A RESOLUTION AUTHORIZING AN INCREASE IN THE
CONTRACT AMOUNT OF $300,000 IN THE CONTRACT
BETWEEN THE CITY OF MIAMI, FLORIDA AND P.N.M.
CORPORATION DATED JANUARY 4, 1986, FOR THE
CONSTRUCTION OF BAYFRONT PARK REDEVELOPMENT -
PHASE II, SAID FUNDS TO BE PROVIDED FROM
FUNDS ALREADY ALLOCATED FOR THE PROJECT;
FURTHER RATIFYING THE CITY MANAGER'S WRITTEN
FINDINGS THAT THE HEREIN INCREASE RESULTED
FROM EMERGENCY CIRCUMSTANCES BY AN
AFFIRMATIVE VOTE OF 4/5THS OF THE MEMBERS OF
THE CITY COMMISSION, AND ADOPTING THE
FINDINGS AND CONCLUSIONS SET FORTH IN THE
PREAMBLE OF THIS RESOLUTION.
WHEREAS, there exists a contract dated January 4, 1986
between the City of Miami, Florida and P.N.M. Corporation for the
construction of Bayfront Park Redevelopment - Phase II; and
WHEREAS, an increase in contract of $300,000 is required to
cover the costs of modifications to the light tower and service
building, additional work in the maintenance space, changes in
aera lighting within the park, the extension of color sidewalks
into the amphitheater area, the renovation of the existing
irrigation system pump house, and proposed additional drainage
within the amphitheater; and
WHEREAS, the City Manager has made a written finding that a
valid emergency exists for the increase; and
WHEREAS, the directors of the Departments of Development and
Public Works recommend an increase in contract to cover
additional costs; and
WHEREAS, funds to cover the increase are available from
monies already allocated for the project;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY
OF MIAMI, FLORIDA:
Section 1. After a properly advertised public hearing, the
findings of the City Manager set forth in the preamble to this
resolution is hereby ratified by an affirmative vote of 4/5ths of
the City Commission, and adopted as fully set forth in this
section.

Section 2. The contract between the City of Miami, Florida
and P.N.M. Corporation for the construction of Bayfront Park
Redevelopment - Phase II, dated January 4, 1986 is hereby
increased by $300,000 with funds for the increase to be provided
from monies already allocated for the project.

RECOMMENDATION:
It is respectfully recommended that the City Commission adopt the
attached resolution authorizing an increase in the contract
amount of $300,000 in the contract between the City of Miami and
P.N.M. Corporation dated January 4, 1986 for the construction of
Bayfront Park Redevelopment - Phase II. Funds to be provided
from funds already allocated to the project, further ratifying
the City Manager's written findings that the herein increase
resulted from emergency circumstances by an affirmative vote of
4/5ths of the members of the City Commission, and adopting the
findings and contract set forth above.
BACKGROUND:
The Department of Public Works has analyzed the situation and
determined that there exists a need for an increase in the amount
of the contract for Bayfront Park Redevelopment - Phase II. The
City received bids and awarded a contract to P.N.M. Corporation
for the construction of the subject project on January 4, 1986 in
a very hurried manner because conditions of several grants
partially funding the park redevelopment stipulated that work
begin by January 1, 1986 (the contractor actually started work in
December 1985 after he was awarded the contract but before the
contract was executed by the City Manager). As is typical of a
"fast track" project such as this, the design of future phases of
the park re -development was not completed at the time of award of
a contract. The fact that the total design was not completed
caused, and is causing changes and additions to have to be made
during the construction of Phase II. The requested increase
would fund the extra cost caused by these changes and additions.
The City has received price quotations from the contractor on the
project for all of the changes and additions and the consultants
have determined that they are in concurrence with the unit prices
used by the contractor in preparing his bid for the work covered
under the contract and thus they are fair and reasonable.
Further, the consultant and City personnel have determined that
should this work not be done under the present contract but done
later in a future phase of the work, the cost would be
considerably higher.

Delaying the work for future contract would also cause that
portion of the park redevelopment that we desire to have
completed to coincide with the opening of Bayside to be
unfinished and unsightly at the time of the opening. Further,
it would cause the Light Tower and Amphitheater to be unfinished
for the expected visit by the Pope in early September.
A listing of the changes and additions that have caused this
need for increasing the contract are listed separately and added
to this memorandum.

