HomeMy WebLinkAboutR-87-0140J-87- 151 1/27/87 RESOLUTION NO. 87--i4D- A RESOLUTION AUTHORIZING THE CITY MANAGER TO EXECUTE AN AMENDMENT TO AGREEMENT, IN SUBSTANTIALLY THE FORM ATTACHED HERETO, BETWEEN THE CITY OF MIAMI AND METROPOLITAN DADE COUNTY INCREASING THE AMOUNT OF FILL MATERIAL TO BE PURCHASED BY THE COUNTY FROM THE CITY'S VIRGINIA KEY STOCKPILE TO APPROXIMATELY 90,000 CUBIC YARDS. WHEREAS, the CITY executed an Agreement with Metropolitan Dade County on November 21, 1986 for the Sale of approximately 35,000 cubic yards of surplus fill material from the City's Virginia Key Stockpile at the unit price of $2.00 per cubic yard (loose measure); and WHEREAS, the 35,000 cubic yards of material allowed to the COUNTY by said Agreement has been expended; and WHEREAS, an additional amount of approximately 55,000 cubic yards of material will be required by the COUNTY; and WHEREAS, said Agreement provides that the CITY and the COUNTY may, at their discretion, amend the Agreement; and WHEREAS, it is in the CITY'S best interest to amend the Agreement by increasing the amount of fill material to be purchased from the CITY to approximately 90,000 cubic yards; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The City Manager is hereby authorized to execute an Amendment to Agreement, in substantially the form attached hereto, between the City of Miami and Metropolitan Dade County increasing to 90,000 cubic yards the amount of surplus fill material to be sold by the City. WHEREAS, the CITY and the COUNTY entered into an Agreement on the 21st day of November, 1986; and WHEREAS, said Agreement provides for its amendment upon the execution of a writing signed by both parties evidencing the amended terms; and WHEREAS, the approximate amount of 35,000 cubic yards of surplus fill material allowed to be sold to the COUNTY by said. Agreement has been expended; and WHEREAS, the CITY and the COUNTY have determined that an increase in the amount of fill material to be sold is necessary and in the best interest of both parties. NOW, THEREFORE IN RECOGNITION OF GOOD AND VALUABLE CONSIDERATION, AND UPON THE PROMISES AND THE MUTUAL COVENANTS HEREIN CONTAINED THE PARTIES HERETO AGREE AS FOLLOWS: Section 1. On page one of said Agreement all references to the words "35,000 cubic yards" are hereby amended to read "90,000 cubic yards". Section 2. Odio City Manager ENCLOSURES: RECOMMENDATION It is respectfully recommended that the City Commission adopt the attached resolution authorizing the City Manager to execute an Amendment to Agreement increasing the amount of excess fill material to be sold to Metropolitan Dade County from 35,000 cubic yards to approximately 90,000 cubic yards. BACKGROUND The Department of Public Works has analyzed the situation and has determined that Metropolitan Dade County has a dire need for additional fill material from the City's Virginia Key disposal site. The City executed an Agreement with Metropolitan Dade County on November 21, 1986 for the sale of approximately 35,000 cubic yards of surplus fill material from Virginia Key at the unit price of $2.00 per cubic yard. Dade County's Water and Sewer Authority Department had underestimated the quantity of material necessary to rebuild the twelve sludge drying beds at the Virginia Key treatment plant. The quantity of 35,000 cubic yards (actually 39,000 sold) allowed by the original agreement dated November 21, 1986 was sufficient to complete only six drying beds. It is necessary, therefor, that an additional amount of approximately 55,000 cubic yards of material be sold to the County at the same unit price of $2.00 per cubic yard to complete their work.
