HomeMy WebLinkAboutR-87-0143J-87-113 1/26/87 RESOLUTION NO. 87-143 A RESOLUTION AUTHORIZING THE PROPER OFFICIALS TO EXECUTE A QUIT CLAIM DEED TO PIO CUESTA FOR THE EAST 10 FEET OF LOTS 15 AND 16, BLOCK 5, PARKER'S FLAGLER HEIGHTS (18-32) WHEREAS, in 1951, Captain Sigurd Olsen and Mae Olsen, his wife, deeded to the City of Miami the East ten (10) feet of Lots 15 and 16, Block 5 of PARKER'S FLAGLER HEIGHTS, according to the Plat thereof, as recorded in Plat Book 18 at Page 32 of the Public Records of Dade County, Florida: and WHEREAS, this deed was executed and delivered to the City of Miami for the purpose of widening N.W. 47 Avenue as the street was then zoned 70 feet in width; and WHEREAS, this project has since been abandoned and the ten (10) additional feet is no longer needed as N.W. 47 Avenue has been re -zoned to its original 50 feet; and WHEREAS, the present owner of said Lot 15 and 16 has requested by letter the return of said East ten (10) feet; and WHEREAS, the Department of Public Works sees no hardship or problem for the City of Miami by this return of 10 feety NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. That the East ten (10) feet of Lots 15 and 16, Block 5 of PARKER'S FLAGLER HEIGHTS, according to the plat thereof as recorded in Plat Book 18 at Page 32 of the Public Records of Dade County, Florida be returned to Pio Cuesta, the present owner, since this area is no longer needed by the City for right-of-way purposes. That the City Manager and City Clerk of the City of Miami are hereby authorized to execute a quit claim deed to Pio Cuesta for the aforementioned area. Odlo City Manager RECOMMENDATION: DATE: F E D 41987 PILE: SUIlJECT: Resolution Authorizing City Manager to Execute a Quit Claim Deed to REFERENCES: P to Cuesta, 100 N.W. 47 th Avenue ENCLOSURES: It is respectfully recommended that a resolution be adopted granting a quit claim deed to Pia Cuesta for the East 10 feet of Lot 15 and 16, Block 5, Parker's Flagler Heights (18-32) by the City Commission of Miami, Florida. BACKGROUND: The Department of Public Works has been requested by Pio Cuesta to return property deeded by Mr. and Mrs. Olsen to the City of Miami in 1951 for right-of-way purposes; namely the East 10 feet of Lots 15 and 16, Block 5, Parker's Flagler Heights (18-32). This deed was recorded in Deed Book 3480 at Page 585 of the Public Records. The additional 10'feet was for the purpose of widening N.W. 47th Avenue as part of an overall plan of the City to make streets on Section Lines 70 feet in width. This project has since then been abandoned and the street rezoned to 50 feet. The present owner of this lot has requested by letter the return of this 10 feet and this department sees no problem in returning it to him.
