RESOLUTION NO. 87 -454
A RESOLUTION AUTHORIZING THE CITY MANAGER TO
NEGOTIATE UP TO $25,000 WITH PROPERTY OWNER
FOR ACQUISITION OF REAL PROPERTY LOCATED AT
2610 NORTHWEST 25TH AVENUE IN THE CITY OF
MIAMI, LEGALLY DESCRIBED AS THE SOUTH 20 FEET
OF LOT 2, AND NORTH 20 FEET OF LOT 3, BLOCK 2
OF GROVELAND, AS RECORDED IN PLAT BOOK 11 AT
PAGE 54 OF DADE COUNTY PUBLIC RECORDS, TO BE
USED FOR THE DEVELOPMENT OF AFFORDABLE
HOUSING FOR LOW AND MODERATE INCOME FAMILIES;
FURTHER AUTHORIZING AND DIRECTING THE CITY
ATTORNEY TO PROCEED TO CLOSE ON THE SAID
PROPERTY AFTER EXAMINATION OF THE ABSTRACT
AND CONFIRMATION OF OPINION OF TITLE; SAID
ACQUISITION COSTS TO BE PROVIDED FROM THE
GENERAL OBLIGATION HOUSING BOND FUND.
WHEREAS, in November of 1983, the Melrose Nursery site was
acquired for the development of housing affordable to low and
moderate income families; and
WHEREAS, Metropolitan Dade County serving as the City's
acquisition agent did not acquire a single family dwelling
located in the southeast corner of the site at 2610 Northwest
25th Avenue; and
WHEREAS, in October of 1986, the City retained the services
of two (2) appraisers in order to determine the fair market value

of the subject property; and
WHEREAS, the two appraisers retained by the City determined
the fair market value of the subject property to be $15,000 and
$25,000; and
WHEREAS, the City Commission, through Resolution No. 86-887
authorized the City Manager to negotiate with the owner of the
subject property and established a purchase price of $20,000; and
WHEREAS, the City's initial offer of $20,000 which
represented an average of the two appraisals secured by the City
was rejected by the property owners; and
WHEREAS, a counter offer of $25,000 was submitted by the
property owner which represents the highest appraised value of
the subject property; and

WHEREAS, an increase in the City's offer of $25,000 would
enable the last remaining property not under public ownership on
the Melrose Nursery site to be acquired;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY
OF MIAMI, FLORIDA:
Section 1. The City Manager is hereby authorized to
negotiate up to $25,000 for the parcel located at 2610 Northwest
25th Avenue to Wayne A. Rofolante, Trustee, for the testamentary
Trust, of Henry C. Morat, owner, in connection with the
development of affordable sales housing on the publicly owned
Melrose Nursery site.
Section 2. All funding for the costs of the herein
authorized acquisition is hereby allocated from the General
Obligation Housing Bond Fund.
Section 3. Upon notification from the City Manager that an
agreement %pith the property owner(s) has been reached in
accordance with the above authorization, the City Attorney is
hereby authorized to proceed to close on said property after
examination of the abstract and confirmation of an Opinion of
Title; whereupon, if approved by the City Attorney, the City
Manager is hereby authorized to disburse the sum(s) of money in
accordance with said agreement.
Section 4. All recitals and finds contained in the preamble
of this Resolution are hereby incorporated by reference thereto
and are hereby adopted as if fully set forth in this section.

RECOMMENDAT I ON :
It is respectfully recommended that the City Commission adopt the
attached resolution authorizing the City Manager to negotiate with
the property owner up to $25,000 for the acquisition of a „single
family dwelling located in the southeast corner of the publicly
owned Melrose Nursery site.
BACKGROUND:
The Housing Conservation and Development Agency recommends the
adoption of the attached resolution authorizing the City Manager
to negotiate with the property owner of a parcel located in the
southeast corner of the publicly owned Melrose Nursery site. The
_ proposed resolution authorizes and directs the City Manager to
negotiate with the property owner up to $25,000 for purchase of
the subject property.
In November of 1983, the m(_!�lrose Nursery site was acquired for the
purpose of developing housing affordable to low and moderate
income families:.. It was later discovered that a single family
dwelling located in the southeast corner of the Melrose Nursery
property was not acquired by Metropolitan Dade County HUD, which
served as the City's acquisition agent.
In an effort to acquire the last remaining property not under
public ownership on the Melrose Nursery site, the City retained
the services of two appraisers in order to determine the fair
market value of the property. The appraisers retained by the
City, Gene B. Bracer and Rennee Rolle -Dawson, determined the fair
market value of the property to be $15,000 and $25,000,
respectively.
On November 13, 1986, through Resolution No. 86-887, the City
Commission authorized the City Manager to proceed in acquiring the
subject property through a negotiated purchase. A purchase offer
of $20,000 was authorized by the City Commission to be made to the
owner.

Subsequently, the City's offer of $20,000 was forwarded to the
owner and a counter offer of $25,000 was submitted by the owner,
which represents the highest appraised value assigned the property
by the appraisers.
In an effort to acquire the last remaining property not under
public ownership on the Melrose Nursery site, the Housing
Conservation and Development Agency recommends an increase in the
= purchase offer to $25,000. . Funds are available from the General
Obligation Housing Bond fund to cover the cost of acquiring the
subject property.
