A RESOLUTION CLOSING, VACATING, ABANDONING
AND DISCONTINUING THE PUBLIC USE OF THE WEST
232.7 FEET OF NORTHEAST 21ST STREET AND THE
WEST 256.61 FEET OF THE EAST 300 FEET OF
NORTHEAST 20TH TERRACE LYING EAST OF THE
FLORIDA EAST COAST RAILROAD RIGHT OF WAY AND
THE EAST 200 FEET OF THE EAST -WEST ALLEY
LYING IN THE BLOCK BOUNDED BY NORTHEAST 22ND

ALL AS A CONDITION OF APPROVAL OF TENTATIVE
PLAT NO. 1295 - "CENTRAL BAY VIEW."
WHEREAS, the Miami Zoning Board, at its meeting of
April 6, 1987, Item No. 7, following an advertised hearing,
adopted Resolution No. ZB 47-87, by a nine to zero (9-0) vote,
RECOMMENDING APPROVAL of the official vacation and closure of
portions of streets and a portion of an alley as hereinafter set
forth; and
WHEREAS, the City Commission finds that it is in the best
interest of the general welfare of the City of Miami and its
inhabitants to grant the vacation and closure of the streets and
alley in question and deems it advisable to do so;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY
OF MIAMI, FLORIDA:
Section 1. The west 232.7 feet of Northeast 21st Street and
the west 256.61 feet of the east 300 feet of Northeast 20th
Terrace lying east of the Florida East Coast Railroad right of
way and the east 200 feet of the east -west alley lying in the
block bounded by Northeast 22nd Street, Northeast 2nd Avenue, 3

Northeast 21st Street and the Florida East Coast Railroad right
of way, Tracts A & Be are hereby closed, vacated, abandoned and
discontinued for public use, as shown on and all as a condition
of approval of Tentative Plat No. 1295 - "Central Bay View."

THE PROPERTY
John T. Blount, as Trustee, and Florida Power and
Light Company, the sole beneficial owner, are the owners
of approximately 4.87 acres of land located on the north
side of N.E. 20th Street abutting the east side of the
F.E.C. Railroad right of way and extending northward to
N.E. 22nd Street. The following location map and aerial
photographs show the property.

THE PROPOSED DEVELOPMENT
The applicants are proposing to build a Downtown
Service Center to serve the underground duct network for
the entire downtown Miami area on the Property. This
location has the advantage of close proximity to the
downtown area without being subject to the same rush hour
traffic and other problems associated with the current
downtown service center located on S.W. 2nd Avenue and
S.W. 3rd Street in the downtown area.
The proposed Downtown Service Center will house
approximately twenty-eight (28) work crews and associated
administrative and engineering staff for a total of
approximately one hundred (100) employees based on the
property. The service center will be on call and have
security twenty-four (24) hours per day seven (7) days per
week.
As shown on the following plot plan development
of the property will include: a 4,000 square foot vehicle
maintenance building; a 12,000 square foot warehouse and
associated storage yard; and a 17,000 square foot office
building with associated employee parking areas.

THE ZONING AND PLATTING REQUEST
In order to utilize the property for the Downtown
Service Center, the Applicants are requesting that a small
segment of the deadend portions of N.E. 20th Terrace, N.E.
21st Street and the mid -block east -west alley between N.E.
21st Street and N.E. 22nd Street be closed and vacated as
per the Tentative Plat of Central -Bay View. The portions
of the roadways and alley to be vacated are highlighted on
the following page.

