A RESOLUTION AFFIRMING THE DECISION OF THE ZONING BOARD TO GRANT A SPECIAL EXCEPTION AS LISTED IN ORDINANCE NO. 9500, AS AMENDED, THE ZONING ORDINANCE OF THE CITY OF MIAMI, SCHEDULE OF DISTRICT REGULATIONS, PAGE 4 OF 6, CR COMMERCIAL -RESIDENTIAL, TRANSITIONAL USES, STRUCTURES AND REQUIREMENTS, TO PERMIT CONSTRUCTION OF PROPOSED DRIVE-IN FACILITIES FOR THE CITICORP SAVINGS LOCATED AT APPROXIMATELY 1600 SOUTHWEST 22 STREET (A/K/A CORAL WAY), MIAMI, FLORIDA, MORE PARTICULARLY DESCRIBED HEREIN, AS PER PLANS ON FILE, WITH A REDUCTION OF THE 50' TRANSITIONAL AREA TO A 10, LANDSCAPED AREA; ZONED CR-2/7 COMMERCIAL -RESIDENTIAL (COMMUNITY). THIS SPECIAL EXCEPTION WAS FILED IN CONJUNCTION WITH SPECIAL EXCEPTIONS TO PERMIT A DRIVE-IN FACILITY, AND A REDUCTION IN THE NUMBER OF RESERVOIR SPACES FOR A DRIVE-IN FACILITY. THIS SPECIAL EXCEPTION IS ALSO SUBJECT TO A TIME LIMITATION OF TWELVE MONTHS IN WHICH A BUILDING PERMIT MUST BE OBTAINED. WHEREAS, the Miami Zoning Board at its meeting of February 23, 1987, Item 8, following an advertising hearing, adopted Resolution ZB 25-87 by a nine to zero (9-0) vote granting the Special Exception as listed in Zoning Ordinance 9500, as amended, the Zoning Ordinance of the City of Miami, Schedule of District Regulations, Page 4 of 6, CR Commercial -Residential, Transitional Uses, Structures and Requirements to permit construction of a proposed drive-in teller facility for the Citicorp Savings bank located at 1600 Southwest 22nd Street (Coral Way), also described as Lots 14-19 less north 25 feet of Lots 16 and 17, Block 31 WOODSIDE, Miami, Florida, (5-28), Public Records of Dade County, as per plans on file, with a reduction of the 50 foot transitional area to a 10 foot landscaped area with landscape approval by the Planning Department; WHEREAS, the Planning Department has taken an appeal to the City Commission from the granting of the Special Exception; and WHEREAS, the City Commission after careful consideration of this matter finds that the proposed reduction of the 50 foot transitional area to a 10 foot landscaped area with landscape approval by the Planning Department, as approved by the Zoning CITY COMMS11 YIERWO OF Board, meets the applicable requirements of Zoning Ordinance 9500, as amended; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The decision of the Zoning Board in granting the Special Exception as listed in Ordinance 9500, as amended, the Zoning Ordinance of the City of Miami, Schedule of District Regulations, Page 4 of 61 CR Commercial -Residential, Transitional Uses, Structures and Requirements, to permit construction of a proposed drive-in teller facility for the Citicorp Savings bank located at 1600 Southwest 22nd Street (Coral Way), Miami, Florida, also described as Lots 14-19 less north 25 feet of Lots 16 and 17, Block 3, WOODSIDE (5-28)0, Public Records of Dade County, as per plans on file, with a reduction of the 50 foot transitional area to a 10 foot landscaped area with landscape approval by the Planning Department, zoned CR-2/7 Commercial Residential (Community), with a time limitation of twelve months in which a building permit must be obtained, is hereby affirmed. This special exception is filed in conjunction with special exceptions to permit a drive-in facility, and a reduction in the number of reservoir spaces. RECOMMENDATIONS PLANNING DEPARTMENT DENIAL OF THE SPECIAL EXCEPTION AS REQUESTED. e reduction of the ritty reet tbu I t-F-3-5—ITtional area to only ten feet (101 is not enough to buffer the proposed drive-in facility from the adjacent residential area and would create a negative impact on the adjacent neighborhood. The Planning Department is recommending a masonry wall and a twenty feet (20') landscaped area that would be approved by the Department staff to be sure that a meaningful buffer would be created between both uses. ri PUBLIC WORKS OAOE COUNTY PUBLIC WORKS Require the dedication of 25' radius returns at the intersections of Coral Way with SW 16 Avenue and SW 16 Court. No objections. ZONING BOARD At its meeting of February 23, 1987 the Zoning Board adopted Resolution ZB 25-87, by a 9 to 0 vote, granting the above with a time limitation of (12) twelve months in which a building permit must be obtained. One reply in -favor and one objection received by mail. Three proponents and four opponents were present at this meeting. APPEAL By memorandum dated March 9, 1987 the Planning Department appealed the above to the City Com- mission. W. 22 Street REFERENCES ENCLOSURES Per City Code Chapter 62, Section 62-62, the Planning Department requests a review by the City Commission of a Special Exception granted by the Zoning Board on February 23, 1987, for a reduction of the fifty feet (50') transitional area to a ten feet (10') landscaped area for the drive-in teller facility for Citicorp Savings at 1600 S. W. 22 Street. The Zoning 'Board on February 23, 1987, granted three Special Exceptions for Citicorp Savings at 1600 S. W. 22 Street (Coral Way). The Planning Department cites the following items as forming the basis for review of the reduction of the transitional area where a CR (Commercial -Residential) lot adjoins RS-2 (One -Family Detached Residential) lots. 1. The other two Special Exceptions granted to permit a drive-in facility and to reduce the number of reservoir spaces from ten (10) to (1) for one of the three drive-in tellers will be reviewed by the City Commission according to requirements established by Zoning Ordinance 9500. The Planning Department requests the review of the third Special Exception in order to present to the City Commission a more comprehensive picture of the proposed drive-in teller facility for Citicorp.Savings. 2. The reduction of the fifty feet (50') transitional area to only ten feet (10') is not enough to buffer the proposed drive-in facility from the adjacent residential area. A twenty feet (20') fully landscaped area is recommended by the Planning Department. 3. The reduction of the transitional area for the proposed drive-in facility as requested would create a negative impact on the adjacent neighborhood. It is requested that this item be heard at the City Commission Meeting of. March 31, 1987.
