HomeMy WebLinkAboutR-87-0123J-87-129 1/29/87 RESOLUT ION NO. 13 Y`123- A RESOLUTION RESCINDING THE AWARD TO JUELLE INC., DUE TO THE FACT THAT THE BUILDING AWARDED TO THEM FOR DEMOLITION HAD TO BE DEMOLISHED INMEDIATELY AND THEY HAD NOT PROVIDED THE CITY WITH PROOF OF INSURANCE REQUIRED BY THE CITY FOR FURNISHING DEMOLITION SERVICES AT THAT TIME; FURTHER ACCEPTING THE BID FROM TREE MASTERS, INC. THE SECOND LOWEST RESPONSIBLE AND RESPONSIVE BIDDER AT A TOTAL PROPOSED COST OF $28,727.00, USING FUNDS THEREFOR PREVIOUSLY ALLOCATED UNDER RESOLUTION NO. 86-979 ADOPTED DECEMBER 11, 1986 FROM THE COMMUNITY DEVELOPMENT PROGRAM WITH RECOVERY BY NORMAL LIEN HOLDING PROCEEDINGS; AUTHORIZING THE CITY MANAGER TO INSTRUCT THE CHIEF PROCUREMENT OFFICER TO ISSUE A PURCHASE ORDER FOR THIS SERVICE. WHEREAS, pursuant to public notice, sealed bids were received November 24, 1986 and a contract was duly awarded December 11, 1986 by Resolution No. 86-979 for the demoliton of various structures for the Department of Building and Zoning; and WHEREAS, Juelle, Inc. the lowest bidder, was awarded the contract for the demolition of the building located at 1361 N.W. 61st Street; and WHEREAS, due to the fact that the building and its owners were the object of State Attorney prosecution and a request was made to the City Manager's office for its immediate demoliton; and WHEREAS, at the time of this emergency, Juelle, Inc. had not provided the City with proof of insurance, and Tree Masters, I Inc., the next lowest bidder, was called upon to do the work since they had their Insurance Certificate on file with the City; and WHEREAS, funds for this purchase were allocated previously by Resolution No. 86-979 from the Community Development Program with recovery by normal lien holding proceedings; and WHEREAS, the City Manager and the Director of the Department of Building and Zoning recommend that the award to Juelle, Inc. be rescinded and the acceptance of the bid received from Tree Masters, Inc. in the amount of $28,727.00 be accepted, approved and confirmed; men i MEETING OF FEB 12 .190 �7 ITION No. 87- "-231, f FA NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The award of the contract to Juelle, Inc. under Resolution No. 86-979 adopted December 11, 1986 for demolishing a building located at 1361 N.W. 61st Street is hereby rescinded due to an emergency order being issued to demolish this structure and the City not having Juelle, Inc. proof of insurance at that time resulting in the need to secure this service elsewhere. Section 2. The bid from Tree Masters, Inc. is hereby accepted at a total proposed cost of $28,727.00, using funds therefor previously allocated under Resolution No. 86-979 adopted December 11, 1986 from the Community Development Program with recovery by normal lien holding proceedings. Section 3. The City Manager is hereby authorized to instruct the Chief Procurement Officer to issue a Purchase Order for this service. PASSED AND ADOPTED this 12th day of February 1987. i i XAVIER L. This along with the fact that it posed a threat to Firefighters and Police Officers responding to the frequent calls from the equally endangered and outraged property owners in the area justified the need for its removal. Funds are to be provided by the Community Development Program and recovery by normal lien holding proceedings. REFERENCES: No. 86-87-021 City Manager ENCLOSURES: For City Commission Meeting of February 12, 1987 RECOMMENDATION: It is respectfully recommended that an Resolution be passed rescinding the Award a contractor, and accepting the next responsible bid from Tree Masters, Inc. a for the emergency demolition and clearing property located at 1361 N.H. 61 Street at $289727.00. BACKGROUND: Award be made and a of Bid to Juelle, Inc., lowest responsive and demolition contractor, away of debris from the the same total cost of The Department of Building & Zoning has analyzed the need to execute the attached resolution for rescinding and re -awarding the bid for the demolition of the subject structure. Pursuant to public notice, sealed bids were received November 24, 1986 for furnishing materials and equipment needed to demolish and clear away the debris from the structure as directed by the Building and Zoning Department, Code Enforcement Section. Due to the fact that the building and its owners were the object of State Attorney prosecution and request was made to the City Manager's office for its immediate removal, emergency demolition orders were carried out. At the time of the emergency order, the vendor originally awarded the contract, Juelle, Inc., had not provided the City with proof of insurance. Tree Masters, Inc., the next lowest bidder, was called upon to do the work since they had provided insurance to the City as per bid specifications. They agreed to do the job for the same cost as the original bid awarded, 28,727.00. 87 -123