THE EXISTING CONDITIONS
As they currently exist N.E. 20th Terrace, N.E.
21st Street, the mid -block alley, and N.E. 22nd Street are
all substandard right-of-ways. That is, they do not meet
the current subdivision standards as set out in Chapter
54.5 of the City of Miami Code. All of these
right-of-ways are more than 1,000 feet long and deadend
with no turnaround facilities. The current Code, Section
54.5-12(A)(4), prohibits deadend roadways of more than 600
feet long and also requires all deadend roadways to
provide cul de sac turn around facilities with a minimum
diameter of one hundred (100) feet.
The portions of N.E. 20th Terrace and the
mid -block alley to be closed have never even been
improved --there is no pavement, sidewalk, curb or gutter
on either of these roadways, despite the fact that they
were first dedicated more than fifty (50) years ago. In
addition, both of these right-of-ways have been blocked
off by either barricades or walls for years. Furthermore,
while N.E. 21st Street is improved, the portion to be
closed only provides access to the property owned by the
Applicants and the same is also true for the alley to be
closed.
This area also has inadequate and substandard
public water facilities. The only water lines serving the
area are as follows: a two (2) inch water "main" on N.E.
20th Terrace; a two (2) inch water "main"on N.E. 21st
Street, a one and one-half (1-1/2) inch water "main" on
N.E. 22nd Street; and a six (6) inch water "main" on N.E.
20th Street. The Dade County fire flow ordinance requires
at least a twelve (12) inch water line for commercial and
office development.

PUBLIC BENEFITS FROM APPROVAL OF
HE ROAD CLOSURE AND CENTRAL -BAY VIEW PLA
As shown on the plot plan and plat, the
Applicants are proposing to correct the existing roadway
deficiencies by dedicating and constructing a new N.E. 1st
Avenue connecting N.E. 20th Terrace and N.E. 21st Street.
As a result, these roadways will no longer be deadend
roadways and will meet current code requirements. They
are also going to dedicate and construct a new half cul de
sac on the south side of N.E. 22nd Street, which will
provide a turnaround facility where none currently
exists. The estimated cost for these improvements along
with some additional widening of N.E. 20th Street is
estimated to be approximately $103#000.
In addition to the cost of constructing these
improvements, the Applicants are dedicating all land
necessary for the creation of the improvements. As shown
in the following letter from A. R. Toussaint & Associates,
Inc., closure of tF:e requested roadways and dedication of
the land for the new facilities will result in a net
surplus of 4,6ll square feet, or .10 acres of land for the
Applicants. However, the Applicants will also be required
to provide more than 6r234 square feet of utility
easements for the construction of the water line discussed
below. The Applicants will never be able to build any
buildings on these areas, therefore the real result of
this approval will be the net loss of approximately 1,624
square feet of property for the Applicants. On the other
hand, the net result of these improvements for the public
will be a direct benefit from correction of the existing
substandard roadway facilities in the area.
As shown on the following plan, the Applicants
will also vastly improve the public water facilities in
the area by tapping into an existing twenty (20) inch
water main located near North Miami Avenue and theoretical
N.E. 18th Street. They will then install 600 feet of
sixteen (16) inch waterline on N.E. Miami Court up to and

along N.E. 20th Street. From there they will install 600
feet of twelve (12) inch water line running northward
along the eastern boundary of the property and along the
new N.E. 1st Avenue all the way to N.E. 22nd Street. They
will also install fire hydrants at N.E. 20th Terrace, N.E.
21st Street, and N.E. 22nd Street along this water line
extension. The estimated cost of this water main
extension is $750000.
This proposed water main extension will provide
extensive public benefits to the entire neighborhood by
providing sufficient water supply to adequately fight
fires in the area where there is virtually no fire
fighting capability at the present time. The Applicants
have also been informed by the Fire Department that they
have refused to issue building permits for a few projects
in this area because of the inadequate fire flow and
because those projects were small enough that they could
not economically afford to install a $75,000 water line.
Therefore, in addition to the immediate benefit of
improved firefighting capability, this project will also
make it possible for other redevelopment projects in the
area to more forward.

THE UTILITY EASEMENT
As part of the road closure application the
applicants are seeking approval to close the dead-end
portion of the mid -block alley between N.E. 21st Street
and N.E. 22nd Street. In order to protect the adjoining
neighbor, Mrs. Lennie Sanders, the Applicants are
proposing to provide suitable access from the remaining
portion of the alley to N.E. 22nd Street by means of a
twenty foot wide utility easement. In support of this
request, which was fully supported by the Plat and Street
Committee and recommended unamiously by the Zoning Board,
the Applicants have submitted the following affidavit from
Mrs. Sanders. In the affidavit Mrs. Sanders states that
the alley has not been open to the public for the
fifty-three (53) years that she has resided on the
property and that she fully supports the use of a utility
easement to provide suitable access to the alley. The
Applicants have also proffered an Indemnification and Hold
Harmless Agreement to the City, which will protect the
City in the event there is ever an action brought against
the City concerning the utility easement. The City
Attorney's office has approved the form of this
agreement. The following aerial photos show the alley in
question. They also show that the alley is blocked off by
walls, fences and even a two story house at one location.
In short, the alley is not in use and has not been in use
for more than fifty-three (53) years and does not
currently provide access to N.E. 22nd Street.

