HomeMy WebLinkAboutR-87-0053J-86-1083 12/10/86 RESOLUTION NO. 7_- 5 3 A RESOLUTION AUTHORIZING THE CITY MANAGER TO EXECUTE AN AMENDED AGREEMENT WITH THE PIER 5 BOATMEN'S ASSOCIATION, INC., IN A FORM ACCEPTABLE TO THE CITY ATTORNEY; INCORPORATING CERTAIN TERMS AND CONDITIONS; REALLOCATING TWO HUNDRED AND FIFTY THOUSAND ($250,000.00) FROM THE CAPITAL IMPROVEMENT PROGRAM BUDGET FOR 1985-86 FOR THE PURPOSE OF MAKING IMPROVEMENTS TO MIAMARINA; AND FURTHER AGREEING TO REPLACE FUNDS ADVANCE FROM FEES TO BE PAID BY THE PIER 5 BOATMEN'S ASSOCIATION FOR THE USE OF THE MIAMARINA FACILITIES. WHEREAS, in order to implement the development of the Bayside Specialty Center and parking garage at Miamarina, the City Commission by Resolution No. 85-1030 dated October 10 , 1985 authorized the City Manager to enter into an Agreement with the Pier 5 BOATMEN, (hereinafter described as "BOATMEN") to construct a temporary dockage facility at the north edge of the FEC property in order to accommodate approximately thirty five (35) boats which were vacating Miamarina; and WHEREAS, it is economically advantageous to the City and the BOATMEN not to construct the proposed temporary FEC facility set out in the agreement; and WHEREAS, the BOATMEN have expressed a desire to relocate back to Miamarina rather than relocating to a temporary dockage facility at the FEC property to be constructed by the City; and WHEREAS, it is in the best interest of the citizens of the City of Miami to enter into an amended Agreement relocating the BOATMEN to Miamarina. NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The City Manager is hereby authorized to execute an amended agreement with the Pier 5 BOATMEN'S Association, Inc. in a form acceptable to the City Attorney, relocating the BOATMEN to Miamarina and containing t Ct5iftSSION provisions: MEETING OF J AN8 1987 RESOLUTION NoB 5 3 (a) Construction of certain improvement as set forth in Exhibit A attached hereto at a cost not to exceed two hundred and fifty thousand dollars ($250,000.00). (b) Enter into a one year mooring and dockage agreement with nineteen (19) one year options, subject to the terms and conditions of all applicable Miamarina and Bayside Agreements, at rates established by City ordinance. Section 2. The City Manager is hereby further authorized to reallocate an amount not to exceed two hundred and fifty thousand ($250,000.00) from the Capital Improvement Project Fund No. 41-3006, to be repaid from BOATMEN mooring and dockage fees at Miamarina for the cost of constructing improvements, as set out in Exhibit A attached hereto, and to cover any other incidental costs that may result as a consequence of this amended agreement. Item #6: Trash containers. $35,000.00 Included Included Item 47: Surface area for existing dock must be increased by a minimum of four (4) feet in width throughout the area proposed to be occupied by the BOATMEN: Included Item #8: Canopy over fish selling area. (Canvas or equal). Approximately 3,000 square feet. $60,000.00 Item 49: Mercury vapor lights to highlight boats during evening hours. Included Item 410: Ticket selling booths for drift boats and sailboats to be allowed to exist on the dock behind those boats. $10,000.00 Item #11: Ability to clean and sell fish behind each charter or commercial boat inclusion of sump pump. $15,000.00 Item 412.
