A RESOLUTION AUTHORIZING THE PAYMENT FOR
A THIRD APPRAISAL BY THEODORE SLACK,
MEMBER OF THE AMERICAN INSTITUTE OF REAL
I ESTATE APPRAISERS, AT A FEE OF $5,000 TO
FACILITATE A NEGOTIATED PURCHASE IN LIEU
OF CONDEMNATION OF LOTS 12, 13, 14 AND
15, KENILWORTH REVISED SUBDIVISION, AS
RECORDED IN PLAT BOOK 5, PAGE 115, OF THE
PUBLIC RECORDS OF DADE COUNTY, FLORIDA;
FUNDS COVERING THE COST OF THIS APPRAISAL
BEING ALLOCATED FROM 1984 MIAMI POLICE
HEADQUARTERS AND CRIME PREVENTION
FACILITIES BONDS.
WHEREAS, Resolution 85-916 passed and adopted September 12,
1985, authorized acceptance of two appraisals of Lots 12, 13, 14
and 15, of Kenilworth Revised Subdivision, as recorded in Plat
Book 5, Page 115, of the Public Records of Dade County, Florida,
in connection with the South District Police substation; and
WHEREAS, Resolution 86-289 passed and adopted April 10,
1986, established City policy for negotiated purchases to provide
a bonus to property owners; and
WHEREAS, Resolution 86-290 of the same date authorized
offers to be made to landowners for the acquisition of thirteen
lots in connection with the South District Police Substation; and
WHEREAS, based on these two appraisals an offer of $679,250

was made and such offer was rejected by the owner; and
WHEREAS, condemnation proceedings to acquire the property
began and led to further negotiations; and
WHEREAS, the City sought a third appraisal in an effort to
facilitate a more timely settlement in lieu of condemnation; and
WHEREAS, the services of Theodore Slack, member of the
American Institute of Real Estate Appraisers were secured at a
fee of $5,000; and
WHEREAS, the property owner is willing to accept $760,000
which was the appraised FAIR MARKET VALUE of the Slack appraisal
and relinquish any claims for damages; and

NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY
OF MIAMI, FLORIDA:
Section 1. The City Manager hereby authorizes payment to
Theodore Slack, member of the American Institute of Real Estate
Appraisers, at a fee of $5,000 for a third appraisal of the
property more particularly described as Lots 12, 13, 14, and 15,
of Kenilworth Revised Subdivision, as recorded in Plat Book 5,
Page 115, of the Public Records of Dade County, Florida, as part
of the acquisition for the South District Police Substation.
Funds covering the cost of this appraisal are hereby allocated
from 1984 Miami Police Headquarters and Crime Prevention Facilities
Bonds.
PASSED AND ADOPTED this 8th day of January 1987.

It is respectfully recommended that the City Commission adopt the
attached resolution authorizing the payment of $5,000 as a fee to
Theodore Slack, member of the American Institute of Real Estate
Appraisers for a third appraisal of Lots 12, 13, 14, and 15 of
Kenilworth Revised Subdivision, as recorded in Plat Book 5, Page
115, of the Public Records of Dade County, Florida, as part of
the land acquisition for the South District Police Substation.
BACKGROUND:
Resolution 85-916 passed and adopted September 12, 1985,
authorized two appraisals of the above described lots for
acquisition as part of the South District Police Substation.
Based on these appraisals an initial offer was made to the owner
in May, 1986, of $679,250. This offer was rejected and
subsequently, the file on the property was submitted to the Law
Department for condemnation.
Further negotiations involving the Law Department resulted in a
third appraisal solicitation which yielded a fair market value of
$760,000. The latter amount is the City's final offer to
purchase the property. The seller agreed to accept this offer
and to relinquish any claims for damages. In addition,
disclaimers will be given to the City from all tenants except one
body shop. If an agreement is not consummated based on this
final offer, the City will proceed with condemnation proceedings
to acquire the property.
