HomeMy WebLinkAboutR-87-0518J-87-480 5/28/87 RESOLUTION NO. 87--5118 A RESOLUTION AUTHORIZING AND PERMITTING THE RESTRICTION OF VEHICULAR ACCESS TO JEFFERSON STREET AT S.W. 28 STREET ON A SIX (6) MONTH TRIAL BASIS BY CONSTRUCTING TEMPORARY BARRICADES ACROSS JEFFERSON STREET AT APPROXIMATELY THE EXTENSION OF THE SOUTHERLY RIGHT OF WAY LINE OF S.W. 28 STREET, SUBJECT TO CITY COMMISSION REVIEW AND PROVISIONS CONTAINED WITHIN THIS RESOLUTION. WHEREAS, Leonard A. Ralby and Ralby-Allen Real Estate Partnership, hereinafter referred to as PETITIONER, have requested permission from the City to restrict vehicular access to Jefferson Street at S.W. 28 Street; and WHEREAS, Section 84-17 of the Code of the City of Miami, Florida, gives the City Commission the power, after a properly advertised public hearing, to require that vehicular access to a particular street be prohibited at an intersection where such prohibition is found to be in the best interest of the public; and WHEREAS, the City Commission has requested that the Department of Public Works initiate the process to prohibit vehicular access to Jefferson Street at the southerly right of way line of S.W. 28 Street; and WHEREAS, the Police Department, Fire, Rescue & Inspection Servloe Department and Solid Waste Department have made recommendations on the proposed prohibition of vehicular access and have expressed no objections; and WHEREAS, pursuant to due public notice, a public hearing was held before the City Commission on May 28, 1987, as to any objections to the prohibition of vehicular access to Jefferson Street at S.W. 28 Street and no objections were sustained by the Commission; and WHEREAS, the City Commission finds that the herein prohibition should be instituted for a six (6) month trial period to determine if said prohibition is in the best interest of the public; CITX q)MMISSION j MEETING OE 4 MAY ?,R 198*1 ESOLUTtON No. � ' - tEMMKS: 0 i NOW, THEREFORE, HE IT RESOLVED BY THE COMMISSION OF THB CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings set forth in the preamble to this resolution are hereby incorporated by reference and adopted. Section 2. The PETITIONER is hereby granted permission, subject to the following provisions of this resolution, to construct and maintain for a six (6) month trial period, temporary barricades across Jefferson Street at approximately the extension of the southerly right of way line of S.W. 28 Street. Section 3. Said barricades shall prevent vehicular access, but not restrict pedestrian access, and shall be constructed according to plans prepared and sealed by a registered professional engineer and subject to the approval of the City of Miami Department of Publio Works. Section 4. Said PETITIONER shall prepare and obtain approval from Metropolitan Dade County Public Works Department, Traffic Division, of a traffio signage and/or traffio striping plan for the area affected by the herein traffio prohibition. Section B. If said PETITIONER fails to properly maintain said barricades, signs and striping, or if the barricades for any reason become a hazard to the health, welfare and safety of the general public as determined by the Director of Public Works, the City may immediately remove or require the PETITIONER to immediately remove the barricades, signs and/or striping. Section 6. Said PETITIONER shall provide the City with a performance bond acceptable to the City in the amount of five hundred dollars to insure that the barricades, signs and striping are removed, if so ordered by the City, and the publio right of way restored to the oondition that existed prior to the construction of the barricades. Section 9. The six (6) month trial period shall begin after construction of the barricades has been accepted by the City's Public Yorks Department, and after all required traffio signage and striping has been installed and has been officially aooepted, in writing, by the Dade County Publio Works Department. - 2 Section 8. On the date ending the fifth month of the sic (6) month trial period, said PETITIONER shall send certified letters to all property owners, as shown on the records of the Dade County Tax Collector, in the area bounded by S.W. 27 Avenue, Bird Road, Swanson Avenue, S.W. 23 Avenue and S. Dixie Highway, soliciting their approval or disapproval for construction of permanent barricades. The property owners shall respond directly to the City's Publio Works Department utilizing postage paid postcards supplied by PETITIONER and included with the certified letters. Property owner response will be evaluated by City staff and the herein vehicular access prohibition shall be made permanent only upon approval of the City Commission by resolution. Section 9. All costs for construction of the temporary barricades, signs, striping and any related incidental expenses shall be borne by said PETITIONER. Seotion 10. Vehicular access should not be restricted to Jefferson Street at S.W. 28 Street until a traffic study of the area is completed and a master plan is adopted for alleviating traffic intrusion into the single• family neighborhood east of S.W. 27 Avenue between Tigertail Avenue and South Dixie Highway. BACKGROUND: On March 31, 1987 the City Commission passed on first reading an ordinance amending the Miami Comprehensive Neighborhood Plan and the Zoning Ordinance by changing the zoning classification of a proximately 2606 through 2630 S.W. 28 Street from RS-2/2 to RO- 1/p4 with the SPI-3 Overlay District. One of the conditions of the first reading approval was that the second reading of this ordinance would be brought back to the Commission at the same time as a resolution for prohibiting vehicular access to Jefferson Street at S.W. 28 Street. The main purpose of prohibiting vehicular access to Jefferson Street at S.W. 28 Street is to prevent traffic generated by office, commercial and other higher density development from using Jefferson Street, which is in a single family residential neighborhood. Pedestrian traffic would not be restricted. Section 54-17 of the City Code gives the City Commission the power, after a properly advertised public hearing, to require that vehicular access to a particular street be prohibited at an intersection where such prohibition is found to be in -the best interest of the public. . - Section 54-17 also requires the Department of Public Works to initiate the process of prohibiting vehicular access on a street and to present a traffic study at the public hearing if it.is necessary. 