RE: City Commission Agenda of March 13, 1987, Page 21, Item #61,
Proposed Ordinance J-87-103
The above referenced Ordinance is scheduled for first reading
March 13, 1987. We believe that the Ordinance, as proposed, would
seriously impede commerce in the City of Miami and possibly create
an impossible condition to police if enacted.
We do not fully understand the purpose behind such an Ordinance,
but can only surmise that it may be an attempt to curtail unlicensed
and unpermitted activities within the city limits of Miami.
Please be assured that the Associated General Contractors, South
Florida Chapter, does not support "moonlighting construction".
We do however, believe there must be another alternative to address
such activities that may be better aimed at the offender, rather
than embracing the entire construction community, good and bad alike.
Therefore, we respectfully request that the proposed Ordinance be^
withdrawn,'pending furthur investigation and study with the construc-
tion industry et al, and perhaps collectively we may determine a
more palatable solution for the purpose in which this Ordinance
is intended.
The Construction Industry repeatedly has gone to the City of Miami
_ and asked to be made aware of problems that the City may be encountering
that our Industry could address and, perhaps, be a part of the
solution. To the best of our knowledge, this opportunity has not
been afforded us for this proposed Ordinance.
Therefore, for this and other reasons, we request that this
Ordinance be setaside, pending a more expansive and indepth discussion !:
on the subject.

Permit Required Prior
To Buying/Selling Building Supplies
Dear Mayor Suarez and City Commisioners:
I am writing to you on behalf of the Builders Association
of South Florida's (BASF's) Legislative Committee regarding
the above -referenced ordinance. The members have many ques-
tions that they want additional information on prior to the
passage of the ordinance.
First, it is apparent that the goal of the ordinance is to
prevent illegal construction work from being conducted in the
City. BASF supports this worthy goal. The method by which
the ordinance seeks to achieve this goal, however, is trouble-
some and confusing to the members.
Part of the burden to enforce this proposal would be placed
unfairly on the supplier. Would he be required . by law, to
ask every customer if they are purchasing materials for a job
that has a building permit? f so, the members seriously wonder
if this is a realistic request to make of all suppliers.
The other part of this unnecessary burden will fall on the
subcontractor or contractor. Would he be required to carry
multiple copies of a building permit with him at all times
before he can purchase any item at all? It would appear so.
Currently, the City has sufficient enforcement ordinances to
place. These laws are working better than ever before. The
City's Code Enforcement Board has been levying more fines
against more people who do illegal work. Also, the Building
and Zoning Department has been conducting week -end inspections
throughout the City to reduce the amount of illegal work.
Last, the City Commission established the Construction Industry
Citizens Advisory Committee (CICAC) last year. The first
meeting is scheduled for mid -April. This ordinance should be
presented to the CICAC for industry's input prior to adoption
by the City Commission.
On behalf of the BASF's Legislative Committee, we respectfull
urge that this ordinance be referred to the CICAC for industr
comment, prior to final action by the CityComm! sign. Tank
