A RESOLUTION CONCERNING rHE DINNER KEY
ANCHORAGE ASSOCIATION, INC. AND ALL VESSELS
ANCHORING IN THE AREA KNOWN AS THE "DINNER KEY
ANCHORAGE", ACCEPTING THE CITY MANAGER'S
PROPOSAL THAT ALL OWNERS BE REQUIRED TO PAY A
FEE OF TEN CENTS (100) PER FOOT OF VESSEL
LENGTH FOR CITY SERVICES AND FACILITIES
INCLUDING DINGHY DOCKAGE, SHOWERS, LAUNDRY
FACILITIES, VEHICLE PARKING AND GARBAGE
PICKUP; AUTHORIZING THE CITY MANAGER TO
IMPLEMENT SAID PROGRAM FOR A SIX-MONTH TRIAL
PERIOD; PROVIDING THAT ANY VESSEL OWNER WHO
FAILS TO PAY SAID FEES SHALL NOT BE PERMITTED
ACCESS TO OR USE OF SAID CITY SERVICES AND
FACILITIES AND HIS/HER VESSEL SHALL BE NOT
CONSIDERED AS LAWFULLY PLACED; FURTHER
DIRECTING THAT THE NECESSARY STEPS BE TAKEN TO
HAVE THE AREA DECLARED A LEGAL ANCHORAGE.
BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI,
FLORIDA:
Section 1. The City Manager's proposal is hereby accepted
concerning the Dinner Key Anchorage Association, Inc. and all
vessels anchoring in the area known as the "Dinner Key
Anchorage", whereby it is provided that all. such vessel owners be
required to pay a fee of ten cents (10�) per foot of vessel
length for City services and facilities including dinghy dockage,
showers, laundry facilities, vehicle parking, and garbage pick
up.
Section 2. The City Manager is hereby authc)r.i7t?l t�
implement said program for. the "Dinner Key Anchorage" for s six
month trial period.
Section 3. Said acceptance and authorization is hereby
subject to the provision that any vessel owner who fails to pay
said fees shall not be permitted access to or use of said City
services and facilities and his/her vessel shall not be
considered lawfully placed.

Section 4. The City Attorney is hereby directed to take the
necessary steps to have said area declared a legal anchorage by
the Florida Department of Transportation and/or other affected
government entities.

request that the following enclosed proposal be placed on the
Agenda of the City Commission for May 28, 1987. We thank you

The members of The Dinner Key Anchorage Association,
working in concert with The City of Miami Marina staff, the
City Attorney, and other marina and waterfront interests,
have developed the enclosed proposal. We have included, for
future consideration, drawings and suggestions for additional
progress as needs and funding dictate.
T1+=s proposal does require some explanation as to the
genesis and development of the multifaceted approach. The
basis for the recomendations are a three -pronged solution
addressing (1) The Marina user and user fee, (2) The south
channel and availability for all users, and (3) an
. alternative for the boaters displaced by the recent Houseboat
Ordinance. We have included a contract for services that we
feel adequately and correctly covers all parties (City
Attorney Suarez -Rivas has expressed approval).The wording of
the enclosed contract has been taken directly from a
"Municipal Marina Service Fee Agreement" proposed by the
Office of Marina Development. Also included iy an
interesting and not unrealistic proposal for future
development of_a self-supporting, cost effective, shoreside

service center for cruising sailors and visitors alike.
The emphasis in each facet of this program is cost
effectiveness and the actual availability of the services
required. The original plan discussed by the Marina
Development Specialist would be costly, both in fixed
expenses and in labor -benefit costs. The plan unnecessarily