personally appeared Lennie Sanders, who being first duly
sworn, upon oath, deposes and says:
1. That she is the owner of the West 37.5 feet
of Lot 14, Block 1, Rural Home, P.B. 2/65, also known as
72 N.E. 22nd Street, Miami, Florida 33137.
2. That she has resided on the above described
property for approximately the last 53 years.
3. That to the best of her knowledge and belief
no one, other than Southern Bell Telephone Utility Company •
employees, have ever utilized the 10 ft. alley, which runs
along the southern border of her property, as a means of
access during the period of time she has resided on the
property.
4. That the alley running along the southern
border of her property is currently and always has been
inaccessible to members of the general public.
5. That in the past when the building adjacent
to her property burned down and members of the public gained
access to the alley described above, that she experienced
many problems with derelects and other undesirables gaining
access to her back yard and utilizing her hose and sink
as a public bathroom.
6. That she fully supports the efforts by the
City of Miami and Florida Power and Light Company to provide
suitable access to the existing alley by means of a utility
easement.

CONCLUSION
Approval of the Road Closure Application and Plat
of Central -Bay View submitted by John T. Blount, as
Trustee and Florida Power and Light Company, as sole
beneficial owner, will have direct and measurable public
benefits and not cause the loss of any needed public
access. Approval will result in the elimination of two
substandard deadend roadways on N.E. 20th Terrace and N.E.
21st Street, and the creation of turnaround facilities
where none currently exist on N.E. 22nd Street. The cost
of these improvements is approximately $103,000. Approval
will result in the installation of more than 1p200 feet of
new sixteen (16) and twelve (12) inch water mains, which
will vastly improve the firefighting capability in the
entire surrounding neighborhood. The cost of these
improvements is approximately $75,000. Approval will
allow redevelopment of other smaller properties in the
area that could not otherwise afford to provide the
required fire flow. Approval will provide for the
creation of one hundred jobs and a strong new economic
force in an area sorely in need of new reinvestment.
Finallyp approval will allow FPL to better serve its
customers throughout Downtown Miami.

The Florida Power and Light Company needs the
vacation and closure of the above mentioned
portions of streets and alley, in order to
obtain a more unified site. The Tentative Plat
#1295 also includes the creation of NE 1st
Avenue which would give public access to
abutting properties by linking NE 20th Street
and NE 21st Street.
PUBLIC WORKS APPROVAL. The Department agrees with the
recommendation of the Plat and Street Committee
for approval of the closure of the streets and
alley subject to the required conditions being
satisfied.

No objections.
ZONING BOARD At its meeting of April 6, 1987 the Zoning Board
adopted Resolution ZB 47 -87 by 9 to 0 vote,
recommending approval of the above request, with
an easement rather than alley connecting NE 21st
Street with the existing alley.
Four replies in favor and one objection were re-
ceived by mail. Three proponents were present
at this meeting.

Dear Ms. Fox:
This letter will serve as our Letter of Intent
and explanation for the above referenced Road Closure
Application. Florida Power and Light Company (FPL) is
in the process of acquiring and replatting a 4.84 acre
parcel of land located on N.E. 20th Street, just east of
and abutting the Florida East Coast Railway right-of-way.
It is their intent to construct a service center to serve
the underground duct network for the entire downtown Miami
area on this site. Construction of the Downtown Service
Center on this site will allow FPL to begin to relocate
some of its facilities and operations, which are currently
located on S.W. 2nd Avenue in the downtown area just north
of the Miami River. However, -in order for FPL to utilize
the property on N.E. 20th Street, they need to be able
to close the deadend portions of N.E. 20th Terrace, N.E.
21st. Street and a portion of a( mid -block east/west alley
between N.E. 21st Street and N.E. 22nd Street so that
the site can be assembled into a single parcel.

