Fj A RESOLUTION CONCERNING THE II ALLAPATTAH FAIR TO BE CONDUCTED BY THE ALLAPATTAH BUSINESS DEVELOPMENT AUTHORITY, INC., TO BE HELD DECEMBER 11-13, 1987 PROVIDING FOR THE CLOSURE OF DESIGNATED STREETS TO THROUGH VEHICULAR TRAFFIC AND ESTABLISHING A PEDESTRIAN MALL SUBJECT TO THE ISSUANCE OF PERMITS BY THE DEPARTMENTS OF POLICE AND FIRE, RESCUE AND INSPECTION SERVICES; AUTHORIZING A ONE -DAY PERMIT TO SELL BEER AND WINE IN CONNECTION WITH SAID EVENT SUBJECT TO THE ISSUANCE OF ALL PERMITS REQUIRED BY LAW; FURTHER ESTABLISHING AN AREA PROHIBITED TO RETAIL PEDDLERS DURING THE PERIOD OF THE EVENT; CONDITIONED UPON THE REQUIREMENT THAT THE CITY WILL BE INSURED AGAINST ANY POTENTIAL LIABILITY. WHEREAS, the Allapattah Business Development Authority, Inc. will conduct the II Allapattah Fair on December 11-13, 1987; and WHEREAS, on April 30, 1987 by Motion 87-386 the City Commission expressed its intent to approve the request of the organizer for authorization to close certain streets, to sell beer and wine during the event and to restrict non -festival peddlers; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. In order to effectuate safe passage and establish a temporary pedestrian mall during the II Allapattah Fair, the following streets are hereby closed to through vehicular traffic from 11:00 A.M. to 10:00 P.M. on Sunday, December 13, 1987 as specified below: N.W. 20 Street from N.W. 22nd Court to N.W. 25th Avenue Included in the herein closure are all streets, avenues, alleys, ways and thoroughfares which intersect the enumerated areas delineated in this Section. Section 2. Such closing of streets is subject to State approval and issuance of permits by the Departments of Police and Fire, Rescue and Inspection Services. Said permit from the Department of Police is to be issued upon the full approval of CITY COMMISSION MEETING OF JULIpp- :3 the Chief of Police after giving all due consideration to the safety and traffic needs of residents, businesses, and religious institutions in the area for entering and crossing through said arterials and upon the favorable exercise of the City Manager's judgement predicated upon all factors set forth herein. Section 3. Upon the issuance of a temporary permit by the Florida Department of Business Regulation, Division of Alcoholic Beverages and Tobacco, to sell beer and wine pursuant to City Code 54-12.1, the request of the Allapattah Economic Business Development Authority Inc. to sell beer and wine for a one -day period in connection with the II Allapattah Fair on Sunday, December 13, 1987, is hereby granted subject to the issuance of all permits required by law. Section 4. Pursuant to the provision of Ordinance No. 8851, enacted September 28, 1978, all retail peddlers' occupational licenses issued under the provisions of Chapter 31 of the City Code, as amended, will not be valid on December 13, 1987, during the hours of 11:00 A.M. to 10:00 P.M. on the above designated streets and on all intersecting streets for two blocks in all directions. Section 5. Such authorizations are hereby conditioned upon the organizers obtaining insurance requirements as mandated by the City of Miami. Odio City Manager 6P ENCLOSURES: RECOMMENDATION: J U N 3 0 1987 PILE: Resolution Street Closures for the II Allapattah Fair Commission Agenda Item July 9, 1987 It is respectfully recommended thus: the City Commission adopt the attached resolution authorizin, the closure of certain streets, establishing a pedestrian mall, a one -day permit to sell beer and wine and the restriction of retail peddlers in the area in connection with the II Allapattah Fair to be conducted by the Allapattah Business Development Authority, Inc. on Sunday, December 13, 1987. The street closures are subject to the issuance of permits by the Departments of Police and Fire, Rescue and Inspection Services. BACKGROUND: The Department of Community Development has prepared the appropriate legislation for the above mentioned authorizations for the II Allapattah Fair to be conducted by the Allapattah Business Development Authority, Inc. on December 11-13, 1987. A Street Fair will be conducted on Sunday, December 13, 1987 to end the three day Fair. On April 30, 1987, by Motion 87-386, the City Commission approved the request of the Allapattah Business Development Authority to close certain streets, restrict non -festival peddlers in the area and authorization to sell beer and wine during the street Fair to be conducted on Sunday, December 13, 1987.