placed an unmanageable burden on Marina facilities and staff
at the expense, in services, to Marina residents. In
contrast, the enclosed program will eliminate or minimize the
cost of Implementation, the negative impact on Marina and
Anchorage residents, and maximize use of existing facilities
without the need for additional staff or boating equipment.
Simplicity is the key element - controlled availability
of shoreside services that now exist, with minimum
improvement/expansion as needs increase, are all that is
required. If a free and legal anchorage is declared, by
ordinance, and services made available for a contracted fee,
those needing the services may acquire them. This would open
the way for accommodating the cruising boater and solve the
"liveaboard" problem.
In support of this request, the Dinner Key Anchorage
Association is aware of negative side-effacts and has taken
steps to address them. The most frequently mentioned problem
is the establishment, or more correctly re-establishment, of
a "South Channel". The Dinner Key Anchorage Association is
currently meeting with the Coconut Grove Sailing Club, Mr.
Frank Albritton of Castle Harbour, and other interested
parties in order to properly establish and mark a privately
maintained channel at no cost to the City. The second most
mentioned problem, that of derelict vessels and/or trash on
the spoil islands, deeply distresses this organization. We
are aware of the difficulty in removing this debris and the

lack of funds on the part o4 City and State agencies. In

that regard, we have engaged in an organized daily clean-up
campaign and have dismantled or removed several vessels and
will continue to lend our efforts toward this ongoing
problem.
Included in this package is an artist's rendering of a
proposed, future reception center/dinghy dock submitted by a
Dinner Key Anchorage Association member. This facility would
utilize coin -operated technology ra*ler than traditional
manpower.
We wish to thank you for your consideration of this
proposal and offer our organization to respond to any
question or assist in you any way.

CITY SERVICE AGREEMENT
THIS AGREEMENT, made and entered into at Miamio Dade

hereinafter ref erred to as the "City", and the undersigned

IT IS AGREED AS FOLLOWS:
1. The City operates and maintains facilities for the
provision of dinghy dockage, fresh. water, garbage pick-up,
shower and laundry, and parking for automobiles for the use
of yacht and/or boat owners in the area commonly known as
"the anchorage".
2. The owner agrees to pay the City monthly service
fees for the use of said facilities. The owner agrees that
said service fees shall be based upon a thirty day montho
shall be due and payable on the first day of the month, and
shall be considered delinquent if not paid by the tenth of
the month. Such fees shall be established in compliance with
City ordinances and set forth in a schedule available from
the City Marina Director's Office, as such ordinance and
schedule may be amended from time to time. Delinquent
accounts shall be subject to the statutory interest rate
prescribed by Florida Statutes and to an automatic and
progressive 5% (five per cent) delinquency charge. Fees to
be charged in 1987 are $30.00 (thirty dollars) per month per
vessel and are subject to change from time to time by
applicable amendments to the fee schedule set forth under
City code. /

The owner agrees that the City shall provide identifying
decals, which shall be displayed upon all dinghies of the
vessel, and upon all automobiles owned by the Owner of the
vessel which are parked within the Dinner Key Marina parking
lot. Failure to display the required identifying decal shall
constitute a default under this agreement. 'he owner shall
comply with all Rules and Regulations of the Dinner Key
Marina at any time the owner or vessel makes use of the
facilities of the Marina.
The City agrees that it wi 1Z provide the following
services:
a) A lighted dinghy tender landing dock within the
Dinner Key Marina.
b) Facilities for garbage disposal in a location
accessible to the dinghy landing dock.
c) Facilities for the provision of fresh water for the
use of the vessel.
d) Shower keys for access to the Dinner Key Marina
shower facilities.
e) Laundry facilities with coin —operated laundry
machines.
f) Parking decals and dinghy decals.
The above listed services may be withheld from any vessel
owner who is in default under this agreement.
3. This agreement is effective commencing
_w„___, 19__, and shal 1 , unless termi mated by other
provisions contained herein, continue for a period of one
year. In the event of an emergency situation in which there
is a threat to life or property, or in the event there exists
a hazard to navigation created by the vessel, the Owner 'or
agent will move the vessel upon request.
4. This agreement may be terminated upon any of the
following conditions:
a) by breach or forfeiture of any of the covenants or
provisions of this agreement.
b) by written notice of termination by the City,
delivered to the owner at least three days prior .to the
effective date of termination.
c) by written notice of termination to the City by the
owner upon departure of the vessel from the anchorage,
accompanied by payment of unpaid fees or charges, if any.
d) by a bonafide sale of the vessel describes in this
agreement.
e) by termination date specified herein:

director or his designee in writing of any change in the
information furnished in this agreement.

