A RESOLUTION RATIFYING, APPROVING AND CONFIRMING, BY A 4/5THS AFFIRMATIVE VOTE OF THE MEMBERS OF THE CITY COMMISSION, THE ACTION OF THE CITY MANAGER THAT THE REQUIREMENTS FOR FORMAL COMPETITIVE SEALED BIDS BE WAIVED AND THAT THE EMERGENCY PURCHASE OF TWO (2) REBUILT HYDROCRANES FROM SHELLEY TRACTOR AND EQUIPMENT CO. FOR THE GENERAL SERVICES ADMINISTRATION DEPARTMENT IN THE PROPOSED AMOUNT OF $120,000.00 BE APPROVED; FUNDS BEING ALLOCATED FROM THE SOLID WASTE COLLECTION EQUIPMENT ACQUISITION PROJECT NO. 353001. WHEREAS, the General Services Administration Department analyzed a proposal which was presented to the City to acquire two (2) rebuilt Bucyrus Erie Hydrocranes from Shelley Tractor and Equipment Company; and WHEREAS, a recommendation was made to the City Manager that it would be in the best interest of the City to act quickly and accept the proposal as this recommendation was based on the estimated cost of two (2) similar new cranes at approximately twice the cost; and WHEREAS, the agreement by Solid Waste Department that acquisition of these two units would meet expanded services needs in accordance with the amended provisions of the City Code that stablishes service requirements; and WHEREAS, this purchase will defer the proposed acquisition of four (4) new hydrocranes and in addition these cranes would be identical to the remainder of the fleet; and WHEREAS, the administration perceived a need to make a commitment quickly in order to reserve the cranes for the City; and WHEREAS, funds for this purchase shall be available from the Solid Waste Collection Equipment Acquisition Project No.353001; and WHEREAS, the Director of General Services Administration Department has determined the validity of this emergency purchase and recommends the waiver of formal sealed CITY COAdI8SION ` 2M f==NG O APR 9 18b1 .. :, bids, and acceptance of the purchase from Shelley Tractor & Equipment Company in the proposed amount of $120,000.00; and WHEREAS, this determination has been approved and adopted as the findings of the Chief Procurement Officer and of the City Manager; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. By an affirmative vote of four fifths (4/5ths) of the Members of the City Commission, the City Manager's written finding, that the purchase of two rebuilt Bucyrus Erie Hydrocranes to be used by the Solid Waste Department constitutes an emergency, is hereby ratified. Section 2. The requirements for formal sealed bids for the procurement of these equipment is hereby waived, and the purchase to Shelley Tractor & Equipment Company at a cost of $120,000.00 is hereby authorized with funds being hereby allocated from the Solid Waste Collection Equipment Acquisition Project No. 353001. Odio "' City Manager ENCLOSURES: RECOMMENDATION: It is respectfully recommended that the City Commission adopt the attached resolution ratifying, approving and confirming the award of a contract for purchase of two (2) rebuilt hydrocranes to Shelley Tractor and Equipment Company for the General Services Administration Department, as an emergency action of the City Manager. Also to authorize the issuance of an emergency purchase order for the total cost of this equipment, for approximately $120,003, which funds shall be available from Pollution Control Bonds. BACKGROUND: The General Services Administration Department analyzed a proposal which was presented to the City to acquire two (2) rebuilt Bucyrus Erie Hydrocranes from Shelley Tractor and Equipment Company. A recommendation was made to the City Manager that it would be in the best interest of the City to act quickly and accept the proposal. This recommendation was based on the estimated cost of two similar new cranes of approximately $229,000, the agreement by Solid Waste Department that acquisition of these two units would meet expanded service needs in accordance with the amended provisions of the City Code that establishes service requirements and defer the proposed acquisition of four (4) hydrocranes at a cost of $458,000. In addition, these cranes would be identical to the remainder of the fleet, and the administration perceived a need to make a commitment quickly in order to reserve the cranes for the City. For these reasons, the City Manager determined emergency award of this contract to be an appropriate action. Budgeted Amount: $120,000.00 Source of Funds: Pollution Control Bonds. The Heavy Equipment Maintenance Section of the General Services Administration Department has found that the City has an opportunity to acquire two (2) completely rebuilt Bucyrus Erie Hydrocranes, H 3 Series, at a total cost of approximately $120,000 for both. The cranes would be delivered to the City, ready for operation within ninety (90) days. Each crane will be equipped with a new diesel engine with a warranty not to exceed one year or 3,000 hours and a six month warranty on the crane itself. Through discussions with the Department of Solid Waste, it has been determined that acquisition of these two (2) cranes, which are identical to the balance of the crane fleet, would meet their expanded service needs, thus deferring the purchase of new cranes. If the City can act quickly, these two rebuilt cranes can be acquired and will result in savings to the City in several ways. First, there will be a savings of approximately $109,000 when compared to the cost of new cranes. Also, these cranes are the same type now used by the Solid Waste Department, which will mean increased utilization of our stock inventory, and there will be no need for training operators or mechanics on a new model of equipment. Solid Waste Department supports the acquisition of this equipment, which will enable that department to achieve additional flexibility and efficiency in collection scheduling. In order to take advantage of the rare opportunity to acquire this rebuilt equipment which meets our specifications, the City must act quickly to obtain a commitment from the vendor to furnish these items within the time frame specified. To immediately place an order for the acquisition of two rebuilt hydrocranes which match the existing fleet, it is recommended �r W y -z pp@� s, R Cesar H. Odio Page 2 that the emergency purchase of these rebuilt cranes be approved. Through consultation with the Departments of Finance and Solid Waste, it was determined that Pollution Bond (see attached) funds are available and may be used for this purpose.
