A RESOLUTION AUTHORIZING AN INCREASE IN THE CONTRACT AMOUNT OF $100.000 IN THE CONTRACT BETWEEN THE CITY OF MIAMI, FLORIDA AND MCNEW MARINE CONSTRUCTION, INC., DATED JANUARY 5, 1987, FOR THE CONSTRUCTION OF BAYSIDS SPECIALTY CENTER-MIAMARINA RENOVATION PROJECT, ALLOCATING MONIES THEREFOR FROM FUNDS TO BE APPROPRIATED TO THE PROJECT BY ORDINANCE NO. 10242; FURTHER RATIFYING THE CITY MANAGER'S WRITTEN FINDINGS THAT THE HEREIN INCREASE RESULTED FROM EMERGENCY CIRCUMSTANCES BY AN AFFIRMATIVE VOTE OF 4/5THS OF THE MEMBERS OF THE CITY COMMISSION, AND ADOPTING THE FINDINGS AND CONCLUSIONS SST FORTH IN THE PREAMBLE OF THIS RESOLUTION. WHEREAS, there exists a contract dated January 5, 1987, between the City of Miami, Florida and MoNew Marine Construction, Inc. for the construction of Bayside Specialty Center-Miamarina Renovation Project; and IS om � WHEREAS, an increase in contract of $100,000 is required to cover the costs of renovations and additions to the utilities on Pier A and enlargement of landside water mains that will supply the fire lines on Piers A, B, and C; and WHEREAS, the City Manager has made a written finding that a valid emergency exists for the increase; and WHEREAS, the directors of the Departments of Public Works and Development recommend an increase in contract to cover the additional costs; and WHEREAS, monies to cover the increase are being allocated from funds to be appropriated to the Project by Ordinance No. 10242; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. After a properly advertised public hearing, the findings of the City Manager set forth in the preamble to this resolution is hereby ratified by an affirmative vote of 4/5ths of the City Commission, and adopted as if fully set forth in this section. O d i o REFERENCE!: City Manager ENcLosuREs: RECOMMENDATION: FILE: B-3213-e BAYSIDE SPECIALTY CENTER MIAMARINA RENOVATION PROJECT Resolution for Increase in Contract It is respectfully recommended that the City Commission adopt the attached resolution authorizing an increase in contract amount of $100,000 in the contract between the City of Miami, Florida and McNew Marine Construction, Inc. for Bayside Specialty Center- Miamarina Renovation Project, said funds to be provided from funds already allocated to the project; further ratifying the City Manager's written finding that the herein increase resulted from emergency circumstances by an affirmative vote of 4/5ths of the members of the City Commission and adopting the findings and conclusions set forth in the preamble of this resolution. BACKGROUND: The Department of Public Works and the Project Coordinator have analyzed the situation and determined that there exists a need for an increase to the existing contract in the amount of $1009000. The existing contract does not include an Additive Alternate that would have provided all new utilities for Pier A. During the procedure of securing a permit from the Building Department, it was ruled by the !Fire Prevention Section that Pier A utilities would have to be updated to meet the present code requirements because the work covered by the contract involved the renovation of two-thirds or more of the marina. It was also found by the Project Coordinator that some of the existing utility apparatus on the pier was deteriorated, + vandalized, or partly missing and thus unuseable and needs to be renovated before the pier can be used. Odi o REFERENCES: City Manager ENCLOSURES. 1"LE` 3213-8 Bayside Specialty Center- Miamarina Renovation Project Emergency Need for Increase in Contract Amount Based on information supplied to me by the Director of the Department of Public Works and the Project Coordinators I have found that there exist an emergency need for an increase in contract amount of $1009000 in the contract between the City of Miami and McNew Marine Construction, Inc. for the construction of Bayside Specialty Center- Miamarina Renovation Project. The reason for the emergency need is as follows: The existing contract does not cover the renovation and additions to the utilities on Pier A and the enlargement of landside water mains that supply the fire lines in piers A,B and C. If the work is not done, the piers will not comply with present code requirements and thus not be useable. A requirement that the marina renovation be completed by the April 7th opening of Bayside causes the emergency need by the work to be added to the existing contract. Odio Page 2 Additionally, no provision was made in the plans and specifications for the enlargement of the landside water mains that supply the existing fire lines on the piers as required by the revised code. The consulting designers did not include the work because they thought that all landside improvements would be done by the Rouse Company. The Project Coordinator's estimate of the cost to enlarge the mains is $55,000, producing a total cost for both items of $1009000. Since all of the cash allowance for the project is committed for other items of extra work, an increase in contract amount for the entire $100,000 is required. Funds for the increase must be appropriated to the project from Marina Enterprise Funds by an amendment of the Appropriations Ordinance to be considered by the Commission as a companion item to the resolution herein requested.