To accomplish this, Mr. Blount, as Trustee, and
FPL have submitted this Application and a Tentative Plat
entitled "Central -Bay View", -which was unanimously approved
by the City of Miami Plat and Street Committee on March
4, 1987, reflecting the closure of the above referenced
right-of-ways and in their place the dedication of a one
block long proposed N.E. lst Avenue, a partial cul-de-sac
turnaround on N.E. 22nd Street and a proposed utility
easement linking the alley and N.E. 22nd Street.
More specifically, this Road Closure Petition
respectfully requests the closure and vacation of:
(1) approximately 250' of N.E. 20th Terrace located between
lots 16-21, Block 1 and Lots 16-21, Block 2, West Bay Side
according to the plat thereof, recorded in Plat Book 2,
at Page 43, of the Public Records of Dade County, Florida;
and 2) approximately 244.6' of N.E. 21st Street located
between lots 17-21, Block 1, and Lots 17-21, Block 2, Bay
View Addition, according to the plat thereof, recorded
in Plat Book "B", at Page 104, of the Public Records of
Dade County, Florida; and 3) 210' of the east/west alley
between Lots 15-18, Rural Home, according to the plat
thereof, recorded in Plat Book 2, at Page 65, the Public
Records of Dade County, Florida and Lots 17-21, Block 1,
Bay View Addition, according to the plat thereof, recorded
in Plat Book "B", at Page 107, of the Public Records of
Dade County, Florida.
This Road Closure Application and proposed Plat
request the vacation of 26,519 sq. ft. of right-of-way
area, however, through the creation of the new roadway
improvements, 21,908 sq. ft. are being rededicated.
Therefore, the net change is only 4,611 sq. ft. or less
that 11/100th of an acre. Moreover, the general public,
and particularly those persons living and working in the
immediate area, will actually benefit from the approval
of the Central -Bay View plat and this Road Closure
Application. At the present time, N.E. 20th Terrace, N.E.
21st Street, and N.E. 22nd Street are all blind deadend
roadways that are more than 1,000 feet long and provide
no turn -around facilities. To remedy this situation, the
Road Closure Application and Plat provide for the creation
of a new N.E. 1st Avenue linking N.E. 20th Terrace and
N.E. 21st Street. It also provides for a partial cul-de-sac
on N.E. 22nd Street. These improvements will eliminate
two deadend roadways and provide a turn -around facility
on U.E. 22nd Street where none currently exists.

These proposed new facilities will be particularly
helpful to the Police, Fire and Solid Waste Departments
as they carry -out their daily patrols, garbage pickup and
emergency calls. They will also obviously benefit the
immediately surrounding neighborhood by providing a generally
improved circulation pattern. Moreover, the creation of
the new N.E. 1st Avenue will correct the existing land
use pattern that does not meet the current subdivision
regulation standards.
In addition to improving the circulation pattern
in the immediate area, approval of this Road Closure request
and the associated Plat of Central -Bay View, will have
another major positive impact on the surrounding area.
At the present time, the waterlines serving this area are
grossly inadequate. As the Tentative Plat shows, there
are currently 2 inch waterlines on N.E. 20th Terrace and
N.E. 21st Street and a 1h inch waterline on N.E. 22nd Street.
I£ this Road Closure Application and the associated Plat
are approved, FPL will substantially upgrade the water
facilities in the area by tapping into the 20 inch waterline
located south of Biscayne Park at approximately N.E. 18th
Street and extending a 12 inch waterline northward up N.E.
Miami Court across N.E. 20th Street, then up the proposed
N.E. lst Avenue and eventually extending all the way up
to N.E. 22nd Street. This watermain extension, which is
estimated to cost $100,000, will vastly improve the water
pressure and fire fighting capability in the entire
surrounding area.
The construction of the Downtown Service Center
by FPL on this site will also benefit the surrounding area
by creating a major new business, with 24 hour security,
in the area. This should have the added benefit of
encouraging further reinvestment and redevelopment in an
area that has been historically somewhat neglected, as
is evidenced by the condition of the water system in the
area.

