On October 23, 1986, the City Commission passed Motion 86-864
"Authorizing and directing the City Planning Department to
further study and recommend to the Commission as to possible
elimination of all Transitional zoning uses in the City."
In response to this motion, the Planning Department prepared
an ordinance proposing deletion of all Transitional Uses without
first conducting the requested study to determine the effect
of such action on the existing and future development of the City.
On November 19, 1986, the Planning Advisory Board unanimously
recommended denial of the deletion of Transitional Uses on the
strength of three basic arguments:
Transitional Use regulations offer a flexible land
use mechanism within the zoning ordinance which can
provide both aesthetic and economic relief for resi-
dentially zoned properties which are undergoing change
due to proximity to commercial districts
Transitional Use provisions have been available for
use in the City of Miami since 1961. There are
numerous sites in the City which have been upgraded
from deteriorating and underutilized, marginally
functional residential quasi -slum areas to viable
office and/or mixed use sites
Deletion of the Transitional Use regulations from the
Ordinance will create numerous nonconforming uses and
throw an additional burden on the enforcement agencies
in the City
We are all working for the same goal, the preservation of a
healthy viable environment for all the City's inhabitants, be
they resident, entrepreneur, developer, professional or public
official. 1 respectfully request that the City of Miami Commission
give careful consideration to the Transitional Use issue and
vote either to deny the proposed amendment or to defer the matter
until Ordinance 9500 is revised.

In response to your request for information on Transitional Uses in the
new Zoning Ordinance (9500), I have to refer to the period of time when
the old Zoning Ordinance (6871) was being reviewed by the zoning consultants -
Mr. Bair and Dr. Bartley, the writer, and the City of Miami Planning Depart-
ment.
The City of Miami zoning along the majority of its major and minor arterials
is medium to high intensity residential, residential -commercial, commercial,
or industrial uses. The zoning that adjoins these high intensity uses is
usually low to medium residential. The old Zoning Ordinance (6871) allowed
a stepping up of intensity of use at residential district boundaries bordering
commercial and industrial districts. Both the consultants and the Planning
Department agreed that this was sound planning practice, but needed to be
carried a step farther by introducing certain standards that would make this
buffer zone more compatible with adjoining residential use. Each proposed
zoning district was analyzed and transitional use standards such as (1) yard,
height envelope and open space requirements on the transitional lot had to
be the same as the adjoining low intensity residential district; (2) active
recreational facilities were not permitted within 20 feet of transitional
lot lines; (3) where commercial lots adjoined residential, noisy uncompatible
uses were prohibited within 50 feet of the common boundary, and the like,
were introduced into the new zoning ordinance. Also, the transitional con-
trols lessened the probability of requests for changes of zoning to intense
non residential uses that would intrude into the residential area based on
arguments that noisy, overbuilt commercial uses were not compatible with
residential uses.
The transitional use controls are based on sound zoning practice for the City
of Miami land use pattern. If the controls are not working, either they are
not being properly administered in accord with standards set forth in the
Zoning Ordinance, or the standards need to be revised. If there are examples

where non compatible buildings have encroached into residential areas (which
I find hard to believe based on standards which state that building bulk in
transitional areas must be the same as adjacent residential areas), somebody
who understands the standards should analyze these examples to see what is
causing the problem.
I fervently hope that the new Zoning Ordinance is not being dismembered
piece by piece and turned into the internally inconsistent zoning ordinance
(6871) that confronted the consultants and the Planning Department eleven
years ago.

due to proximity to commercial districts
Transitional Use provisions have been available for
use in the City of Miami since 1961. There are
numerous sites in the City which have been upgraded
from deteriorating and underutilized, marginally
functional residential quasi -slum areas to viable
office andlor mixed use sites
Deletion of the Transitional Use regulations from the
Ordinance will create numerous nonconforming uses and
throw an additional burden on the enforcement agencies
in the City
We are d/l working for the same goal, the preservation of a
healthy viable environment for all the Cityrs inhabitants, be
they resident, entrepreneur, developer, professional or public
official. 1 respectfully request that the City of Miami Commission
give careful consideration to the Transitional Use issue and
vote either to deny the proposed amendment or to defer the matter
until Ordinance 9500 is revised.

This letter io being sent on behalf of the Coral Gate Home
owners Association.
Members of our group attended a Workshop on Transitional
Zoning presented by the Planning Board on February 17th
during which four proposals were suggested.
In order to preserve our residential community, we respectfully
URGE you to accept Proposal Three.
The acceptance of Proposal Three will afford our residential
community a future. Without it, we will be subjected to continuous
chipping away at and inside our perimeters which will result
in deterioration and the loss of home owners.
We want to remain a neighborhood community. We do not want to
be forced to flee to the outskirts or Broward. Our 450 home
developement which was built in 1949 contains many original
owners and we have new, younger families moving in at an
interesting pace.
Our group will be in attendance at the Commission Meeting on
February 26th to follow the action taken.
We thank you for your interest and consideration.
