Recommendation
It is respectfully requested and recommended that the City
Commission appoint three (3) persons to serve on the Miami River
Coordinating Committee.
Background
Originally named the Miami River Management Committee, this
Committee was created by Governor Bob Graham in December, 1983; in
1985 the present name was established. On September 11, 1986, the
City Commission passed and adopted Resolution No. 86-701 which
approved a "Memorandum of Understanding" between the City and Dade
County.
Two of the Committee's primary functions will be to continue to act
as a clearinghouse for informational and educational purposes and
to formulate and make recommendations for the Miami River's
restoration and enhancement.
In order to accomplish this, the "Memorandum", which was also
adopted unanimously by the Dade County Commission, provided for a
new committee to be appointed jointly by the City Commission,
County Commission and the Governor. The Governor's Committee will
expire by executive order on January 5, 1987. It is now
appropriate that the City Commission make its appointments.In
accordance with the Memorandum, the new committee is to be
appointed as follows.
1. The Committee shall be composed of eleven (11) members selected
as follows:
(a) The Manager, City of Miami, or his designated staff
member.
(b) Three (3) persons, appointed by the Miami City Commission,
who have demonstrated an interest in the protection and
enhancement of the Miami River and who 'are not elected
officials or employees of the City of Miami and who
represent an appropriate cross section of businesses,.
conservationists, property owners, and other citizens
interested in the welfare of the Miami River.

(c) The Manager, Metropolitan Dade County, or his designated
staff member.
( d ) Three ( 3 ) persons, appointed by t he Dade County
Commission, who have demonstrated an interest in the
protection and enhancement of the Miami River and who are
not elected officials or employees of Metropolitan Dade
County and who represent an appropriate cross section of
businesses, conservationists, property owners, and other
citizens interested in the welfare of the Miami River.
(e) One (1) staff member from the Florida Governor's Office.
(f) Two (2) persons, appointed by the Florida Governor, who
have demonstrated an interest in the protection and
enhancement of the Miami River and who are not elected
officials or employees of the State of Florida and who
represent an appropriate cross section of businesses,
conservationists, property owners, and other citizens
interested in the welfare of the Miami River.
2. Members selected under Paragraph 1(a), (c) and (e) shall
serve in perpetuity. Members selected under Paragraph
1(b) and (d) shall serve terms of 3, 2 and 1 years
respectively. Members selected under Paragraph 1(f) shall
serve terms of 3 and 2 years respectively. Vacancy on the
Committee shall be filled in the same manner as the
original appointments.
3. The Committee shall elect a chairman from among its
members. The Committee shall meet at the call of the
chairman. The Committee shall formulate its own rules and
regulations. Six members constitute a quorum for the
transaction of business.

correspondence received from the Marine Council and the Greater
Miami Marine Association. Both organizations have forwarded,
jointly, a number of names for consideration for appointment to
the committee.

BACKGROUND
the Commission adopt the attached memorandum of
City of Miami and Dade County which delineates
Miami River and establishes a Miami River
The Memorandum of Understanding clarifies and delineates the
responsibilities -of the City and County in governing and maintaining the
Miami River. In addition it recognizes the need for and establishes the
framework of an ongoing Miami River Coordinating Committee. The Committee
will be composed of three persons each appointed by the County and City
Commissioners and two appointed by the Governor. The County Manager, City
Manager and a member of the Governor's staff will occupy permanent seats on
the Committee.
The Miami River Coordinating Committee will act as a clearinghouse and make
recommendations to the County, City and other agencies that perform
functions and services relating to the river. The resolution does not
entail any provision of funds by the County for Committee staff or related
administrative expenses.
In December 1983 Governor Bob Graham created the Miami River Management
Committee by executive order to examine problems associated with the Miami
River and make recommendations for it's restoration and enhancement. Based
upon the accomplishments of the Committee as outlined in the first two annual
reports in the areas of derelict vessel removal, historic preservation,
planning, environment, business and economics, the Governor re—established
the Committee as the Miami River Coordinating Committee. This Committee's
primary charge was to create a framework for an on —going body to oversee this
most important community asset.
The attached Memorandum of Understanding was unanimously passed by the
Committee on June 18, 1986 and forwarded to both the County and City
Commissions for their endorsement. Governor Graham has expressed his firm
support of the memorandum. It is also supported by the Marine Council and
the Miami River Business Association.
The County Manager and his representative have served on and worked closely
with the Governor's Committee in formulating the numerous recommendations
during its three year- tenure. The Governor's Committee will expire by
executive order on January 5, 1987. The proposed new Committee will take
effect at that time.
This item was presented to the Environment and Land Use Committee on July
22, 1986. Commissioner Harvey Ruvin subsequently requested that it be
forwarded to the full Commission.