aware that the property owner immediately abutting the
proposed 20 ft. alley is an elderly woman named Lennie
Sanders who has lived on that property for approximately
53 years. In speaking to her, she informed the Applicants
that she was very much opposed to the creation of an alley
adjacent to her property because she was fearful that she
would again suffer problems with derelicts and undesirables
gaining access to her yard and utilizing her hose and sink
as a public bathroom. In essence, she is very fearful
of the general public gaining access to her backyard. She
further informed the Applicants that in the 50 plus years
that she has lived on the property that no one has ever
used the alley as a means of a public access. This fact
was confirmed by a field investigation, which shows that
substantial portions of the alley have been blocked off
by fences, walls and in one case, even a two-story structure.
In response to Mrs. Sanders' concerns, the
Applicants then met with City staff members to see if an
alternative approach could be developed. After relatively
lengthy discussions, it was determined that the best
alternative would be the creation of a 20 ft. utility
easement, which would guarantee access to the Southern
Bell telephone lines in the existing alley. This alternative
was presented to the Map and Street Committee at the time
of their approval of the tenative plat. After a thorough
discussion, it was agreed that the application should go
forward in the alternative. That is that the tentative
plat be approved showing a 20 ft. utility easement or in
,the alternative, a 20 ft. alley. Further, that the final
determination regarding the utility easement or the alley
should be made by the City Commission after a public hearing
on the Road Closure Application.
Based on the recommendations of the Plat and
Street Committee, the Applicants have submitted the Road
Closure Application requesting approval of the 20 ft. utility
easement or in the alternative, a 20 ft. alley. The
Applicants do not have any strong preference for either
the utility easement or the alley and are fully prepared
to accept either alternative based on the wishes of the
City. On the other hand, the Applicants fully recognize
and respect Ms. Sanders' concerns regarding the provision
of access to her rear yard, and to that extent prefer the
provision of a 20 ft. utility easement. The Applicants

The City of Miami Plat and Street Committee, at its meeting of
March 4th, 1987, approved the above tentative plat subject to
the following revisions being made to the tentative plat,
additional information being provided and/or variances being
granted. Please be advised that the processing of your
tentative plat cannot proceed until these conditions have been
satisfied.
- Public hearing for approval to close right-of-way.
- Correct legal descriptions.
- Obtain a letter from the FEC approving the closure
of N.E. 21 Street and the alley abutting the FEC
Railroad right of way.
-*Remove the building encroachment in the proposed
public right of way before the tentative plat is
approved by the City Commission or execute an
agreement approved by the Law Department for the
removal of the building encroachment.
- Dedicate one half of a cul-de-sac at the dead-end
on N.E. 22 Street.
- Execute an agreement for maintaining the
landscaping on the east side of N.E. 1 Avenue.
- Provide suitable access from the closed end of the
alley to N.E. 21 or 22 Street. The type of access
will be determined by the Law and Public Works
Departments.
In addition to the above

2. The alteration, relocation or installation of utilities
such as storm and sanitary sewers, electric, telephone,
water, etc., caused by this plat will be at the property
owner's expense. Also, utility easements may be required
on the property being platted.
3. A building permit will not be issued on the property being
platted until the final plat is recorded. Also, the
Certificate of Occupancy for any building construction will
be issued only after all the required subdivision
improvements have been completed.
4. Approval for fire flow requirements must be obtained from
- the Fire, Rescue and Inspection Services Department prior
to the issuance of a building permit.
5. Additional items must be provided to the City of Miami
Department of Public Works before the final plat is
submitted to the City Commission for approval. You will be
notified in writing as to what these items are after the
amount of the bond has been determined for the necessary
subdivision improvements.
6. Tentative plat approval is only valid for one (1) year from
the da—c of the Plat and Street Committee Meeting at which
t,bme it was approved.

refer to the attached sheet for the appropriate person to
contact.
