WHEREAS, the General Services Administration Department has found Southern Bell to be the sole source of supply for the Enhanced 911 (E911) Automatic Location Identification (ALI) system; and WHEREAS, this system enhancement will display a caller's address on a video screen manned by City communications operators at the center, this feature shall enable emergency units to respond more quickly and efficiently to an emergency call despite a caller's inability to inform operators of his or her locations; and WHEREAS, if a Letter of Intent is approved by the City of Miami by March 31, 1987, there is the opportunity to take advantage of the scheduled county system upgrade, thereby avoiding the 18 to 24 months of lead time isually required; WHEREAS, the Chief Procurement officer has adopted a finding wherein that Southern Bell Telephone and Telegraph Company is the sole source to provide this service; and CITY COMMISSION MEETING OF MAR 13 1987 0 P WHEREAS, the findings of the Chief Procurement Officer have been approved and adopted as the finding of the City Manager; and WHEREAS, the City Manager and the Director of the Department of General Services Administration recommend that the requirement for competitive formal sealed bids be waived and the procurement from Southern Bell Telephone and Telegraph Company be approved; WHEREAS, the City Commission desire to accomplish the purposes outlined in the accompanying memorandum and Letter of Intent, a copy of which is incorporated herein by reference. NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. By an affirmative vote of 4/5ths of the Members of the City Commission, after a duly advertised public hearing, the City Manager's written finding that Southern Bell Telephone and Telegraph Company the Sole Source of supply to the City for the Enhanced 911 (E911) Automatic Location Identification (ALI) system, which will enable emergency units to respond more quickly and efficiently to an emergency call. Section 2. The City Manager is hereby authorized to execute an agreement with Southern Bell Telephone and Telegraph Company regarding the addition of the Automatic Location Identification feature to the City of Miami's Emergency 911 sytem in accord with the Letter of Intent attached hereto; further authorizing the City Manager to execute the cancellation provision contained therein. Odio City Manager RECOMMENDATION: DATE: MAR 51987 * FILM Resolution Authorizing SUBJECT: Agreement with Southern Bell - Sole Source In- stallation of Emergency REFERENCES: 911, Automatic Location Identification Feature ENCLOSURES: It is respectfully recommended that the City Commission approve the attached resolution authorizing the waiver of the requirements for sealed bids for the sole -source procurement of the Enhanced 911 (E911) Automatic Location. Identification (ALI) feature from Southern Bell, and further authorizing the City Manager to enter into an agreement with Southern Bell for the acquisition of the E911, Automatic Location Identification feature. Also recommending that the City Manager be given the authority to exercise the cancellation provision contained in the attached Letter of Intent. BACKGROUND: The General Services Administration Department has found Southern Bell to be the sole source of supply for the system needed and the Chief Procurement Officer has also adopted this finding. GSA has analyzed a proposal received from Southern Bell Telephone and Telegraph Company to install the ALI feature as enhancement to the existing Automatic Number Identification (ANI) feature of the City's Emergency 911 system. This system enhancement will display a caller's address on a video screen manned by City communications operators at the 911 center. This feature shall enable emergency units to respond more quickly and efficiently to an emergency call despite a caller's inability to inform operators of his or her location. Metropolitan Dade County recently signed a Letter of Intent to add ALI to their existing 911 system. A due date of January 1988, has been established for this upgrade to the county's system. If a Letter of Intent is approved by the City of Miami by March 31, 1987, there is the opportunity to take advantage of the scheduled county system upgrade, thereby avoiding the 18 to 24 months of lead time usually required. y6 -1 The Honorable M # r and Members of the City Comm_ision sk Page 2 YEAR ONE - To begin when system is operational, estimated to be January, 1988. The enhanced level of services for the citizens of the City of r4iami shall more than compensate for the costs involved to provide this emergency system. Coordination of the implementation with the installation of county service shall make this feature available to residents within a year. We have committed a January 1988 due date for this upgrade. Southern Bell would like to install Miami's ALI concurrently with Dade County. The usual lead time on an E911 installation is 18 to 24 months. This is due to equipment lead times, 8911 implementation schedules throughout BellSouth and data base conversion. By executing the enclosed Letter of Intent by March 31, 1987, we can guarantee installation concurrent with Dade. This would allow your employees and citizens to derive its benefits in less than one year. The attached Letter of Intent