WHEREAS, the Miami Planninq Advisory Board, at its meeting of October 15, 1986, Item No. 5, following an advertised hearing, adopted Resolution PAR 40-86 by a vote of 9 to 0, RECOMMENDING APPROVAL, as amended, of amending Ordinance No. 9500 as hereinafter set forth; and WHEREAS, the City Commission after careful consideration of this matter deems it advisable and in the best interest of the qeneral welfare of the City of Miami and its inhabitants to amend Ordinance No. 9500 as hereinafter set forth; and NOW, THEREFORE, RE .IT ORDAINED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. Ordinance 9500, the Zoning Ordinance of the City of Miami, Florida is herein amended by adding a new Section 1614 entitled 11HC-5: Commercial -Residential Heritage Conservation Overlay District" as follows:l/ "ARTICLE: 16: HERITAGE CONSERVATION DISTRICTS Sec. 1614. Effect of HC-5 Overlay. Regulations Concerning Minimum Lot Requirements, Floor Area Limitations, Minimum Open Space, Minimum Yards, Building Spacing, Maximum Height, Offstreet Parkinq, and Landscapinq. Any existing structure, as identified in the designation report, shall be permitted to be repaired, restored, structurally altered, or changed to any use permissible within this district, notwithstandinq any co—nflicts with provisions of the underlying zoning district pertaining to minimum lot requirements, floor area limitations, minimum open space, minimum yards, -building spacing, maximum height, of.fstreet parking, or landscaping, -subject to a Certificate of Appropriateness as provided in Section 1614.6. New structures or additions to existing structures shall likewise be permitter, where necessary to promote the Preservation o_ existing istoric structures. Subject to the standards for a Certificate of Appropriateness as erovided in Section 1614.6, offstreet parking requirements may be modified by a Class C Special Permit as ollows: 1. In cases where a property owner has voluntarily elected to utilize provisions in Section 1614.3, 1614.4, or 1614.5 to change the permitted use, decrease parking requirements, or receive any other such benefit available in consideration of preserving a istoric structure, then the Heritage Conservation Board shall have the authority to deny a Certificate of Appropriateness for demoTition of the subiect historic structure(s) under the provisions of Section 1605.3. -1, if the Board finds that structures and improvements (of the property owner who has elected to utilize these provisions) remaining after the proposed demolition would continue to benefit from' the provisions o. the HC- over ay.' Section 2. All ordinances or parts of ordinances insofar as they are inconsistent or in conflict with the provisions of this ordinance are hereby repealed. Section 3. REQUEST To create a new HC-5 overlay district that can be applied to historic sites or historic districts in residential or commercial zoning districts. - BACKGROUND Both the HC-2 and HC-3 zoning districts offer a change of use from residential to office as the primary incentive for preservation of historic. - structures. HC-4 offers a bonus in the amount of floor area that can be built on a site. The proposed HC-5 district is needed to allow a change of use from residential to hotel/tourist home and limited retail use. ANALYSIS The HC-5 overlay district would contain the following provisions: - Change of use to hotels, tourist homes, or quest homes and by Class C special permit only, retail establishments compatible with the historic character of the district. - Accessory uses to service the hotel (maximum total floor area not to exceed 20 percent of gross floor area of principal use. - Modif ication of regulations concerning minimum lot requirements, floor area limitations, minimum open space, minimum yards, building spacing, maximum height, and landscaping. At its meeting of October 15, 1986, the Planning Advisory Board adopted Resolution PAB 40-86 by a 9 to 0 vote, recommending approval of the above. HC-51:, Commercial - Residential Heritage Conservation Overlay District as follows: -- "Sec. 1614. HC-5 Commercial -Residential Heritage Conservation Overlay District. 1614.1. Intent. This overlay district is intended to carry out the purposes of heritage conservation zoning districts as set forth in Section 1600. It is to be applied to historic sites or historic districts located within residential or commercial zoning districts where it is appropriate to encourage preservation - of historic structures and their grounds by providing for an economically productive adaptive reuse. This district is further intended to provide flexibility to permit development in an orderly manner consistent with the special significance and visual character of such buildings and grounds, and to safeguard against unnecessary destruction of the special historic significance and visual character of such buildings and grounds. 1614.2. Effect of HC-5 Overlay. The HC-5 overlay district shall have the effect of modifying requirements and procedures that apply to existing zoning districts indicated in the official zoning atlas, or zoning districts hereafter created and remaining after the HC-5 overlay district is superimposed, to the extent provided herein. All zoning requirements, regulations, and procedures not specifically modified by the HC-5 overlay shall remain in full force and effect. 1614.3. Permissible Principal Uses and Structures. 1614.3.1. Permitted Generally, Without Limitation on Location Within the Overlay District.
