ORDINANCE NO.;
AN ORDINANCE AMENDING ORDINANCE; NO. 9500, AS
AMENDED, THE ZONING ORDINANCE OF THE CITY OF
MIAMI, FLORIDA, BY AMENDING ARTICLE 16
ENTITLED "HC HERITAGE CONSERVATION DISTRICTS"
BY ADDING A NEW SECTION 1614 ENTITLED "HC 5:
COMMERCIAL -RESIDENTIAL HERITAGE CONSERVATION
OVERLAY DISTRICT," PROVIDING FOR INTENT,
EFFECT, PRINCIPAL AND' ACCESSORY USES AND
STRUCTURES, MINIMUM LOT REQUIREMENTS, FLOOR
AREA LIMITATIONS, MINIMUM OPEN SPACE, MINIMUM
YARDS, BUILDING SPACING, MAXIMUM HEIGHT,
OFFSTREET PARKING, LANDSCAPING AND
CERTIFICATE OF APPROPRIATENESS; CONTAINING A
REPEALER PROVISION AND A SEVERABILITY CLAUSE.
WHEREAS, the Miami Planninq Advisory Board, at its meeting
of October 15, 1986, Item No. 5, following an advertised hearing,
adopted Resolution PAR 40-86 by a vote of 9 to 0, RECOMMENDING
APPROVAL, as amended, of amending Ordinance No. 9500 as
hereinafter set forth; and
WHEREAS, the City Commission after careful consideration of
this matter deems it advisable and in the best interest of the
qeneral welfare of the City of Miami and its inhabitants to amend
Ordinance No. 9500 as hereinafter set forth; and
NOW, THEREFORE, RE .IT ORDAINED BY THE COMMISSION OF THE CITY
OF MIAMI, FLORIDA:
Section 1. Ordinance 9500, the Zoning Ordinance of the City
of Miami, Florida is herein amended by adding a new Section 1614
entitled 11HC-5: Commercial -Residential Heritage Conservation
Overlay District" as follows:l/
"ARTICLE: 16: HERITAGE CONSERVATION DISTRICTS
Sec. 1614. HC-5 commercial -residential heritage
conservation overlay district.
1614.1. Intent.
This overlay district is intended to carry out the
purposes of heritage conservation zoninq districts as

1614.2. Effect of HC-5 Overlay.
The HC-5 overlay district shall have the effect of
modifying requirements and procedures that appIX to

zoning atlas, or zoning districts hereafter created and

1614.5. Regulations Concerning Minimum Lot Requirements,
Floor Area Limitations, Minimum Open Space,
Minimum Yards, Building Spacing, Maximum Height,
Offstreet Parkinq, and Landscapinq.
Any existing structure, as identified in the
designation report, shall be permitted to be repaired,
restored, structurally altered, or changed to any use
permissible within this district, notwithstandinq any
co—nflicts with provisions of the underlying zoning
district pertaining to minimum lot requirements, floor
area limitations, minimum open space, minimum yards,
-building spacing, maximum height, of.fstreet parking, or
landscaping, -subject to a Certificate of
Appropriateness as provided in Section 1614.6. New
structures or additions to existing structures shall
likewise be permitter, where necessary to promote the
Preservation o_ existing istoric structures. Subject
to the standards for a Certificate of Appropriateness
as erovided in Section 1614.6, offstreet parking
requirements may be modified by a Class C Special
Permit as ollows:
1. Not less than two-thirds (2/3) of the number of
parking spaces t at would ordinarily be required
for a new structure of equivalent use and floor_
area shall be provided for existing or new
structures either onsite or at a remote location
within six hundred (600) feet of the subject site.
1614.6. Certificates of Appropriateness.

