HomeMy WebLinkAboutR-87-0247J-87-178 2/23/87 RESOLUTION N0.8'7--24 A RESOLUTION RECOGNIZING THE TAX-EXEMPT STATUS CLAIMED BY MIAMI FIREFIGHTER'S BENEVOLENT ASSOCIATION IN SUPPORT OF ITS REQUEST FOR RETURN OF MONIES PAID BY IT BECAUSE OF ITS FAILURE TO TIMELY FILE APPLICATION FOR TAX-EXEMPT STATUS OF ASSOCIATION PROPERTY LOCATED WITHIN THE CITY OF MIAMI; AUTHORIZING AND INSTRUCTING THE FINANCE DIRECTOR TO PAY TO SAID ASSOCIATION THE AMOUNT OF $5,848.61, SAID SUM BEING CONFIRMED AS THE AMOUNT TO BE RECEIVED BY THE CITY AS A RESULT OF THE ASSOCIATION'S NONCOMPLIANCE WITH THE FILING DEADLINE; FURTHER ALLOCATING SAID SUM FROM SPECIAL PROGRAMS AND ACCOUNTS, CONTINGENT FUND. WHEREAS, the Miami Firefighter's Benevolent Association has long been recognized as having a tax-exempt status beoause of its charitable community service program of activities; and WHEREAS, the City has received or is to receive $5,841.61 from tax monies to be paid by said Assooiation due to its having failed to perfect its claim for recognition of such status; and WHEREAS, Dade County has granted to said Association $4,167.00, the amount equal to the sum whioh Dade County received as a result of the Association's noncompliance with the filing deadline for such claims of exempt status; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA; Section 1. The tax-exempt status claimed by the Miami Firefighter's Benevolent Association in support of its request for the return of monies paid by it to the City because of its failure to timely file an application for tax-exempt status of Association property located in the City of Miami is hereby recognized and the Finanoe Director is hereby authorized and instructed to pay to said Association the amount of $5,848.61. said sum being confirmed as the amount received or to be received by the City as a result of the Association's noncompliance with the filing deadline; said amount being hereby allocated from Special Programs and A000unts, Contingent Fund. Odio City Manager RECOMMENDATION: DATE: MAR 51987 FILE: SUBJECT: Agenda Item Firefighters Tax Exempt Status and Re- questing Refund for Meeting REFERENCES: of March 13, 1987 ENCLOSURES: It is respectfully recommended that the City Commission adopt the attached Resolution recognizing the tax-exempt status claimed by Miami Firef ighter's Benevolent Association in support of its request for return of monies paid by it because of its failure to timely file application for tax-exempt status of association property located within the City of Miami, and authorizing and instructing the Finance Director to refund to said Association the amount of $5,848.61, paid by the Association, and allocating said sum from Special Programs and Accounts Contingent Fund. BACKGROUND: The Finance Department recommends returning the $5,848.61 paid by the Miami Firefighters Benevolent Association to the City for property taxes for its failure to timely file an application for tax-exempt status of Association property located in the City of Miami. Dade County has already granted to said Association $4,167.00, the amount equal to the sum which Dade County received as a result of the Association's noncompliance with the filing deadline for such claims of exempt status. 12-1 8'7--247
