A RESOLUTION RATIFYING BY AFFIRMATIVE
VOTE BY 4/5'S OF THE CITY COMMISSION
THE EMERGENCY ACTIONS OF THE CITY
MANAGER OF ACCEPTING THE BID OF MCNEW
MARINE CONSTRUCTION, INC. AND
EXECUTING A CONTRACT WITH SAID FIRM
IN THE PROPOSED AMOUNT OF $1,373,577
FOR THE BASE BID AND FOR ADDITIVE
ALTERNATES ONE AND TWO FOR BAYSIDE
SPECIALTY CENTER - MIAMARINA
RENOVATION PROJECT; WITH MONIES
THEREFOR ALLOCATED FROM "MIAMARINA
RENOVATION PROJECT" FUNDS IN THE
AMOUNT OF $1,373,577 TO COVER THE
CONTRACT COST
WHEREAS, sealed bids were received December 9th, 1986, for
Bayside Specialty Center - Miamarina Renovation Project; and
WHEREAS, the City Manager and the Directors of the
Departments of Development and Public Works recommended that the
bid received from McNew Marine Construction, Inc., be accepted
as the lowest responsible and responsive bid; and
WHEREAS, monies are available for the proposed amount of the
contract, project expense, and incidentals from "MIAMARINA
RENOVATION PROJECT" funds; and
WHEREAS, there existed an emergency need to begin
construction on the project immediately; and
WHEREAS, the City Manager accepted the bid of McNew
Construction, Inc., and executed a contract with them for the
work;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY
OF MIAMI, FLORIDA:

Section 1. The City Manager's action in accepting the bid
of McNees Marine Construction in the proposed amount of
$1,373,577, for the project entitled "Bayside Specialty Center -
Miamarina Renovation Project" for the base bid and additive
alternates 1 and 2 is hereby ratified.
Section 2. The City Manager's written finding that a valid
emergency need existed herein and his action in executing a
contract with McNew Construction, Inc., for the above -mentioned
work are hereby ratified.
Section 3. The amount of $1,373,577 is hereby allocated
from Miamarina Renovation Project funds to cover the cost of said
contract.

REFERENCES CENTER - MIAMARINA
ENCLOSURES RENOVATION PROJECT
It is respectfully recommended that the City Commission adopt the
attached resolution ratifying the actions of the City Manager of
accepting the bid of McNees Marine Construction, Inc. and
executing a contract in a proposed amount of $1,373,577 for the
base bid and for Additive Items 1 and 2, for Bayside Specialty
Center - Miamarina Renovation Project, with monies therefor
allocated from Miamarina Renovation Project funds in the amount
of $1,373,577 to cover the contract costs.
BACKGROUND:
The Department of Public Works evaluated the bids received
December 9, 1986 for the Miamarina marine facilities which are
adjacent to the Bayside project, with the intention of asking
the Commission to award a contract to the lowest acceptable
bidder at the December 11 Commission Meeting. Because of
miscommunication between the Departments of Public Works and
Development, the Mayor and Commissioners failed to receive
information on the two projects prior to its scheduled time for
consideration by the Commission, and therefore the item of
awarding the contract was not taken up at the meeting.

The next available Commission Meeting for the award of the
contract would have been January 8, 1987, but the Departments of
Public Works and Development believed that delaying the starting
of the work covered by the contract until that time would likely
result in the project not being completed by the proposed opening
date of Bayside, April 7, 1987. Accordingly, the City Manager
proceeded with the acceptance of the lowest acceptable bid and
the execution of a contract with the firm.
The lowest acceptable bidder was McNees Marine Construction
Company, Inc. They are a female -owned firm whose bid of
$1,373,577 for the base bid and Additive Alternate Items 1 and 2
is well under the City's consultants' estimate of the cost of the
work. The Directors of the Departments of Public Works and
Development recommended the award of the contract to them. Funds
for the project are available from Miamarina Renovation Project
funds.

ENCLOSURES.
Based on information supplied to me by the Directors of the
Departments of Development and Public Works I have found
that there exists an emergency need to accept the lowest
responsive and responsible bid of McNew Marine Construction,
Inc. for Bayside Specialty Center - Miamarina Renovation
Project and execute a contract with the amount of $1,373,577
for the Base Bid plus Additive Alternates 1 and 2.
The reason for the emergency need is as follows:
* Bids were received on the project December 9, 1986
with the intention of awarding a contract on December
10, 1986. The contract was not awarded on December
10, 1986 and the next scheduled commission meeting is
January 8, 1987. To wait unti 1 January 8, 1987 to
award a contract would cause the project not to be
completed by the date of the opening of Bayside.