MEMORANDUM OF UNDERSTANDING BETWEEN THE CITY OF MIxmI,
DADE COUNTY AND THE STATE OF FLORIDA RELATING TO THE
MIAMI RIVER AND ITS TRIBUTARIES EAST OF THE
SALINITY STRUCTURE AT 36TH AVENUE
1. This agreement is made and entered into between the City of
Miami, hereinafter referred to as the "City", Metropolitan Dade County,
hereinafter referred to as the "County", and the State of Florida,
hereinafter referred to as the "State".
WITNESSETH:
WHEREAS, the parties hereto desire to clarify and delineate the
responsibilities of the City and the County in governing and maintaining
the Miami River; and
WHEREAS, the parties desire to establish the Miami River Coordinating
Committee to act as a clearinghouse of information for citizens needinc
assistance regarding any of the various agencies having jurisdiction
over the River, as well as other functions enumerated in Section B
of the agreement.
NOW, THEREFORE, IN CONSIDERATION OF THESE PREMISES AND MUTUAL
PROMISES CONTAINED HEREIN,.THE PARTIES HEREBY AGREE AS FOLLOWS:
A. DELINEATION OF RESPONSIBILITIES OF THE CITY AND COUNTY
'IN GOVERNING AND MAINTAINING THE MIAMI RIVER
1. The'City of Miami Marine Patrol is the primary agency responsible
for law enforcement from the mouth of the river to the City's boundary
which is just west of 27th Avenue.
2. The Metro -Dade Marine Patrol is the primary agency responsible
I for law enforcement from the City's boundary just west of 27th Avenue
to the salinity structure at 36th Avenue.
3. A mutual aid -agreement allows City and County law enforcement

agencies to cooperate and assist each other with routine law enforcement

sources of pollution, cleaning up contaminated sediments and preventing
future pollution of the river.
11. The City and County will undertake shoreline stabilization
and revegetation projects at suitable locations along the river as
grants and other sources of .funding become available.
12. Dade County will continue to provide the services of Ms.
Cleanup, a vessel which removes floating debris from the river.
13. The City and County will provide courtesy notice to the Dade
County Archaeologist when permitting developments along the Miami River.
14. The City and County will encourage activities which provide
public awareness of the Miami River and its rich heritage.
15. The City and County agree to respond promptly to reports
of code violations on riverfront properties.

B. MIAMI RIVER COORDINATING COMMITTEE
The City and County recognize the need for an ongoing Miami River
Coordinating Committee with a similar mix of public and private citizens
as previously created by Governor Bob Graham and such Committee is
hereby created.
1. The Committee shall be composed of eleven members selected
as follows':
(a) The Manager, City of Miami, or his designated staff member.
(b) Three persons, appointed by the Miami City Commission, who
have demonstrated an interest in the protection and enhancement of
the Miami River and who are not elected officials or employees of the
City of Miami and who represent an appropriate cross section of businesses,
conservationists, property owners, and other citizens interested in
the welfare of the Miami River.
(c) The Manager, Metropolitan Dade County, or his designated
staff member.

(d) Three persons, appointed by the Dade County Commission, who
have demonstrated an interest in the protection and enhancement of
the Miami River and who are not elected officials or employees of Metrc
tan Dade County and who represent an appropriate cross section of busi:

(e) One staff member from the Florida Governor's Office.
(f) Two persons, appointed by the Florida Governor, who have
demonstrated an interest in the protection and enhancement of the Miami
River and who are not elected officials or employees of the State of
Florida and who represent an appropriate cross section of businesses,
conservationists, property owners, and other citizens interested in
the welfare of the Miami River.