reflects an increase in rates from the original letter submitted to Ed Cox in August 1985 and prices quoted to you June 1986. This is due to several factors: - an increase in access lines in the City - two rate increases designed to carry existing rates forward for a minimum of five years. As you are aware Ron, the increase in your rates to the Southern Bell full featured 9911 system are over a three year period. This gradual rate increase was negotiated with all the Public Safety Answering Positions in Dade to provide relief from the actual tariff increase. From year three on, your rates will be governed by the general 9911 tariff that all other counties and municipalities are subject to. This order, which authorizes you to proceed with the installation of the system, is based on our understanding of the following thirteen sections and five exhibits: SECTION I TARIFF PROVISIONS The City understands that Enhanced 911 services and facilities are provided subject to and controlled by the provisions of Southern Bell lawfully filed tariffs, including any changes therein as may be made from time to time. SECTION II SYSTEM CHARGES System charges are based on the number of access lines in service. Refer to Exhibit A for a statement of forecasted charges. Actual charges will be determined by the tariffs in effect on the date of service. SECTION III DESCRIPTION OF SYSTEM The Enhanced 911 System provides use of the exchange network at no charge to the caller. It further provides facilities within the network between local central offices and the Public Safety Answering Points (PSAPs), and the ability to transfer calls from a primary PSAP to the proper secondary agency. The Enhanced 911 System covered hereby is more explicitly explained in Exhibits C and D. The preliminary list of primary and secondary PSAPs is contained in Exhibit B. SECTION IV BILLING PROCEDURES It is understood and agreed that billing will begin at the time the system is operational and turned over to the City. These billing procedures shall be as set forth in Southern Bell's applicable tariffs. SECTION V PROVISION OF SERVICE Selection of the appropriate service to the City will be made -mutually by Southern Bell and the City. Selection will be based on a thorough analysis of the City's needs at each public safety location and on the availability of facilities in each area. A service date shall be established no later than 24 months after receipt of an acceptable data base which will be provided by the City. (8167S) 46 -10 87--260 SECTION VI GEOGRAPHIC AREA DESCRIPTION The primary PSAPs and secondary agencies are listed in Exhibit B. The City shall furnish to Southern Bell a definition of the specific geographic areas covered by each primary and secondary agency. Such definition shall be in terms of street names, street types, directionals, street addresses and number ranges (where applicable), or in such other manner as may be mutually acceptable by the City and Southern Bell. The definition of each geographic area, and the ongoing maintenance of such Information shall be the sole responsibility of the City. The City further agrees to furnish to Southern Bell, in a timely manner, any such updated geographical Information. It is understood that the time required by Southern Bell to update the data base will depend on the nature and extent of such changes. Southern Bell will require a minimum interval of time in which to input into the data base major changes such as realignment of PSAP boundaries, street name changes, new street additions and annexations. The City further understands that in order to properly route calls from subscribers in some rural areas of the City, it will be necessary for the City to provide unique street addresses (including house numbers) for specific real estate parcels in these areas. Street addresses will be required for streets or thoroughfares which cross multiple jurisdictional boundaries and at present use only rural route and box numbers as an address. These street addresses would be for the Enhanced 911 System purposes only and would not affect current mailing addresses. SECTION VII SYSTEM FEATURES The features of the Enhanced 911 System to be purchased by the City shall include those features generally described in Section A24 of Southern Bell General Subscriber service Tariff and as'listed in Exhibit D. SECTION VIII SPECIAL REQUIREMENTS The City specifically and expressly agrees as follows: 1. That at least one PSAP will be provided and staffed on a 24 hour, seven (7) days per week basis. 2. That the City accepts responsibility for dispatching, or having others dispatch police, fire, ambulance or other emergency 'services as required, to the extent as such services are reasonably available. 3. That the City will develop an appropriate method for responding to calls for non -participating agencies which may be directed to the 911 - PSAP by calling parties. (8187S) q� _// 87--260 F V 4. That the City will subscribe to, or provide, telephone equipment with a capacity adequate to handle the number of incoming 911 lines recommended by Southern Bell to be installed. That at least one law enforcement agency will be included among the participating agencies in this system. 