N o tw i t h s t a n d i n g any Ci ty Code provision to the Contrary, annual commercial garbage collection and disposal fees are hereby assessed against Commercial establishments to offset the 'cost for the provision of commercial garbage collection and disposal services in accordance with the schedule attached hereto and made a part hereof. Section 2. All ordinances or parts of ordinances insofar as they are inconsistent or in conflict with the provisions of this ordinance are hereby repealed. Section 3. If any section, part of section, paragraph, clause, phrase, or word of this ordinance is declared invalid,', the remaining provisions, of this ordinance shall not be affected. Section 4. Thi s ordinance is hereby declared to be an emergency measure on the grounds or urgent public need f o r the preservation of peace, health, safety a n d property of the City of Miami, and upon the further grounds of the necessity to make the req ui red and necessary payments to i is empl oyees :and officers .payment of its debts, necessary and required purchases of goods and supplies, and to generally carry on the functions and duties of municipal affairs. Section 5. The requirement of reading this ordinance on two separate days i s hereby dispensed with by an affirmative vote of not less than fo ur- f i f ths of the members of the Commission, Section 6. It is the intention of the City Commission' that the provisions of this ordinance shall become and be made a part of the Code of the City of Mi ami Florida, as amended, which provi si,ons may be renumbered or relettered and that the word ordinance" may be changed to "section", ""article"",""article"",or other appropriate word to accomplish such, intention. Odi6 City Manager Recommendation: it is respectfully recommended that the City Commi s5ion adopt the attached emergency ordinance to fund the purchase of automobiles, I fight trucks, Motor -cycles a n d related accessories in the amount of $1,347,683. Revenue in an equal amount is available from the proceeds of the sale of Certificate Of Participation notes. Background; The General Services Administration Department h a 5 recommended that 128 police patrol vehicles costing $1,347,683 be PU rchased to Comply with the City Commission's stated policy of increasing the level Of Safety of the City's fleet of light motor vehicles, trucks and, motorcycles; specifically police patrol vehicles. The attached Emergency Ordinance amends the appropriate sections of the FY',87 annual appropriations ordinance adopted on September 25, 1986 by increasing the appropriations and revenue for the General Services Administration budget. Specifically, the Task Force recommends a revised fee of $75 per month for a conventional 2-cubic yard covered container wi th twite - a - week collection. Accounts will be billed semi-annually — based upon number and service multiples of the basic 2-cubic yard container rAtp. The revised rate structure will establish a more competltive position for the Solid Waste Department and will facilitate the. acquisition of additional commercial accounts. R_ECOMMENDAT ION It is respectfully recommended that the City Commission adopt the attached emergency ordinance amending, portions of the City of Miami Code pertinent to commercial e5 n and street cleaning fees and commercial garbage collection fee BACKGROUND Solid. Waste Fee Task Force recommends that the City amend the current $150 annual fee charged against commercial establishments as defined in Ordinance No 10136 adopted July 24, 1986, and institute the following revised fee schedule, _ Proposed Fee Condominiums $80.00 Apartments $80.00 Commercial $ .08/Sq. Ft. Establishments - The Solid Waste Fee Task Force has recommended a revision in the trash and street cleaning fee to more accurately assess the City's commercial establishments. For example, under the previous rate, commercial establishments of 500 sq. ft., 50,000 sq. ft. , etc,., would have been uniformly charged the same $150 rate regardless of City services rendered. Wi thin the new rate structure, commercial establishments will be more fairly assessed on a per square foot basis with a rate cap of 50,000 sq. ft. Accounts,will be billed on an annual basis.
