HomeMy WebLinkAboutR-87-0375ri d-87-291 4/10/87 RESOLUTION NO. 87r375 A RESOLUTION RECOGNIZING THE TAX-EXEMPT STATUS CLAIMED BY THE CANAAN MISSIONARY BAPTIST CHURCH AND RELIGIOUS CENTER IN SUPPORT OF ITS REQUEST FOR RETURN OF MONIES PAID BY IT BECAUSE OF ITS FAILURE TO TIMELY FILE APPLICATION FOR TAX-EXEMPT STATUS OF CHURCH PROPERTY LOCATED WITHIN THE CITY OF MIAMI; AUTHORIZING AND INSTRUCTING THE FINANCE DIRECTOR TO PAY TO SAID CHURCH THE AMOUNT OF $6,419.78, SAID SUM BEING CONFIRMED AS THE AMOUNT TO BE RECEIVED BY THE CITY AS A RESULT OF THE CHURCH'S NONCOMPLIANCE WITH THE FILING DEADLINE; FURTHER ALLOCATING SAID SUM FROM SPECIAL PROGRAMS AND ACCOUNTS, CONTINGENT FUND. WHEREAS, the Canaan Missionary Baptist Church and Religious Center has long been recognized as having a tax-exempt status under provisions of the Florida Statutes; and WHEREAS, the City has received or is to receive $6,419.78 from tax monies to be paid by said Church due to its having failed to perfect its claim for recognition of such status; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA; Section 1. The tax-exempt status recognized under Florida law and claimed by the Canaan Missionary Baptist Church and Religious Center in support of its request for the return of monies paid by it to the City because of its failure to timely file an application for tax-exempt status of Church property located in the City of Miami is hereby recognized and the Finance Director is hereby authorized and instructed to pay to said Church the amount of $6,419.78, said sum being confirmed as the amount received or to be received by the City as a result of the Church's noncompliance with the filing deadline; said amount being hereby allocated from Special Programs and Accounts, Contingent Fund. Odio REFLR[NC[l'Tax Exempt Status of City Manger Canaan Missionary Baptist ENCLOSURES: Church and Religious Center RECOMMENDATION: It is respectfully recommended that the City Commission adopt the attached Resolution recognizing the tax-exempt status claimed by Canaan Missionary Baptist Church and Religious Center, in support of its request for return of monies to be paid by it because of its failure to file an application for tax-exempt status of property located -within the City of Miami, and authorizing and Instructing the Finance Director to refund to said church, the amount of $6,419.78, which is to be paid by the church, and allocating said sum from Special Programs and Accounts Contingent Fund. BACKGROUND: The Finance Department recommends reimbursing the $6,419.78 to be paid by the Canaan Missionary Baptist Church and Religious Center to the City for property taxes, for its failure to file and application for tax-exempt status of Church property located in the City of Miami. cc: law Department y -/
