RECOMMENDATION:
It is respectfully recommended that the City Commission adopt the
attached resolution authorizing an offer to purchase Lots 12, 13,
14, and 15, Kenilworth Revised Subdivision, Plat Book 5, Page
115, of the Public Records of Dade County, Florida, from Charles
Simon/Robert Simon/Sonya R. Summers, property owners as to estate
of Dorotny Simon, in connection with the South District Police
Substation.
BACKGROUND:
The General Services Administration Department has been
negotiating with the above property owners, as authorized by
Resolutions 86-289, and 86-290, since May, 1986. Two appraisals
were made on the property and these came in at $575,000 and
$660,000 respectively. Based on these figures, the City made an
offer to purchase of $679,250, which was* calculated by
determining the mid point between the two appraised values and
including a bonus. This offer was rejected by the property
owners and subsequently the file on the property was submitted to
the Law Department for condemnation.
Further negotiations involving the Law Department resulted in a
third appraisal solicitation which yielded a fair market value of
$760,000. The latter amount is the City's final offer to
purchase the property. The seller agreed to accept this offer
and to relinquish any claims for damages. In addition,
disclaimers will be given to the City from all tenants except one
body shop. If an agreement is not consummated based on this
final offer, the City will proceed with condemnation proceedings
to acquire the property.