1614.6.2. Snecial Regulations Concerninq
Demolition.
In cases where a property owner has
voluntarily elected to utilize
provisions in Section 1614.3, 1614.4, or
1614.5 to change the permitted use,
decrease parking requirements, or
receive any other such benefit available
in consideration of preserving a
istoric structure, then the Heritage
Conservation Board shall have the
authority to deny a Certificate of
Appropriateness for demoTition of the
subiect historic structure(s) under the
provisions of Section 1605.3. -1, if the
Board finds that structures and
improvements (of the property owner who
has elected to utilize these provisions)
remaining after the proposed demolition
would continue to benefit from' the
provisions o. the HC- over ay.'
Section 2. All ordinances or parts of ordinances insofar as
they are inconsistent or in conflict with the provisions of this
ordinance are hereby repealed.
Section 3. If any section, part of section, paragraph,
clause, phrase or word of this ordinance is declared invalid, the
remaining provisions of this ordinance shall not be affected,

REQUEST To create a new HC-5 overlay district that can
be applied to historic sites or historic
districts in residential or commercial zoning
districts.
- BACKGROUND Both the HC-2 and HC-3 zoning districts offer a
change of use from residential to office as the
primary incentive for preservation of historic.
- structures. HC-4 offers a bonus in the amount
of floor area that can be built on a site. The
proposed HC-5 district is needed to allow a
change of use from residential to hotel/tourist
home and limited retail use.
ANALYSIS The HC-5 overlay district would contain the
following provisions:
- Change of use to hotels, tourist homes, or
quest homes and by Class C special permit
only, retail establishments compatible with
the historic character of the district.
- Accessory uses to service the hotel (maximum
total floor area not to exceed 20 percent of
gross floor area of principal use.
- Modif ication of regulations concerning
minimum lot requirements, floor area
limitations, minimum open space, minimum
yards, building spacing, maximum height, and
landscaping.

Section 1. Ordinance 9500, the zoning ordinance of the City of Miami, Florida
is herein amended by a adding a new Section 1614. HC-51:, Commercial -
Residential Heritage Conservation Overlay District as follows: --
"Sec. 1614. HC-5 Commercial -Residential Heritage Conservation Overlay
District.
1614.1. Intent.
This overlay district is intended to carry out the purposes of heritage
conservation zoning districts as set forth in Section 1600. It is to be
applied to historic sites or historic districts located within residential or
commercial zoning districts where it is appropriate to encourage preservation -
of historic structures and their grounds by providing for an economically
productive adaptive reuse. This district is further intended to provide
flexibility to permit development in an orderly manner consistent with the
special significance and visual character of such buildings and grounds, and
to safeguard against unnecessary destruction of the special historic
significance and visual character of such buildings and grounds.
1614.2. Effect of HC-5 Overlay.
The HC-5 overlay district shall have the effect of modifying
requirements and procedures that apply to existing zoning districts indicated
in the official zoning atlas, or zoning districts hereafter created and
remaining after the HC-5 overlay district is superimposed, to the extent
provided herein. All zoning requirements, regulations, and procedures not
specifically modified by the HC-5 overlay shall remain in full force and
effect.

convenience, public utilities and services, lighting, noise, or
other potentially adverse impacts on adjacent residential
areas;
2. The location and arrangement of parking and accQss drives shall
be compatible with special historic integrity and visual
character of the structure(s);

3. parking and service areas shall be adequately screened front
view of adjacent properties;
4. All signs, lighting fixtures, landseaoing, and other
appurtenant elements shall be suitable for the historic
character of the site and compatible with the surrounding area;
and
5. All plans shall be in accord with the intent and purpose of
this district and to the benefit of the general public.
1614.6.2. Special Regulations Concerning Demolition.

REQUEST To create a new HC-5 overlay district that can
be applied to historic sites or historic
districts in residential or commercial zoning
districts.
BACKGROUND Both the HC-2 and HC-3 zoning districts offer a
change of use from residential to office as the
primary incentive for preservation of historic
structures. HC-4 offers a bonus in the amount
of floor area that can be built on a site. The
proposed HC-5 district' is needed to allow a
change of use from residential to hotel/tourist
home and limited retail use.
ANALYSIS The HC-5 overlay district would contain the
following provisions:
- Change of use to hotels, tourist homes, or
guest homes and by Class C special permit
only, retail establishments compatible with
the historic character of the district.
- Accessory uses to service the hotel (maximum
total floor area not to exceed 20 percent of
gross floor area of principal use.
- Modification of regulations concerning
minimum lot requirements, floor area
limitations, minimum open space, minimum
yards, building spacing, maximum height, and
landscaping.
- Modification of offstreet parking
requirements by a Class C special permit,