5. That the 911 number shall not replace the telephone service of the various public safety agencies which may participate in the use of this number. The City shall subscribe to additional local exchange service, if none exists, at the PSAPs for administrative purposes for placing of outgoing calls and for receiving other emergency calls, including any which may be relayed by Southern Bell operators. SECTION IX ACCESS TO USER FACILITIES Southern Bell shall be provided access by the City and all public safety agencies to their premises where the equipment and facilities are located. This access shall be for the purpose of installation, inspection, testing, repairing, or removing the equipment and facilities used in furnishing the Enhanced 911 system. SECTION X UNAUTHORIZED USE OF SYSTEM It is understood and agreed that ANI and ALI information pertaining to incoming Enhanced 911 System calls is to be used solely for the purposes of answering, handling, and responding to emergency calls in a manner consistent with the nature of the emergency. SECTION XI LIABILITY AND INDEMNITY Southern Bell's liability to third parties or to the City and any indemnity obligations in connection therewith shall be limited to that stated in Southern Bell's applicable tariffs. See Exhibit E for this particular statement. SECTION XII CANCELLATION —= The City understands that if this request, or any subsequent request by the city for service or facilities, or request for additions, rearrangements, relocations or modifications of service or equipment is cancelled in whole or In part, for any reason, prior to completion of the work involved, the City shall reimburse Southern Bell for all expenses incurred in handling the request before notice of cancellation is received. Such charges, however, shall not exceed all charges which would apply if the work involved in complying with the request had been completed. Section XII shall not apply to any cancellation made within thirty (30) calendar days of the effective date of this letter. '1 &r-260 i t EXHIBIT D CITY OF MIAMI ENHANCED 911 SYSTEM FEATURES Selective Routing: A feature that routes a call from a central office to a designated primary PSAP based upon the identified number of the calling party. Automatic Number identification: A feature by which the calling party's telephone number is forwarded to E911 Control Office and to the PSAP's Display and Transfer Units. Automatic Location Identification: A feature by which the name (business accounts only) and address associated with the calling party's telephone number (identified by ANI as described above) is forwarded to the PSAP for display. Telephones associated with a calling party's telephone number but which are physically located elsewhere (off -premise extensions, secondary locations, etc.) will also be identified with the same address associated with the calling party's telephone number at the primary location. No ALI data is provided when a call is sent to Default Routing (DR). Alternative Routing: A feature provided to allow E911 calls to be routed to a designated alternate location if (1) all E911 exchange lines to the primary PSAP are busy, or (2) the primary PSAP closes down for a period (night service). This is a standard feature of E911 service. Data Management System: A system of manual procedur^s and computer programs used to create, store, and update the data required to provide the Selective Routing and Automatic Location Identification features. Default Routing; A feature activated when an incoming E911 call cannot be selectively routed due to ANI failure, garbled digits or other causes. Such incoming calls are routed from the E911 Control Office to a default PSAP. Each incoming E911 facility group to the Control Office is assigned to a designated default PSAP. This is a standard feature of E911 service. Four -Party or Rural Service will be default routed. No ANI/ALI data is provided when a call is sent to Default Routing. Display and Transfer Unit: A selector console and associated common equipment for displaying ANI numbers at the PSAP attendant position and used by the attendant to activate Fixed and/or Selective Transfer functions. Enhanced 911 Control Office: The office providing tandem switching capability for 911 calls. It controls switching of ANI information to the PSAP and also provides the selective routing feature, standard ESS Speed Calling features, call transfer capability, and certain maintenance functions for each PSAP. Enhanced 911 Service Area: The geographic area in which the City of Miami will respond to all 911 calls and dispatch appropriate emergency assistance. (8167S) S7- ?Z0 Fixed Transfer: The feature which enables a PSAP attendant to transfer incoming E911 calls to secondary PSAPs by use of a single button on the Display and Transfer Unit. (A maximum of six buttons can be activated at each PSAP. - Forced Disconnect: A standard feature of the E911 system which enables the PSAP attendant to release a connection even though the calling party has not hung up. The feature prevents the jamming of the E911 exchange lines. Manual- Transfer: A standard feature of E911 which enables the PSAP attendant to transfer an incoming call by dialing a 2 digit speed call code or a 7 digit number. Selective Transfer: A feature providing PSAP attendants the ability to transfer an incoming call to another agency