87"'"'51F; x e ' rn At the April 30, 1987 City Commission meeting, the Commission authorized the City Manager to execute a contract for $65,000 with Transport Analysis Professionals Inc. to perform a traffic study in Coconut Grove. One of the major components of the study, is traffic intrusion in the single family residential neighborhoods. The City plans to make the first priority of the study the S.W. 27 -Avenue corridor and traffic intrusion in the adjacent single family residential areas. This portion of the study is anticipated to be accomplished in a couple of months. Prohibiting vehicular access to streets at designated intersectio.ns to reduce traffic intrusion into single family residential neighborhoods can become a divisive issue with the property owners. This issue has been raised in the Belle Meade, Morningside, Bay Heights and Natoma Manor neighborhoods and it was very divisive in all but the Belle Meade area. Section 54-17 of the City Code also requires that recommendations be made by the Police Department, Fire, Rescue and Inspection Services Department and Solid Waste Department. Memos from each of these departments are attached. There was some discussion at the March 31, 1987 City Commission meeting concerning prohibiting vehicular access on S.W. 28 Street at the east side of S.W. 26 Avenue. The department's memos also address this location. Two resolutions have been prepared for prohibiting vehicular access to Jefferson Street at S.W. 28 Street. One resolution prohibits vehicular access on a 90-day trial basis by constructing temporary barricades across Jefferson Street at approximately the extension of the southerly right of way line of S.W. 28 Street. This method was used in the Belle Meade neighborhood and allows for public response based on a temporary installation. This process is recommended by the Department of Public Works. The second resolution prohibits vehicular access on a permanent basis by constructing immovable landscaped barriers instead of temporary barricades. This method provides a "final" solution concerning the prohibition of vehicular access to Jefferson Street at S.W. 28 Street before the second reading of the ordinance amending the Miami Comprehensive Plan and the Zoning Ordinance by changing the zoning classification of approximately 2606 through 2630 S.W. 28 Street. If the City Commission approves the resolution prohibiting vehicular access to Jefferson Street at S.W. 28 Street on a 90- day trial basis, the following will be accomplished by the Applicant for the previously'mentioned zoning change: WwSI,19 SI, e 1. Install temporary barricades across Jefferson Street at S.W. 28 Street. 2. Install traffic signage and striping in conjunction with the. barricades. . 3. Provide a $500 performance bond to assure removal of the barricades and traffic signs and striping if required. 4. Send certified letters 60 days after the installation of the temporary barricades to property owners in the area bounded by S.W., 27 Avenue, 'Bird Road, Swanson Avenue, S.W. 23 Avenue and S. Dixie Highway. The letters will include postage paid postcards addressed to the Department of Public Works for a property owner poll. 5. Bear all costs for installation of temporary barricades, traffic signs and traffic striping, mailing letters to property owners and any related expenses. If the resolution utilizing a 90-day trial basis is approved, permanent prohibition of vehicular access on Jefferson Street at S.W. 28 Street will require another resolution by- the City Commission after the property owner response to the temporary prohibition of vehicular access has been evaluated. If the* City Commission approves the resolution prohibiting vehicular access on a permanent basis by constructing immovable landscaped barriers instead of temporary barricades, the following will be accomplished by the applicant for the previously mentioned zoning change: 1. Construct immovable landscaped barriers across Jefferson Street at S.W. 28 Street. 2. Install traffic signage and striping in conjunction with the barricades. 3. Construct a "T" type vehicular turning area on Jefferson Street. 4. The Miami klice Department is generally opposed to closing public roadways. The current proposal to close Jefferson Avenue on the"Southside of S.W. 28th Street would delay the response time of police units responding to a call for service in the area. Furthermore, a street that is not readily accessible will not have high police visibility. If the decision is made to close the street, then I will notify my personnel to make the appropriate changes so that the Miami Police Department can best service the area in question. W. 28 Street must remain open. It is recomeended that vehicular traffic be curtailed on a trial basis at S. W. 28 Street and Jefferson Street.
