Dear M%. Noble:
March 6, 1987
You admit: that the restroom facilities do not meet specifications for the physically
disable3. Anti that if you can't find ones that do meet the specifications you will use
the ones that do not meet 255.21 of the Florida statutes.
This is ut-occeptable. we will not be accepting aparthied of the disabled .in this CAMty.
i will request time before the Miami Ccffcrdssion to advise them that we will seek injunction
to close the part, as well as seek punitative damages from the City of. Miami.
I re-gret to Inform you that the sans is ixot "hard packcil" erxxigh for wheelchair use. vnlpsn
you are± a super athletic type with an extraordinary equipped wheelchairs or you have an
exyrrLaive recreational vehicle.
You also state that you are unwilling to provide accessible fishing areas. 9hi9 is con-
sistent with not providing _resLrocros fox the disabled and the settle trechanistn will attempt
to rcer-4y this separation by aparth fd of the 'the disabled. You have provision for: the very
;,blp to fish At this park, yet express unwillingness to provide a fishing alternative for

ship on a separate class of people. We realize that this policy may be urs=nscious in moti-
vation, del ik2et•atn or accidential.
You h-Ad funr13 to make the park accessible and usable to the able, but omitted the disabled.
All such facilities constructed or lensed sitre 1972 by use of public revenue are illegal.
I an imIuduxg this letter to Manager Olio, and requesting to speak before the: Commission
in the hope of correcting a City of Miami Parks Department Administration who did not pravic'
for the disahl.Ni of the City of Miami and the Florida citizens and tourists who are the
vtorlms of this scoiregation/discrintination.
Parks in DAde County should be the showcase of how to provide for the disabled, not the

Dear Mr- Wools
I visited Virginia Key Park last week with my staff srcc1 fiQaliy
to' evaluate existing accessible facilities an well as the
feasibility of constructing additional ones.
The portable toilets which are da3ignud Lc, be aFtir:t_1•:luir
accessible, unfortunately, do not meet the apecitication3 Ear
permanent structures. We are checking with the contractor a:«i
witil the industry to see if there are any available which do meet
those specifications. if there are not, the uxisling 0110'1 '0111
h,,jvcr to suffice until the City cure futirl Lim! c:hrr::c4.1
purmaiscut. rentrovms -
Tilare are three parking spaces designatad for t1ee: disablijt1 in the
harking area along the right of way. We have requested that the
City's General Services Administration strips scveral mart: rear
the wain picnic area and that they all be appLoprintuiy a;gnud.
The paths, main picnics area and the beach area ne.arhy nry sill
hard packed enough to be wheelchair accessible. In ut!Oiition, we
are: investigating the possibility of constructing a raitirw. to the
watere however, there are no plans to provide a<cessible fi,hing
areas. In fact, there should not be any fishing in c:r4ns
reserved for swimming and the beach and jetties will be: signed
accordingly. ,
In the event that funding is provided for additional deve:lorn-.1ent
in the park, we are planning such improvements as boardwalks and
decks. 'i'itese will all be accessible to those uaerS c0nti:aeei to
Wheelchairs.