by depressing a single button labeled with the type of agency, e.g., fire, ambulance, etc. on the Display and Transfer Unit. This feature automatically transfer the call to the correct agency which serves the address of the calling party. (8167S) F EXHIBIT E CITY OF MIAMI ENHANCED 911 -LIABILITY AND INDEMNITY When the use of service or facilities furnished by the Company is interrupted due to any cause other than the negligence or willful act of the subscriber or the failure of the facilities provided by the subscriber, a pro rata adjustment of the fixed monthly charges involved will be allowed as covered by Section A2 of this Tariff. where allowances on monthly charges for Service Features of E911 Service are involved, only those Service Features which are affected by the interrupted service shall be considered; and further, only those main stations on the interrupted portion of a service shall be considered in determining the number of main stations affected. This service is offered solely as an aid in handling assistance calls in connection with fire, police and other emergencies and does not create any relationship or obligation, direct or indirect, to any person other than the customer contracting for 911 service. In the event of any interruption of the service, the Company shall not be liable to any person, corporation or other entity for any loss or damage in an amount greater than an amount equal to the pro rata allowance of the tariff rate for the service or facilities provided to the customer for the time such interruption continues, after notice to the Company. No allowance shall be made if the interruption is due to the negligence or willful act of the customer of the service. Further, each customer agrees to release, indemnify, defend and hold harmless _ the Company from any and all loss, claims, demands, suits, or other action, or any liability whatsoever, whether suffered, made, instituted, or asserted by the customer or by any other party or person, for any personal injury to or death of any person or persons, or for any loss, damage or destruction of any property, whether owned by the customer or others, or for any infringement or invasion of the right of privacy of any person or persons, caused or claimed to have been caused, directly or indirectly, by the installation, operation, failure to operate, maintenance, removal, presence, condition, location or use of 911 service features and the equipment associated therewith or by any services which are or may be furnished by the Company in connection therewith, including but not limited to the identification of the telephone number, address or name associated with the telephone used by the party or parties accessing 911 services hereunder, and which arise out of the negligence or other wrongful act of the Company, the customer, its user agencies or municipalities or employees or.agents of any one of them. Background In an effort to improves Metro -Dade County's Emergency 911 system, it is desired to add the Automatic Location Identification (ALL) feature to the existing Automatic Number Identification (ANI) System by contracting with Southern Bell for the leasing of the ALI service to Dade County. A caller dialing 09110 for emergency police or fire service would have the location from which he or she is caliing shown on a video display screen to County communications operators at the 911 center, in addition to the existing screening of the originating phone number. The ALI feature will enable a caller who is unable to speak or who does not know his location to be assisted more effectively and expediently. Presently, the other cities who have separate 911 systems --Cities of Miami, Miami Beach, Hialeah and Coral Gables --have contracted with Southern BeTl to provide ALI service. Because the database for this location information has been created and maintained by Southern Bell, the company is the sole source for this ALI service. This agreement for ALI service also includes the purchase of a computerized tape from Southern Bell of all phone subscribers, their service addresses and published telephone numbers. Updates of this information will be provided to Dade County on a quarterly basis. The information on this tape can be used by County departments for such uses as identifying the locations of hazardous chemicals and explosives for the Fire Department, address certification in police investigations and to identify previous violent occurrences for the Metro -Police Department. At this time however, Southern Bell has refused our request to provide the data base for the unpublished phone numbers, based on their belief that providing this data is prohibited by Public Service Commission's approved tariff. However, we reserve our claims to this data. Dade County currently pays a recurring annual cost of $324,000 to Southern Bell for the existing Emergency 911 ANI service. The initial capital cost for implementing ALL with the current system is $310,000. The annual -, recurring charge to Southern Bell for the lease of this service has been negotiated to be phased in over a three year period. The first year, the County's recurring charge would increase to $555,000. The second year this would rise to $651,,000, and the third year and succeeding years would rise to $750,000.
