPERATING BUDGET FOR THE CONTINUATION OF SERVICES BY SPECIAL COUNSEL TO THE CITY'S CODE ENFORCEMENT BOARD. WHEREAS, Florida law provides that the City Attorney shall either be counsel to the Code Enforcement Board or shall represent the municipality by presenting cases before the Code Enforcement Board, but in no case shall the City Attorney serve in both capacities; and WHEREAS, it was determined when the Code Enforcement Board was established that the Office of the City Attorney would present cases before the Code Enforcement Board; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. Funding for the continuation of services by special counsel to the City's Code Enforcement Board in an amount not to exceed $30,000 is hereby allocated from the 1986-87 Operating Budget. FLORIDA INTEROFFICE MEMORANDUM Members Lon N DATE: November 21, 1986 FILE: SUBJECT: Code Enforcement Board Special Counsel Funding REFERENCES: City Commission Meeting December 11, 1986 ENCLOSURE!: (i ) Pursuant to Resolution No. 88-1082, adopted October 24, 1983, Alan Rosenthal was engaged as special counsel to the City's Code Enforcement Board. Employment of special counsel to this Board is required by law since the City Attorney prosecutes code violations before the Board and is not allowed to both represent the Board and prosecute cases before the Board. The monies allocated as compensation at the time of Mr. Rosenthal's employment have been expended on a periodic basis and are nearly depleted. Accordingly, an additional allocation of an amount not to exceed $30,000 is hereby requested from funds which have already been appropriated in the 1986-87 Operating Budget.