Based on information supplied to me by the Directors of the
Departments of Public Works and Development, I have found that
there exists an emergency need for an increase in contract amount
of $300,000 in the contract between the City of Miami and P.N.M.
Corp. for the construction of Bayfront Park Redevelopment - Phase
II.
The reason for the emergency is as follows: The consulting
Architects have determined that changes in work and additional
�+ work necessary for the full development of the park can be done
more economically and conveniently under the present construction
than in future phases of the park development.

Additionally, the work needs to be done on the present contract
in order to have the north end of the park in an essentially
completed condition to coincide with the April 7 opening of
Baysi de.

LIST OF WORK TO BE COVERED BY THE
REQUESTED $300,000 INCREASE IN
CONTRACT AMOUNT ON BAYFROTIT PARK
REDEVELOPMENT - PHASE II
1. Changes and additions to the Light Tower that will add:
1) To the laser capabilities
2) Fogging capability to enhance laser show
3) Lighting of the inner tower
4) Structural and architectural changes
The cost of the- changes and additions
will cost:
$ 92,000
2. Modifications to the Service Building ordered by the
Consultant. These modifications basically "flopped"
the east end of the building over, causing us to have
to make structural, electrical, mechanical and
architectural changes. The changes were made to
make the Service Building better coordinated with
the stage and amphitheater to be constructed as part
of Phase III of the redevelopment.
These modifications will cost: $ 53,000
3. The changing of the Amphiwalk (the walkway around
the periphery of the Amphitheater) from the
originally specified "Z" block pavers salvaged from
the existing sidewalk of Biscayne Boulevard, to
sandblasted colored concrete as is being constructed
in the rest of the park. The additional cost for
this work will be: $ 44,000
4. The plans and specifications for the project did not
include any provision for renovating and reusing the
existing irrigation system pump house outside the
limits of the project to be used for the irrigation
system being installed as part of the park
redevelopment. It was the understanding of the
Consultants that the pump house, including the pump
and electrical gear, was in good order and if any
renovations were to be made, they would be made by
the Bayside development. After the contractors left

We became aware that Bayside had no intention of
using the pump house and so it is necessary to
cover renovation of it under the existing contract.
The cost of this renovation is estimated to be: $ 19,000
5• Additionally, and also pertaining to the pump
house:
The existing electrical service to the pump house
is presently of a temporary nature from Biscayne
Blvd., (an aerial service). This temporary
electrical service was put in when the old Bayfront
Park Auditorium was demolished to allow for the
construction of Bayside. Once again, it was
thought by the Consultants that any new electrical
required for the pump house would be provided as
part of the Bayside project, but the Rouse Company
disagrees. Further, the Rouse Company would not
allow a service to the pump house from their
service point, and forced us to bring the service
from the bight Tower, some 600 feet south. The
cost of this additional work will be: 16,000
6. The plans and specifications for the project call
for the removal of existing sidewalks along
Biscayne Blvd. and replacing them with a 20-foot,
4" thick concrete sidewalk. The Construction
Engineer of the Department of Public Works
directed the contractor to make the new sidewalks
6" thick with wire mesh because they are subject
to unusual loads by such events as the Orange Bowl
Parade. The additional cost of this work is: $ 16,000

7. Due to haste in getting plans and specifications out
for bids, there were numerous discrepancies between
various portions of the plans. In one instance, the
architectural plans showed a particular type of
lighting in the area around the Light Tower, but the
electrical plans clearly specified by model number
and description a different lighting fixture. The
architect wants the more expensive fixture. The
additional cost for this item will be:
8. When plans were put out for bids, again due to the
haste in the work, three plan sheets were
inadvertently left out of the bid set of plans.
These plan sheets pertained to work to be done in
the maintenance space. We have determined that the
cost of including this work on the present
construction would be:
TOTAL COST
The total of $325,000 shown above will be partially
funded by credits we expect to receive from the
contractor for other unmentioned changes in the work. It
is the judgment of the Public Works Department that this
$300,000 increase, when incorporated with all other
numerous additional costs and credits, will allow us to
complete Phase II of the redevelopment in a satisfactory
and complete manner.