(b) work with the Miami River business community and act as a
liaison between that community and the City and County,

(c) be empowered to accept and expend grants and other donations
from City and County agencies or from private sources for the purposes
of carrying out its duties and responsibilities under this agreement,
(d) make recommendations for review and action by the appropriate
City, County and other agencies that perform functions and services
relating to the Miami River,
(e) establish its headquaters on the river, possibly at a park
or other public property,
(f) and make an annual report of its activities.
5. The creation of the Miami river Coordinating Committee shall
take effect upon the expiration of Executive Order Number 86-4 by Florida
#40#4,
Governor Bob Graham on January 5, 1987.
6. This acreement does not entail any provision of funds by the
City of Miami or Dade County for Committee staff or related administrat_vE
expenses either now or in the future.
IN WITNESS WHEREOF, the parties have executed this agreement this

ENRIQUE BURNETT
Enrique Burnett is a member of the'Board of Directors of the
Greater Miami Marine Association and is a sales manager for Key
Power, Inc., the GM Detroit Diesel Allison distributor for
Florida which has been located on the Miami River since 1937..
Mr. Burnett promotes their products throughout the Central and
South American countries.
A resident of Miami since 1981, Mr. Burnett is an active sail and
power boater and served as coordinator of GMMA's first So.
Florida Marine Flea Market.
Mr. Burnett is a resident of Miami where he lives with his wife
and two daughters who attend college.

CARLOS M. CAPOTE
Carlos Capote, 33, has been Vice President of River Marine Supply,
Inc., 275 S. W. 6th Street, Miami, since 1974. He is a 1974
graduate of Florida International University (B.B.A.) and
previously received an Associate in Arts Degree from Miami -Dade
Community College.
Mr. Capote is a member of the Greater Miami Marine Association
and served as its President in 1983. He lives with his wife and
two daughters in Southest Dade.
His responsibilities at River Marine Supply include Financial

PATRICK D. CUNNINGHAM
Patrick Cunningham has been President of Miami based Bertram -
Trojan, Inc. of Miami since 1982. Bertram -Trojan, Inc., which
makes high quality yachts for a world wide market, is a major
Dade County manufacturer and a daily user of the Miami River in
connection with its new boat testing program. Mr. Cunningham
joined Bertram in 1972 as Regional Sales Manager, later becoming
National Sales Manager and then Vice President Marketing, his
last position before becoming President.
Pat Cunningham was born in Detroit, Michigan and graduated from
Western Michigan University. He is a member of the boards of
directors of the National Boat Manufacturers Association and the
National Marine Manufacturers Association. He is a Trustee of
,..� the Greater Miami Chamber of Commerce and a member of the Board
of Governors of the Dade Manufacturers Council.
His memberships include The Marine Council and the Marine Indus-
tries Association of South Florida.
He resides with his wife Cathy and 3 children in south Dade
County.

Mr. Falkey is presently General Manager of Merrill -Stevens,
Dinner Key Division. He has been a long time Miami resident
and possesses a wide knowledge of marine matters through
education and broad experience in various facets of marina
related activities. His friendships with many civic and
governmental leaders makes necessary liaison between the
M.R.C.C. and existing empowered institutions a real possibility.
He is a member of The Society of Naval Architects and Marine
Engineers, past Vice -President Marine Council supervising the
Miami River Division; the Propeller Club; Admirals of the Fleet
of Florida; member and; technical consultant on environmental
permitting to the-M.R.B.A. It is noteworthy that in conjunction
with GreenleaftTelesca, engineers and architects; he was in
charge of all local, state and federal permits for marine pro-
jects as well as for solid waste disposal.

HENRY LEE GIVENS
Mr. Givens is the current chairman of the Miami Waterfront Board.
He has background in marketing, tourism, food distribution
particularly in the Caribbean area. He is the creator of a food
item sold throughout the Caribbean and in domestic department
stores.
Mr. Givens is Executive Director of Marketing and Caribbean
Affairs for Lynbird International, Inc. He has served as Busi-
ness Development Specialist for the Small Business Administration
and Project Director for the Dade County Department of Housing
and Urban Development.
He studied business management/administration at the Univer-
sity of Miami, Northwestern University and Miami -Dade Community
College.
He has been affiliated with GUTS, Grovites United to Survive, a corporation
developed to upgrade minority businesses of Coconut Grove. He is
a member of the Board of Directors for Miami -Dade Tourist and
Trade Authority and the board of the Family Health and Children
Services of Dade County.
He is chairman of the Minority Business Opportunity Committee Board
and chairman of the City of Miai Community Development Advisory
Board.
He is a member of the Culmer Advisory Board and the Eastern
Airlines Black Laymans Committee.
Mr. Givens is the recipient of a number of awards from the
Federal Government, Florida Memorial College, Edward Waters
College, Dade County, the City of Miami, the Micosukee and
Seminole Indians and the Dade County School System.

