REVENUE 'FUND IN THE COMMtRITY DEVELOPMENT DLOCK GRANT PUND (CDBG) ACCOUNT ELEVENTH YEAR, WHICH AMOUNT IS ALSO BEING TRANSFERRED. FROM, SAID FttND TO THE CDBG ELEVENTH YEAR CONTINGENCY' BUDGET FUND; CONTAINING A REPEALER PROVISION AND A' SEVERABILITY CLAUSE, WHEREAS, on November 18, 1985, an agreement was reached. between the City of Miami and Metropolitan Dade County over, a dispute regarding the latter's takeover of the Miami -Dade Water, And Sewer Authority; and - WHEREAS, as a result of said agreement the ,City received the amount of $1,573,663.39 for reimbursement of Sanitary Sewers constructed by the City with Sanitary Sewer G.O. Bond Funds and Community Development Block Grant Funds and $987,401.75 of the reimbursement amount was returned to the Sanitary Sewer Bond Fund account and the remaining. $586,261.64 to the Community Development Block Grant Fund account as a .Special Revenuer Fund; and WHEREAS said amount of $1,573,,663.39 represents reimbursement to the City of Miami for sewer improvements which were an obligation of the Water and Sewer Authority i,under the 1975 Tripartite Agreement; and WHEREAS, said amount was credited to the Eleventh Year Community Development account, in compliance with federal rules and regulations, as .program 'income to fund other eligible activities and WHEREAS, said sum will be made available through this ordinance to provide financial and technical assistance to minority entrepreneurs seeking to locate in, the City 's:Bayside specialty. Center, as reflected in Resolution No, 86-216, adopted March 18, 1956; _a' 4 NOW, THtREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY OF MIA81 , FbOB,IDA Section 1, (a) The following esouz ces are hereby appropriated as budget funds as described herein: $586,161.64 Prot the Community Development Block Grant (CDBG) Eleventh Year revenue fund to the Community Development Black Grant (CDBG) Eleventh 'Year contingency budget fund, said amount being made available as a result of the settlement of the City's dispute with bade County over the County's assumption of control over the Miami -Dade Water and Sewer Authority. (b) The City administration, in the interest of fairness, shall notify all recipients of these funds pursuant' to Resolution No 86-216 that. there will 'be zero dollars available from Federal Revenue Sharing funds next year and in ensuing years. Section 2 All ordinances or parts of ordinances .insofar as they are inconsistent or in conflict with the provisions of this ordinance are hereby repealed. Section 3. If any section, part of section, paragraph, clause,,phrase,or word of this ordinance is declared invalid, the remaining provisions of this ordinance shall not_ be affected.
