HomeMy WebLinkAboutR-87-0691a J-87-476 7/6/87 RESOLUTION NO. A RESOLUTION AUTHORIZING THE CITY ATTORNEY TO APPEAL THE RULING OF THE U.S. DISTRICT COURT, SOUTHERN DISTRICT OF FLORIDA. WHICH IS ADVERSE TO THE CITY IN THE CASE OF MIKELE CARTER V. CITY OF MIAMI, CASE NO. 84-1716- CIV-ZLOCH; FURTHER AUTHORIZING THE CITY ATTORNEY TO ENGAGE THE SERVICES OF ARTHUR ENGLAND, ESQUIRE OF THE LAW FIRM OF FINE, JACOBSON, SCHWARTZ, NASH. BLOCK AND ENGLAND, P.A., IN CONNECTION WITH SAID APPEAL, THE EXPENDITURE OF FUNDS THEREFOR BEING AUTHORIZED FROM THE SELF-INSURANCE AND INSURANCE TRUST FUND IN THE AMOUNTS SET FORTH IN THE ATTACHED CITY ATTORNEY'S MEMORANDUM. WHEREAS, the City Attorney, by memoranda to the City Commission has furnished all necessary factual information in regard to the pending litigation which is the subject of this Resolution, including the amount of fees payable hereunder; and WHEREAS, on May 28, 1987 the City Commission deferred action until this time; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The City Attorney is hereby authorized to appeal the ruling of the U.S. District Court, Southern District of Florida, which is adverse to the City in the case of Mikele Carter v. City of Miami, Case No. 84-1716-Civ-Zloch. Section 2. The City Attorney is hereby further authorized to engage the services of Arthur England, Esquire of the law firm of Fine, Jacobson, Schwartz, Nash, Block and England, P.A., in connection with said appeal, the expenditure of funds therefor being hereby authorized from the Self -Insurance and Insurance Trust Fund in the amounts set forth in the attached City Attorney's memorandum.
