HomeMy WebLinkAboutR-87-045309 06 J•-87-464 5/14/87 r RESOLUTION NO.�7"-`A=J+3 A RESOLUTION AUTHORIZING THE CITY MANAGER TO MAKE OFFERS TO PROPERTY OWNERS FOR ACQUISITION OF FIFTEEN PARCELS (PARCELS 02-01 THRU 02-15) WITHIN THE MODEL CITY COMMUNITY DEVELOPMENT TARGET AREA AND WHICH ARE MORE PARTICULARLY AND LEGALLY DESCRIBED IN THE ATTACHED EXHIBITS "A" AND "B", TO BE USED FOR THE DEVELOPMENT OF HOUSING AFFORDABLE TO LOW AND MODERATE INCOME FAMILIES IN CONNECTION WITH THE CITY SPONSORED SCATTERED SITE AFFORDABLE HOUSING DEVELOPMENT PROGRAM; FURTHER DIRECTING THAT MAIL NOTICE OF A PUBLIC HEARING SCHEDULED BEFORE THE CITY COMMISSION BE GIVEN TO ALL OWNERS OF PROPERTY WITHIN 375 FEET OF THE PROPERTY LINES OF THE LAND PARCEL SOUGHT TO BE OBTAINED FOR THE PURPOSE OF OBTAINING CITY COMMISSION APPROVAL OF EACH ACQUISITION PRIOR TO THE CITY ATTORNEY CLOSING ON THESE PARCELS AFTER EXAMINATION OF THE ABSTRACT AND CONFIRMATION OF OPINION OF TITLE; FURTHER DESIGNATING PREVIOUSLY APPROPRIATED 11TH YEAR COMMUNITY DEVELOPMENT LAND ACQUISITION FUNDS IN THE AMOUNT OF $1,000,000 TO COVER THE COST OF SAID ACQUISITION. WHEREAS, there exists a severe shortage of standard housing in the City of Miami affordable to families and individuals of low and moderate income; and WHEREAS, on October 23, 1986, the City Commission passed and adopted Resolution No. 86-840, which approved implementation of the Scattered Site Affordable Housing Development Program in the City's Community Development Target Areas for the purpose of providing owner -occupied residential units within the affordability range of qualified low and moderate income purchasers; and WHEREAS, in October of 1986, the City Commission authorized the issuance of $4,200,000 in Special Obligation Bonds for the purpose of providing construction financing for such housing; and WHEREAS, the City, serving as developer, plans to finance the development of up to fifteen (15) owner -occupied residential units in the Model City neighborhood during Phase I of the Program; and WHEREAS, fifteen (15) parcels in the Model City Community Development Target Area have been identified and recommended for CITY COI4MSSION ATTACHMENTS MEETING OF MAY 14 1987 ENCLOSED LESOLUTION ti.- 87'� 46!1-12 0 the development of housing affordable to low and moderate income families; and WHEREAS, the City of Miami is interested in acquiring parcels of land located in the Model City neighborhood which are more particularly and legally described in the attached Exhibits A and B for the development of such housing; and WHEREAS, appraisals have been obtained and efforts to secure the properties for valid public and municipal purposes through negotiation should be undertaken by the City; and WHEREAS, funds in the amount of $1,000,000 are available from llth Year Community Development. Block Grant funds for acquisition of the subject properties; and WHEREAS, the amounts set forth in Exhibit A are reasonable and in keeping with the costs of acquiring property through the normal negotiation process; and WHEREAS, the City Commission previously established a policy under Resolution Yqo. 77-73 to provide a bonus over the appraised value to owners who sell their_ property to the City through a negotiated settlement in Lieu of condemnation; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: SECTION 1. The City Manager is hereby authorized to negotiate with the property owners of fifteen (15) parcels of land in the Model City Community Development Target Area and which are particularly and legally described in the attached Exhibits A and B are hereby authorized for acquisition by way of negotiated purchase. SECTION 2. The City Manager is further hereby authorized to negotiate with the above property owners within the framework of the two appraisals obtained for each parcel and further authorized to offer a settlement bonus as per Resolution No. 77-73. SECTION 4. Eleventh Year Community Development Block Grant land acquisition funds in the amount of $1,000,000 previously authorized by the City Commission is hereby designated to fund the cost of said acquisition. SECTION 5. Upon an agreement with the property owner(s) being reached in accordance with the above authorization there shall be a Public Hearing scheduled before the City Commission with mail notice of said hearing having been given to all owners of property within 375 feet of the property lines of the land parcel sought to be obtained. The City Attorney is hereby authorized then to proceed to close on said property whose acquisition shall have been approved by the City Commission. After examination of the abstract and confirmation of an Opinion of Title, if approved by the City Attorney, the City Manager is hereby authorized to disburse the sum(s) of money in accordance with the City Commission's approval. SECTION 6. Odio City Manager LATE: MAY 0 61987 R1L[+ Resolution Authorizing SUBJECT: Acquisition of Parcels in Model City REFERENCES: City Commission Agenda Item - May 14, 1987 ENCLOSURES: RECOI4MENDATION: It is respectfully recommended that the City Commission adopt the attached resolution authorizing the acquisition of fifteen (15) parcels in the Model City Community Development Target Area through a negotiated purchase for the purpose of developing affordable sales housing in connection with the City sponsored Scattered Site Affordable Housing Development Program. BACKGROUND: The Housing Conservation and Development Agency recommends through a negotiated purchase, the acquisition of fifteen (15) parcels in the Model City Community Development Target Area. The proposed resolution authorizes and directs the City Manager to proceed in acquiring the said sul)ject parcels. in October of 1986, through Resolution No. 86-840, the City Commission approved the implementation of the City sponsored Scattered Site Affordable mousing Development Program in the City's Community Development Target Areas for the purpose of providing owner occupied residential units within the affordability range of qualified low and moderate income purchasers. In addition, the City Commission authorized the City Manager to proceed in securing appraisals of home sites with initial emphasis in the Allapattah, Model City, Wynwood and Overtown target areas. Fifteen (15) parcels have been identified by City staff for acquisition in the Model City neighborhood in connection with the program. The City retained the services of two appraisers in order to determine the fair market value of each of the parcels proposed for acquisition. $1,000,000 in Community Development Block Grant funding previously authorized by the City Commission for the acquisition of home sites in connection with the Program is available to fund the cost of acquiring the parcels. 9/7-/ 8'7-45*3 4t A The City of Miami, serving as developer, will be able to deliver the residential units planned for construction under the Program at sales prices affordable to low and moderate income purchasers. Approximately, $3,900,000 in tax exempt bond proceeds are available for construction financing. A consortium of five local financial_ institutions have tentatively agreed to provide the low and moderate income buyers with first mortgage home purchase financing subject to second mortgage financing through the Dade County Surtax Program. Acquisition of the subject parcels will result in the development of fifteen units of sales housing in the Model City neighborhood. f 8'7-453
