WHEREAS, on January 14, 1985, the City and Bayside Center
Limited Partnership (hereinafter referred. to as "Sayside")
entered into a lease for the development of a waterfront
specialty center and a lease, for the development of a parking
facility, pursuant to which the City leased to Bayside certain
property located,on the North end of Bayfront Park; and
WHEREAS, pursuant to an agreement entered into on
October 24, 1985, between the City and Bayside, the City agreed
to restore the structural integrity of the Miamarina' including
the piers, docks, pilings; quays,; seawall, lighting and the
original design depth of the marina; and
WHEREAS; this commitment was reaffirmed by Motion 86-6010
on 1986; and
at the City Commission meeting of Jul
WHEREAS, by Resolution No. 87-63, adopted on
January 8, 1987, the City.Commission ratified the City Manager's
action of acoepting the law bid of McNees Marina Construction;
Inc,, in, the amount of $1,573,577 for the Base Bid, plus Additive.
Alternates No. 1 .and 2 and executing a ` cQntract 'with the. firm;
and
enlargemoftt of landside water mains that supply the fire lines`on
Piers A,E�and C; and —
WHEREAS, both the aforementioned Mork on Pier A and the
enlargement of the water mains must be'dbne before they meet code
requirement and be usable; and
WHEREAS, funding for the increase in the existing
appropriation for the project is available from a temporary loan
-
from the General .Fund, Special Programs and Aeounts, to be
reimbursed from the 'proceeds of the sale of 1987 Marina Revenue
Bonds; and
WHEREAS, an increase in the appropriation to the project
of $100,000 is 'required to land an increase in the contract
amount in the existing contract with McNew Marine Construction,
Inc.;
NOW THEREFORE, BE IT ORDAINED BY THE COMMISSION 'OF THE.
CITY OF MIAMI, FLORIDA: —
Section 1. Section 1 of Ordinance No. 10187, adopted
December ll, 1986, as amended, is hereby amended in the,following —
particulars: �/ ■
"Section 1.. The herein appropriations are hereby made
for implementation of all municipal capital
improvements of the City of Miami, including new,
oapital improvement projects scheduled to begin during
fiscal year 1986-87. The herein appropriations: which,
are hereby, designated by reference to descriptive
project title and number_ also include appropriations
for previously approved scheduled projects. as well as
re -appropriations of prior fund appropriations. The =
source of revenues to support the herein appropriations
is hereby identified by 'fund -and project with the —
project appropriations and revenues therefor being set
forth for seven program areas (I-VII) based upon use or
fuanctional oategory withinsaid areas, as Tollows
Words and/or figures strioXen through shall be deleted.
Underscored , wards and/or figures shall- be added. The
reaaizing'provisions are now in effect and remain un.ohanged,

ordinance are hereby repealed.
Section 3. If any section, part of section, paragraph,
clause, phrase or word of this ordinance is declared invalid, the
remaining provisions of this.ordinance shall not be affected.
Section 4.' This ordinance is ,hereby declared to, be an
emergency measure on the grounds of urgent public need for the
preservation of peace, health, safety, and property of the ,City
of Miami and'upon the further grounds of. the necessity to make
the required and necessary payments to generally carry out the
functions and duties of municipal affairs.

RECOMMENDATION:
It is respectfully recommended that the:City Commission adopt the
attached resolution authorizing an increase in contract amount of
$100,000 i n the contract between the Ci ty. of Mi ami , Fl on da and
McNew Marine Construction, Inc. for Bayside Specialty Center-
Miamarina. Renovation project, said funds to be provided from
funds already allocated to the project; further ratifying the
City. Manager's written finding, that the herein increase resulted
from emergency circumstances by an affirmative,vote of'4/5ths of
the members of the City Commission an d°adopting the findings and
conclusions set forth in the preamble of this resolution.
BACKGROUND: -
The Department of Public Works and the Project Coordinator have
analyzed the situation and 'determined that there exists a need
for, an increase to. the existing contract in the amount of
$100,000. The existing contract does not include an Additive
Alternate that would have provided all new utilities for Pier A.
During the proce.dure of securing a permit from the Building
Department, it was ruled,by the Fire Prevention Section tha.t.Pier
A utilities would have 'to be updated to meet the present code
requirements because the work covered by the contract' involved
the renovation of two-thirds or more of the marina.
It was also found by the. Project Coordinator that some of the.
existing utility apparatus oni the pier was deteriorated,
vandalized, or. partly missing and thus unuseable and needs to be
renovated before the.pier can be used.
The Project Coordinator's estimate of the cost of boththe
upgrading to meet code and the renovation of the existing utility
system is $45,000,

Based on information supplied to me by the Director of the.Department _
Of Public Works and the Project Coordinators I have found that there
exist an emergency need for an i,ncrease''in contract amount' of
$10U,000 in the contract between the City of Miami and McNew Marine
_ Construction, inc. for the construction of 8aysi de Special tCenter�-
Miamarina Renovation Project. y
The reason for the emergency, need is as follows:
The existing contract does not cover the renovation and
additions to the utilities on Pier A and the enlargement.of
1 andsi de water mains that supply the fire 1 i n e s in piers A,6
and C. if the work is not done, the piers will not comply
with present code requirements and thus not be useable. A
requirement that. the' marina renovation be completed by the
April lth opening of Bayside causes the emergency need by the
work to be added to the existing contract.
