RESOLUTION NO.
87-13
A RESOLUTION AUTHORIZING THE CITY MANAGER TO
NEGOTIATE AGREEMENT(S), IN A FORM ACCEPTABLE
TO THE CITY ATTORNEY, WITH INDIVIDUALS AND/OR
BUSINESSES DESIRING TO PLACE ADVERTISEMENTS
INSIDE THE MIAMI ORANGE BOWL AND MIAMI
BASEBALL STADIUMS, EACH SUCH NEGOTIATED
AGREEMENT BEING SUBJECT TO COMMISSION
APPROVAL PRIOR TO EXECUTION THEREOF UNTIL
COMMISSION ADOPTION OF A SCHEDULE OF RATES OR
APPLICABLE CHARGES FOR THE PLACEMENT OF SAID
ADVERTISEMENTS.
WHEREAS, the Miami Orange Bowl and Miami Baseball Stadiums
are focal points for national televised sports and other
entertainment events; and
WHEREAS, the Department of Parks, Recreation and Public
Facilities has been approached by several individuals and
businesses that desire to place paid commercial advertisements in
said stadiums; and
WHEREAS, it is anticipated that the City will realize an
estimated $200,000 net advertising revenue for such promotions;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY
OF MIAMI, FLORIDA:
Section 1. The City Manager is hereby authorized to
negotiate agreements, in a form acceptable to the City Attorney,
with individuals and/or businesses desiring to place
advertisements inside the Miami Orange Bowl and Miami Baseball
Stadiums, each such negotiated agreement being subject to
Commission approval prior to execution thereof until Commission
adoption of a schedule of rates or applicable charges for the
placement of said advertisements.

RECOMMENDATION
It is respectfully recommended that the City Commission adopt the
attached resolution authorizing the City Manager to negotiate and
execute agreements, in a form acceptable to the City Attorney,
with individuals and or businesses desiring to place paid
advertisements in the Orange Bowl and Miami Baseball Stadiums;
further authorizing payment of commission, in an amount not to
exceed 20% of gross advertising fees paid to the City, to
advertising agencies representing such individuals and/or
business.
BACKGROUND
The Department of Parks, Recreation and Public Facilities has
prepared the attached legislation concerning advertisement in the
City's Orange Bowl and Miami Baseball Stadiums. As part of the
transition of operations in the post Dolphin period, it is
necessary that the City aggressively seek new revenue sources for
its public facilities. One such is advertising.
In past years, the Miami Dolphins rented the large sign on the
Orange Bowl Scoreboard to Winston Cigarettes (Reynolds Tobacco
Company) for $150,000 per year ,for five years. Based on the
City's agreement with the Dolphins, the City was to receive one-
half of such fees, less commission paid by the Dolphins to the
tobacco company's ad agency. Recently, Marlboro Cigarettes
(Phillip -Morris, Inc.) has shown interest in using the same sign
at a fee of $160,000 per year for five years, less advertising
commission.
The Department of Parks, Recreation and Public Facilities
anticipates that several other companies presently having signs
in the Orange Bowl will renew those rights witn the City
providing in excess of $200,000 in net advertising revenue.
Furthermore, the City will not share any of these fees with any
major tenant of the stadiums.
The attached resolution will allow for the timely negotiation and
execution of advertising contracts with existing and potential
sponsors.
