A RESOLUTION RATIFYING, APPROVING AND
CONFIRMING, BY A 4/5THS AFFIRMATIVE VOTE OF
THE MEMBERS OF THE CITY COMMISSION, THE
ACTION OF THE CITY MANAGER IN MAKING
FINDINGS THAT AN EMERGENCY NEED EXISTED IN
APPROVING THE EXTENSION OF A PURCHASE ORDER
FOR THE PROVISION OF EMERGENCY CUSTODIAL
SERVICES ON AN INTERIM BASIS AT THE POLICE
ADMINISTRATION BUILDING TO HOWARD'S
PROFESSIONAL SERVICES IN THE AMOUNT OF
$15,639.60; FURTHER ALLOCATING SAID TOTAL
AMOUNT FROM THE DEPARTMENT OF GENERAL
SERVICES ADMINISTRATION 1986-87 OPERATING
BUDGET ACCOUNT NO. 421001-340.
WHEREAS, by Resolution No. 85-257 of March 21, 1985,
the Commission approved Custodial Services at the Miami Police
Department Building and awarded to Miami International Lawn &
Janitorial Services the contract for one year; and
WHEREAS, said firm's performance of services became so
poor that the building was left in an unclean and unsanitary
condition thereby causing the firm's contract to be terminated by
the City; and
WHEREAS, emergency arrangements were made with Howard's
Professional Services to provide emergency interim custodial
services to the Police Administration Building based upon a
recommendation made to the City Manager that such services were
necessary on an emergency basis as a result of the termination of
the City's contract with the previous vendor; and
WHEREAS, the development of a new procurement
contract' had been delayed which resulted in a month to month
extension of the interim services until a new contract for
services could be properly presented to the City Commission for
its consideration following a competitive bid process which
presentation is being made to the City Commission this date; and
WHEREAS, funds for these past services have been
appropriated in the General Services Administration 1986-87
Operating Budget Account No. 421001-340; and

WHEREAS, the previous vendor's termination and the
interim vendor's emergency procurement have been aproved and
adopted as the findings of the Chief Procurement Officer and of
the City Manager;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE
CITY OF MIAMI, FLORIDA%
Section I. By an affirmative vote of four fifths
(4/5ths) of the Members of the City Commission, the City
Manager's written finding, that the extension of the Purchase
Order for the provision of emergency interim custodial services
at the Police Administration Building for Howard's Professional
Services in the amount of $15,639.60 is hereby ratified, approved
and confirmed.
Section 2. The said amount of $15,639.60 is hereby
allocated from the Department of General Services Administration
1986-87 Operating Budget Account No. 421001-340.

RECOMMENDATION:
It is respectfully recommended that the City Commission adopt the
attached resolution ratifying, approving and confirming the
extension of a Purchase Order for the provision of emergency
custodial services on an interim basis at the Police
Administration Building, to Howard's Professional Services, a
Black vendor, as an emergency action of the City Manager. runds
in the amount of $15,639.60 are available from the 42'001-340
account, Contractual Services, Property Maintenance Division
operating budget of the General Services Administration
Department, for this activity.
BACKGROUND:
The General Services Administration Department made arrangements
for Howard's Professional Services to provide emergency interim
custodial services to the Police Administration Building. A
recommendation was made to the City Manager that such services
were necessary on an emergency basis as a result of the
termination of the contract of a previous vendor because of
unsatisfactory services. The development of a contract with a
new vendor had been delayed, which resulted in month to month
extension of the interim services. A new contract for services
is being presented to the City Commission at the June 11, 198T
meeting, for an effective start date of July 12. In the interim,
custodial services were urgently needed at the Police building.
For this reason, the City Manager determined emergency extension
of the Purchase Order to be an appropriate action.

EMERGENCY REQUEST
Your emergency approval is respectfully requested to award an
extension of the custodial services being provided to the Police
Department. The award of this extension will bring to $15,639.60
the amount expended for these services which are above the amount
previously approved.
BACKGROUND .
The General Services Administration Department has reviewed bids
to provide custodial services to the Police Department building
commencing July 12, 1987, that bid award has been submitted as a
companion item to this item on the June 11, 1987 City Commission
agenda. However, extension of the current month to month
agreement for provision of services until the award of the new
contract and the required start-up time for the new vendor, is
necessary to provide uninterrupted service to the building.
Originally, Miami International Lawn & Janitorial Service was
awarded the custodial contract at the Miami Police Department
Building at 400 N.W. 2nd Street. Their services became so bad,
and the building became so unclean and unsanitary, their contract
was terminated.
A Black minority contractor, Howard's Professional Services, who
was the next lowest bidder was issued a Purchase Order for two
(2) months on an emergency basis. They were also authorized to
bring in crews on a 24 hour basis in order to bring the
building's cleanliness up to standard. Their performance was
excellent; and very pleasing to the Police Department.
On October 29, 1986, bids were awarded for new custodial
contracts at city buildings with the exception of City Hall and
Miami Police Department. Due to the unique physical and security
requirements of both facilities, General Services Administration
was directed to develop "Professional Services" contracts with
the then current providers, both Black minority vendors.

Subsequently, the City Attorney advised that according to the
City Code, custodial services could not be classified as
"Professional Services", and the service would have to be bid.
New bids were advertised, and a new custodial contract for the
Miami Police Department building will be scheduled for the June
11th Commission Meeting.
In order to maintain services, it was rPeessary to extend the
Purchase Order with Howard's Professional Services on a month to
month basis, through July 11, 1987, because the contractor
recommended Cor award of the new contract requires 30 days start-
up time.
The total purchase order to Howard's Professional Services is
$159639.60 above the amount originally awarded to Miami
International of $1139988.
Your approval of this increased expenditure on an emergency basis
is requested, with City Commission ratification at the June 11th
City Commission meeting.
Funds for this purpose are available in the 421001-340 account.
