Wr130- A RESOLUTION AUTHORIZING THE CITY MANAGER TO REIMBURSE THE STATE OF FLORIDA DEPARTMENT OF NATURAL RESOURCES FOR THE ACQUISITION OF TWO REAL PROPERTY APPRAISALS OF THE BARNACLE ADDITION PROPERTY LOCATED AT 3471 MAIN HIGHWAY, MIAMI, FLORIDA IN THE AMOUNT OF $15,000 AVAILABLE FROM THE PROPERTY AND LEASE MANAGEMENT ENTERPRISE FUND, SUBJECT TO AN AGREEMENT IN A FORM ACCEPTABLE TO THE CITY ATTORNEY BETWEEN THE CITY AND THE OWNERS OF THE BARNACLE ADDITION PROPERTY, STIPULATING THAT ACQUISITION OF SAID APPRAISALS NOT PREJUDICE THE PENDING LITIGATION BETWEEN THE PARTIES. WHEREAS, in October, 1986, the State of Florida Department of Natural Resources selected two property appraisers to reappraise the Barnacle Addition property located at 3471 Main Highway, Miami, Florida; and WHEREAS, reappraisals of said property are a result of an agreement between the Department of Natural Resources and the property owner due to concern that explicit instructions given the prior appraisers may have inadvertently influenced the value estimate; and WHEREAS, the City of Miami has agreed to reimburse the State of Florida for the cost of acquiring reappraisals in an amount of $15,000 available from the Property and Lease Management Enterprise Fund, subject to an Agreement in a fo::sn acceptable to the City Attorney between the City and the owners of the Barnacle Addition property, stipulating that acquisition cf said ap;.raisa.ls not prejudice the pending litigation betwee,.; --hc aarties; NOW, THEREFORE, BE 1T RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. Odio City Manager RECOMMENDATION: A k M7 DATE - FILE: Resolution Authorizing SUBJECT: Reimbursement to State DNR for Acquisition of Barnacle ;Addition Property Appraisals REFERENCES, For City Commission Meeting of February 12, 1987 ENCLOSURES: It is respectfully recommended that the City Commission adopt the attached Resolution authorizing the City Manager to reimburse the State of Florida Department of Natural Resources for the acquisition of two real property appraisals of the Barnacle Addition property located at 3471 Main Highway, Miami, Florida, in the amount of $15,000 available from the Property and Lease Management Enterprise Fund, subject to an Agreement in a form acceptable to the City Attorney between the City and the owners of the Barnacle Addition property, stipulating that acquisition of said appraisals do not prejudice the pending litigation between the parties. BACKGROUND: The City of Miami through the Department of Development has been formally requested by the State of Florida Department of - Natural Resources to prepare the attached Resolution authorizing the City Manager to reimburse the State of Florida for two reappraisals of the Barnacle Addition property. The two reappraisals are the result of an agreement between the Department of Natural Resources and the Barnacle Addition property owner due to concern expressed that explicit instructions given the prior appraisers may have inadvertently influenced the value estimates of the property. The State of Florida is required to have funds on deposit before a contract may be awarded to property appraisers. The amount to be reimbursed the State of Florida by the City of Miami is $15,000. The two firms selected by the State to perform the appraisals are Property Consultants, Inc. and Hedge-Peth and Gallaher, Inc. Reimbursement is requested to be made to the State, subject to an Agreement between the City and the owners of the Barnacle Addition property, stipulating that the pending litigation is not prejudiced by the acquisition of said appraisals. Funding for said reimbursement in the amount of $15,000 is available from the Property and Lease Management Enterprise Fund. Attachments: Proposed Resolution 87-1.301 .
