THERETO TO PROVIDE, NPON REQUEST, POP.
INSPECTIOR OF REAL PROPERTY BY THE Bt?ILBING
AND ZONING DEPARTMENT TO ASCERTAIN WHETHER
ZONING VIOLATIONS OPENLY EXIST ON SAID
PROPERTY; ESTABLISHING A FEE FOR THIS
SERVICE, CONTAINING A REPEALER PROVISION AND
SEVERABILITY CLAUSE.
WHEREAS, there have been instances where interests in real
property have been sold within the City of Miami and after the
sale it has been discovered by the new owner or purchaser that
zoning violations exist on the property, and
WHEREAS, these new owners have then received notices of such
violations which have caused them to be brought before the Code
Enforcement Board of the City of Miami; and
WHEREAS, the City of Miami desires to furnish, upon request,
on -site inspection of properties to assist prospective purchasers
in administratively determining whether zoning violations openly
exist on the real property; and
WHEREAS, this service will not be mandatory and will only be
made available upon request of the owner or owner's agent and the
City will charge a fee to cover the cost of the inspection and
report which shall be rendered and which shall only constitute
prima facie evidence of compliance/noncompliance with Zoning
Ordinance 9500 and shall not be conclusive proof of
compliance/noncompliance with said Ordinance 9500;
NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY
OF MIAMI, FLORIDA:
Section 1. Section 2-75 of the Code of the City of
Miami, Florida, as amended, is hereby amended in the following
particulars
