RESOLUTION NO. 87-294=
A RESOLUTION AUTHORIZING AN INCREASE IN THE
AMOUNT OF $39,116.00 IN THE CONTRACT BETWEEN
THE CITY OF MIAMI, FLORIDA AND MET
CONSTRUCTION, INC. DATED SEPTEMBER 51, 1986
FOR THE CONSTRUCTION OF THE ORANGE BOWL -
RECEPTION/PRESS INTERVIEW AREA, SAID FUNDS TO
BE PROVIDED FROM FUNDS ALREADY ALLOCATED TO
THE PROJECT; FURTHER RATIFYING THE CITY
MANAGER'S WRITTEN FINDING THAT THE HEREIN
INCREASE RESULTED FROM EMERGENCY
CIRCUMSTANCES BY AN AFFIRMATIVE VOTE OF TWO-
THIRDS OF THE MEMBERS OF THE CITY COMMISSION,
AND ADOPTING THE FINDINGS AND CONCLUSIONS SET
FORTH IN THE PREAMBLE OF THIS RESOLUTION;
FURTHER ACCEPTING THE COMPLETED WORK OF MET
CONSTRUCTION, INC., AT A TOTAL COST OF
$478,540.50 AND AUTHORIZING A FINAL PAYMENT
OF $83,058.45.
WHEREAS, there exists a contract dated September 5,
1986, between the City of Miami, Florida and MET Construction,
Inc., for the construction of the Orange Bowl - Reception/Press
Interview Area; and
WHEREAS, an increase in contract of $39,116.00 is
required to cover the cost of changes required for fire
evacuation and to make the Reception/Press Interview Area more
functional; and
WHEREAS, the City Manager has made a written finding
that a valid emergency existed for the work to be done; and
WHEREAS, the Directors of Department of Parks,
Recreation and Public Facilities and Public Works recommend the
increase to cover the additional costs; and
WHEREAS, funds to cover the increase are available from
money already allocated to the project; and
WHEREAS, all of the work included in the contract and
the proposed increase in contract has been satisfactorily
completed by MET Construction, Inc., and they have furnished the
required documents certifying that all bills for labor and
materials have been paid in full in connection with the aforesaid
contract; and

WHEREAS, the City Manager and the Director of the
Department of Parks, Recreation and Public Facilities, recommend
acceptance of the completed work and authorization of final
payment to the contractor;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE
CITY OF MIAMI, FLORIDA:
{r Section 1. After a properly advertised public hearing,
is the finding of the City Manager set forth in the preamble to this
'I resolution is hereby ratified by an affirmative vote of two-
thirds of the City Commission, and adopted as if fully set forth
in this section.
Section 2. The contract between the City of Miami,
Florida and MET Construction, Inc., for the construction of the
Orange Bowl - Reception Room/Press Interview Area is hereby
increased by $39,116.00 with funds for said increase to be
provided from monies already allocated to the project.
Section 3. The completed work performed by MET
Construction, Inc., for the Orange Bowl - Reception Room/Press
Interview Area is hereby accepted at a total cost of $478#540.50.

Section 4. The proper officials of the City of Miami
are hereby authorized to pay MET Construction, Inc., a balance of
$83,058.45 as full and final payment for all work performed and
all materials furnished in connection with the aforesaid
contract.

REFERENCES: Acceptance.
ENCLOSURES:
It is respectfully recommended that the City Commission adopt the
attached resolution authorizing an increase in the amount of
$39,116.00 in the contract between the City of Miami, Florida and
MET Construction, Inc., for the construction of the Orange Bowl -
Reception/Press Interview Area; said funds to be provided from
funds already allocated to the project; further ratifying the
City Manager's written finding that the herein increase resulted
from emergency circumstances by an affirmative vote of two-thirds
of the members of the City Commission and adopting the finding
and conclusions set forth in the preamble of this resolution;
further accepting the completed work of MET Construction, Inc.,
at a total cost of $4781540.50; and authorizing a final payment
of $83,058.45
BACKGROUND:
The Department of Parks, Recreation and Public Facilities, with
the Department of Public Works, has determined that it is now
appropriate for the Commission to accept the completed work and
authorize final payment, after all conditions are met, for the
Orange Bowl-Reception/Press Interview Area. This project was
performed in accordance with plans and specifications and under
the terms of a contract between the City and MET Construction,
Inc., dated September 5, 1986.
Completion of the project resulted in an overrun of the bid
amount, due to fire safety changes and to changes requested to
increase the functionality of the project. It will be necessary
to authorize an increase in contract of $39#116.00 to cover this
overrun. Resources to cover the increase are available from
funds already allocated to the project.

As required by City ordinances, an increase of $10,000 or more in
a City contract must be accompanied by a finding by the City
Manager that the increase resulted from emergency circumstances,
and such a finding has been prepared and signed. It is further
required that a Public Hearing be held, and the Public Hearing
has been scheduled.
The contractor on the project has satisfactorily completed all
of the work included in the original contract, and the work
covered by the proposed increase in contract, at a total cost of
$478,540.50, which includes the requested $39,116.00 increase in
contract.