6. This agreement is for services only. The City shall
not be liable for the care, protection, or security of the
vessel, her appurtenances, or contents, or for any loss or
damage of any kind or nature to the vessel, whether due to
theft, fire, vandalism, collision, equipment failure,
windctirm, hurricane, rains or other casualties. There is no
warranty of any kind as to the condition of any dinghy
dockage area, piers, walks, gangways, ramps, or electrical or
water service, nor shall the City be responsible for injuries
to persons or property occurring upon Marina property for any
reason.
7. The Owner agrees to hold the City harmless and to
indemni+y the City for any loss, damage or liability imposed
by any acts or omissions on the part of thw Owner, his
agents, employees, or guests in the use of City facilities.
The indemnification provided herein shall include, but not be
limited to: all costs, expenses, and reasonable attorneys'
fees, incurred by the City in any action based on the
foregoing.
e. The Owner agrees to remove, or cause to be removes,
his vessel from the anchorage area before or immediately upon
issuance of hurricane warnings by the National Hurricane
Center. It shall be the Owner's responsibility to be aware
of such warnings.
9. The Owner agrees to comply with all State, Federal,
and Local laws pertaining to boating. The Owner shall not -
dos suffer or allow, either individually or in conjunction
with other persons:
a) any unlawful act, or
b) any act which may have the effect of disturbing the
peace, disturbing, inconveniencing, or subjecting to physical
jeopardy the Marina premises, other persons, or other vessels
docked or moored at the Marina or anchored or moored in the
anchorage, or
c) any act which will impede, disrupt or injure the
orderly.operation of the Marina.
10. Part ownership of a vessel does not in any way imply
an obligation on the part of the City to furnish services to
any of the "owners" other than the original signer of this
agreement. If this agreement is executed in any other than
an individual capacity (corporation, partnership, etc.) then
no dissolution or withdrawal of a partner shall operate to
release such party from any obligations hereunder. Each such
party shall nonetheless be bound by the terms and conditions
of this agreement and be obligated to the City' for the
payment of all sums due and the performance of all its
covenants, terms and conditions.
11. The Owner agrees to pay all costs and expenses
including reasonable attorney fees incurred by the City in
the collection of any unpaid sums due under this agreement,
or by reasan of Owner's default in the performance of any of
the covenants o4 this agreement.
12. In the event Owner shall be in default under this
agreement, the City shall have the right to pursue any remedy
provided by State or Federal laws, or any other applicable
County or City Code as the same may be from time to time
amended.
13. This agreement is binding upon the City, the Owner
and any authorized representative of either, together with
any other signatory and may only be modified in writing duly
execu`gd by all parties.

PROPOSED MIAMI MARINE WELCOME STATION
All yachts entering Florida on the Intracoastal Waterway
are greeted by the Florida Marine Welcome Station at
Fernandina Beach. A free glass of orange juice and a hot
shower greet the sailor with a hearty welcome. This proposal
suggests a Miami Marine Welcome Station that would say to the
visiting yachtsman, "Welcome to Miami!"
. A Miami Hari ne Welcome Station could provide the
following functions:
1. An information center that would direct
boating tourists to needed services and
facilities, i.e. restaurants, repair
services, marine stores, entertainment,
public transportation, shopping centers, food
stores, etc.
2. A secure, lighted dinghy landing area
that would encourage yachtsman to visit
Miami.
S. Collection of fees for boat residents
using City (Marina) Facilities.
4. Coin operated laundry machines,
telephones, ice, map dispensing machines.
3. Connecting the Tourist and Chamber of
Commerce approach with the visiting
yachtsman.
Several years ago, the Bahamian goverment announced that
109000 visiting yachts cruised Bahamian waters each year.
These vessels consist largely of American or Canadian couples
or families able to vacation for several months aboard their
yachts. This proposal would, in affect, be attempting to
attract these tourists to the Miami area on their way to the
islands. Miami is a place ideally suited -for -Final
provisioning and last minute repairs as well as a wonderful
recreational area. It is also affords a convenient

Jumping-off location to both the Bahamas and the Carribbean.
The financial benefits to local merchants are obvious.
