HomeMy WebLinkAboutR-87-0293iM700 0 RESOLUTION NO. 87-293 A RESOLUTION RATIFYING, APPROVING AND CONFIRMING, BY A 4/5THS AFFIRMATIVE VOTE OF THE MEMBERS OF THE CITY COMMISSION, THE ACTION OF THE CITY MANAGER IN FINDING THE DEMOLITION OF A STRUCTURE LOCATED AT 947 N.E. 1ST AVENUE TO BE AN EMERGENCY AND IN AUTHORIZING THE ISSUANCE OF AN EMERGENCY PURCHASE ORDER FOR THE DEMOLITION OF SAID STRUCTURE TO M.C.O. CONSTRUCTION, INC. FOR THE DEPARTMENT OF BUILDING & ZONING AT A TOTAL PROPOSED COST OF $58,861.00; ALLOCATING FUNDS THEREFOR FROM THE BUILDING & ZONING DEMOLITION FUND ACCOUNT CODE #560502-340- 110035 WITH RECOVERY OF SAID AMOUNT TO BE ACCOMPLISHED THROUGH NORMAL LIEN ENFORCEMENT PROCEEDINGS. WHEREAS, pursuant to public notice, sealed bids were received September 10, 1986 for the demolition of a structure located at 947 N.E. 1st Avenue to the Department of Building & Zoning; and WHEREAS, invitations were mailed to twenty seven (27) potential vendors and four (4) bids were received; and WHEREAS, funds for this demolition were available in the Building & Zoning Demolition Fund Account Code #560502-340-110035 with recovery through normal lien enforcement proceedings; and WHEREAS, this structure had become an eyesore being vacant, unsecured, a haven for vagrants; and just in the recent past it had been identified as the source of criminal activity; and WHEREAS, the building had posed a threat to Firefighters and Police Officers responding to frequent calls from the equally endangered and outraged property owners in the area and accordingly justified the City Manager's written finding of an emergency need the for its removal and demolition; and WHEREAS, the City Manager and the Director of the Department of Building & Zoning found that the bid received from M.C.O. Construction, Inc. was the lowest responsible and responsive bid; and WHEREAS, the City Manager has made a written finding that a valid emergency need existed and the safety and welfare of city citizens and city personnel were endangered by the building's dangerous condition; CITY COJUMSI1 MEETING OF MAR 241 1987 NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. By an affirmative vote of four fifths (4/5ths) of the Members of the City Commission, the City Manager's written finding that the demolition of a structure located at 947 N.E. 1st Avenue, Miami, Florida constituted an emergency is hereby ratified. Section 2. The City Manager's action in authorizing the Chief Procurement Officer to issue a Purchase Order to M.C.0 Construction, Inc. in the amount of $58,861.00 for the Department of Building & Zoning with funds therefor allocated from the i Building & Zoning Demolition Fund Account Code #560502-340-110035 with recovery of said amount to be accomplished through normal lien enforcement proceedings is hereby ratified, approved and confirmed. Odi REFERENCES: Bid No. 85-86-133 City Manager ENCLOSURES: For City Commission Meeting of March 31, 1987 RECOMMENDATION It is respectively recommended that a resolution be passed ratifying, approving and confirming the need for emergency action to cause the demolition of the commercial structure located at 947 N.E. 1 Avenue, and the authorization to issue a purchase order to M.C.O. Construction Inc., a contractor, as the lowest responsive. and responsible bidder at the total proposed cost of $589861:00. BACKGROUND: The Department of Building & Zoning has analyzed the need to r execute the attached resolution for ratifying and approving NEWS 1.1 emegency award of bid for the demolition of the subject structure. Pursuant to- public notice, sealed bids were received September 10, 1987, for furnishing materials and equipment needed to demolish and clear away the debris from the structure as directed -� by the Building and Zoning Department, Code Enforcement Section. i The subject building had become an eyesore. It was vacant, unsecured, a haven for vagrants; and just in the recent past it had been identified as the source of criminal activity.