Section 1. Ordinande 9500, the zoning ordinance of the City of Miami, Florida
is herein mended by a adding a new Section 1614, HC-N/ commercial-
Residential Heritage Conservation Overlay District as follows,
"Sec. 1614. HC-5 CoMIilercial-Aesidetitial Heritage Conservation Overlay
District.
1614.1, Intent.
This overlay district is intended to carry out the purposes of heritage
conservation zoning districts as set forth in SP.ction 1600. It is to be
applied to historic sites or historic districts located within residential or
commercial zoning districts where it is appropriate to encourage preservation
of historic structures and their grounds by providing for an economically
productive adaptive reuse. This district is further intended to provide
flexibility to permit development in an orderly manner consistent with the
special significance and visual character of such buildings and grounds, and
to safeguard against unnecessary destruction of the special historic
significance and visual character of such buildings and grounds.
1614.2. Effect of HC-5 Overlay.
The HC-5 overlay district shall have the effect of modifying
requirements and procedures that apply to existing zoning districts indicated
in the official zoning atlas, or zoning districts hereafter created and
remaining after the HC-5 overlay district is superimposed, to the extent
provided herein. All zoning requirements, regulations, and procedures not
specifically modified by the HC-5 overlay shall remain in full force and
effect.
1614.3. Permissible Principal Uses and Structures.
1614.3.1. Permitted Generally, Without Limitation on Location Within the
Overlay District.
The permitted uses and structures shall be as for the underlying zoning
district.
1614.3.2 Permissible Subject to Limitation Within the Overlay District.
The following uses, as principal uses, shall be permissible subject to a
Certificate of Appropriateness as provided in Section 1614.6; and shall
not be permissible in any case where the structures) of principal
— historic significance within a historic site or historic district, as
identified in the designation report, has (have) been destroyed or
damaged beyond repair for any reason:
1. Hotels, tourist homes, or guest homes.
2. By Class C special permit only, retail establishments for sale
of Oearing apparel, antiques, handicrafts; book stores open to
the general public (not to include adult book stores); gift
shops; florists; art stores; and other similar uses that are
compatible with the historic character of the district.

Any existing structure, as identified in the designation report, shall
be permitted to be repaired, restored, structurally altered, or changed to any
use permissible within this district, notwithstanding any conflicts with
provisions of the underlying zoning district pertaining to minimum lot
requirements, floor area limitations, minimum open space, minimum yards,
building spacing, maximum height, offstreet parking, or landscaping, subject
to a Certificate of Appropriateness as provided in Section 1614.6. New
structures or additions to existing structures shall likewise be permitted
where necessary to promote the preservation of existing historic structures.
Subject to the standards for a Certificate of Appropriateness as provided in
Section 1614.6, offstreet parking requirements may be modified by a Class C
Special Permit as follows:
1. Not less than two-thirds (2/3) of the number of parking spaces
that would ordinarily be required for a new structure of
equivalent use and floor area shall be provided for existing or
new structures either onsite or at a remote location within six
hundred (600) feet of the subject site.,
1614.6- Certificates of Appropriateness.
1614.6.1. Certificate of Appropriateness Required, Special Standards.
All applicable actions within the HC-5 overlay district shall be subject
to the requirements, procedures, and guidelines for Certificates of
Appropriateness, as set forth in Section 1605. In addition to the
guidelines set forth in Section 1605.3, the following standards shall be
observed in issuing Certificates of Appropriateness within this
district:
I. The project shall not cause undue negative impact on the
surrounding area in terms of compatibility with adjacent land
uses, vehicular ingress and egress, pedestrian safety and
convenience, public utilities and services, lighting, noise, or
other potentially adverse impacts on adjacent residential
areas;
2. The location and arrangement of parking and access drives shall
be compatible with special historic integrity and visual
character Qf the structure(s);
