Discrimination in
the Fire Dept.

This memorandum addresses the steps taken to implement your
directive to identify an agency to investigate the discrimination
complaints of employees in the Fire Department. Two
possibilities for your consideration are:
1. Equal Employment Opportunity Commission (EEOC)
2. National Panel of Experts.
The EEOC, located in the City of Miami, is a regional office of
the National Equal Employment Opportunity Commission which
administers Title VII of the Civil Rights Act. The EEOC will
provide the following services without charge:
1. Furnish Technical Assistance to persons subject to the law
which includes employers, unions, State & local governments
and employment agencies.
2. Furnish Conciliation Services at the request of an employer
or union whose employees or members refuse to cooperate in
carrying out the provisions of the law.
3. Bake Technical Studies as may be appropriate to carry
the purposes of the law and make the results of its studies
available to the public.
If the EEOC is selected to conduct the investigation, individual
complaints from the aggrieved parties lust be filed. The agency
will determine if a systemic investigation is warranted.
Another approach would be to appoint a national panel of experts
to address the issue of discrimination in the Fire Department.
The Department of Internal Audits b Reviews; Affirmative Action
Division along with Greater Miami United has canvassed other
organizations and experts in the field and compiled the attached
list of names (Attachment 1). These individuals have tentatively
agreed to serve if we can coordinate their individual schedules.
The projected budget to implement this project is approximately
$50,000. (Attachment 2)
The appointment of the panel would require
authorizing the selection and allocation of funds.