GEORGE M. GOOD
George Good is a management consulant and was President of Ber-
tram Yacht from 1974 - 1982, prior to which he was Vice President
of Marketing. Previously he was General Sales Manager for the
Chris Craft Corporation.
He is a member of the Bar of the State of Michigan and is a
graduate of the Georgtown University School of Law. He was born
in Holland, Michigan.
Mr. Good is President of The Marine Council, founding chairman
of the National Marine Manufacturers Association and past Presi-
dent of the American Boat and Yacht Council.* He is a former
director of the Greater Miami Chamber of Commerce and past member
of the Boating Safety Advisory Council, USCG appointed by the
Secretary of the Treasury. He was recently appointed chairman of
the Marine Industry Committee of the Greater Miami Chamber of
Commerce.

^ Since moving to Miami from Tampa in 1976, Mr. McNab has
been General Manager of Hyde Shipping Corporation located
on the Miami River. In this capacity he has had to create
elaborate business systems, deal with complicated inter-
national regulatory agencies as well as the U.S. Coast Guard.
The zoning and enviromental requirements of doing business
on a large scale have made him an expert in many such fields.
This knowledge of the Shipping Industry in general and the
Miami River enviroment specifically has earned him the respect
of River related businesses. He was elected President of the
Miami River Business Association in January 1986 and began a
major reorganization and expansion of that group.
He has taken a leadership role in efforts to assist the Dade
County Planning Department (Jane Evoy) and to secure coope-

JOHN K. MEYER
John K. Meyer is the President and CEO of the First Miami Group
of Companies and President of First Miami Development Co. He is
an active member of the South Florida Coordinating Council,
serving as Chairman of its Economic Development Coordination
Committee. He is a member of the Beacon Council, Organizational
Task Force, and is a Director of Homes for South Florida, a
private sector initiative to develop low income housing in Miami.
He is also active on the St. Hugh Church Parish Advisory Council
and is past president of the Carrollton School Parents
Association.
He graduated with Distinction and first in his class at the
Masters Degree Program of Georgetown University's School of
Foreign Service. As an Army Officer he was both Leadership
graduate and Distinguished Military Graduate and went on to serve
at The Pentagon as a Congressional Liaison Officer in charge of
Congressional affairs.
He joined Exxon Corporation Treasurers Department in 1972.
During his 7 year tenure at Exxon he was selected for the
Corporate Finance Program at Harvard Business School; he held
managerial positions with Exxon in Rio de Janiero, Coral Gables,
Houston, and New York. His last position was as the Treasurer of
Exxon Chemical Company of Brazil, whose annual sales were $100
million.
Subsequent to this he became Executive Vice President and Chief
Financial Officer of the Stadler Corporation, a diversified Dade
County real estate firm. During the 5 years at Stadler he was
responsible for numerous special projects as well as management of
eight operating companies involved in commercial and residential
real estate, with over 250 employees and sales associates.

David Ray is President of Atlantic Marine Supply, Inc., 260 S. W.
6th Street, Miami and President of the Greater Miami Marine
Association.
He has been a Miami resident since 1941 and was born in Terre
Haute, Indiana in 1939. He earned a BBA from the University of
Miami in 1961.
In addition to his membership in the Greater Miami Marine
Association, he is a member of the City of Miami Waterfront
Board, the Board of the Marine Industries Association of Florida,
the Marine Industry Committee of the Greater Miami Chamber of

of "Currents" he has come to possess a wide knowledge of River
matter and is a welcome speaker at civic affairs. ,
Mr. Snider is actively promoting this year's M.R.C.C.."Riverfest"
and has been successful in generating sponsorships and newsworthy
events for the occasion. His value beyond knowledge of the River
will lie is helping the M.R.C.C. create needed public awareness
in reference to River issues. He is active in the M.R.B.A.,

District of Florida and Middle District of Florida; Fifth Circuti
