HomeMy WebLinkAboutO-10207J - 8 7 - 6 3 1/8/87 ORDINANCE NO. 0207 AN EMERGENCY ORDINANCE AMENDING SECTION 1 OF ORDINANCE NO. 10187, ADOPTED DECEMBER 111 19861 THE CAPITAL IMPROVEMENT APPROPRIATIONS ORDINANCE, BY ESTABLISHING A NEW CAPITAL IMPROVEMENT PROJECT ENTITLED: "MIAMARINA RENOVATION PROJECT" AND APPROPRIATING FUNDS FOR ITS OPERATION IN AN A1MOUNT NOT TO EXCEED $1,500,000 FROIM MARINA REVENUE BOND FUNDS; CONTAINING A REPEALER PROVISION AND A SEV- ERABILITY CLAUSE, WHEREAS, on January 14, 1985, the City and Bayside Center Limited Partnership (hereinafter referred to as " Bayside") entered into a lease for the development of a waterfront speciality center and a lease for the development of a parking faciltity pursuant to which the City leased to Bayside certain property located on the North end of Bayfront Park; and WHEREAS, pursuant to an agreement entered into on October 24, 1985, between theCityand Bayside, the City agreed to restore the structural integrity of the Miamarina including the piers, docks, pilings, quays, seawall, lighting and the original design depth of the marina; and WHEREAS, this commitment was reaffirmed by Motion 86-600 at the City Commission meeting of July 24, 1986; and WHEREAS, by Resolution No. 86-949, adopted on November 25, 1986, the City Commission accepted the bid of Dantzler Lumber and Export, Inc. for the purchase of 500 piles for the Miamarina renovation project at a total cost of $71,000; and WHEREAS, in order to complete the renovation of the Miamarina in time for the opening of the Bayside Speciality Center in April 1987, construction must have commenced no later than, January 1, 1987; NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. Section l.of Ordinance No. 10187, adopted December 11., 1986, is hereby amended in the following particulars; 1/ "Section 1. The following appropriations hereby made by use, fund and project title include previously authorized projects and fund appropriations for implementation of all municipal capital improvements of the City of Miami, Florida. The source of revenues to support the herein appropriations are hereby identified by fund and project: 1/Words and/or figures stricken through shall be deleted. Underscored words and/or figures shall be added. The remaining provisions are now in effect and - remain unchanged, Asterisks indicate omitted and unchanged material. All ordinances or parts of ordinances insofar as they are inconsistent or in conflict with provisions of this ordinance are hereby repealed. Section 3. If any section, part of section, paragraph, clause, phrase or word of this ordinance is declared invalid, the remaining provisions of this ordinance shall not be affected. Section 4. This ordinance is hereby declared to be an emergency measure on the grounds of urgent public need for the preservation of peace, health, safety, and property of the City of Miami and upon the further grounds of the necessity to make the required and necessary payments to generally carry out the functions and duties of municipal affairs. Section 5, The requirements of reading this ordinance on two separate days is hereby dispensed with by a vote of not less than four -fifths of the members of the Commission. O d i b REFERENCES FROMCity Manager For the City Commission Meeting of Jan. 8, 1987 ENCLOSURES ■ RECOMMENDATION: It is respectfully recommended that the City Commission adopt the attached Emergency Appropriations Ordinance establishing a new capital project entitled the "Miamarina Renovation Project" and appropriating funds for this project in the amount of $1,704,000 from contributions fron the sale of Marina Revenue Bonds. BACKGROUND: P� co The Department of Development recommends that the attached Emergency Appropriations Ordinance be adopted establishing the Miamarina Renovation Project as a new capital project and appropriating $1,704,000 from contributions from the sale of Marina Revenue Bonds to cover the costs of this project. In order to ensure that the Miamarina Renovation Project is completed in time for the April 8, 1987 opening of the Bayside Specialty Center, construction on this project must have commenced on or before January 1, 1987. It is requested that this Emergency Appropriations Ordinance be considered as a Companion Item to the Resolution ratifying the City Manager's award of the construction contract for the Miamarina Renovation, Project, on the January 8, 1987 Agenda.
