WHEREAS, the Miami Zoning Board, at its meeting of
May 18, 1987, Item No. 8, following an advertised hearing,
adopted Resolution No. ZB 64-87, by a seven to zero (7-0) vote,
RECOMMENDING APPROVAL of the official vacation and closure of
portions of streets as hereinafter set forth; and
WHEREAS, the City Commission finds that it is in the best
interest of the general welfare of the City of Miami and its
inhabitants to grant the vacation and closure of portions of
streets in question and deems it advisable to do so;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY
OF MIAMI, FLORIDA:
Section 1. That portion of Northeast Miami Court lying
north of the north right-of-way line of Northeast 58th Street and
south of the south right-of-way line of Northeast 59th Street;
that portion of Northeast Miami Place lying north of the north
right-of-way line of Northeast 58th Street and south of the south
right-of-way line of Northeast 59th Street, that portion of
Northeast 58th Street lying east of the east right-oE-waX line of

also described as Tracts A, B and C, are hereby closed, vacated,
abandoned and discontinued for public use, as shown on and all as
a condition of approval of Tentative Plat #1285, "TOUSSAINT
L'OUVERTURE SCHOOL LEMON CITY PARK SITE."
Section 2. The foregoing approval is subject to and
conditioned upon the receipt by City of the sum of $101,000 from
Dade County School Board for the use by the School Board of City
parks
and the
subsequent
payment to
the City
by the Dade
County
School
Board,
from time
to time,
of 60% of
the costs
of the
maintenance performed on those parks.

At its meeting of November 5, 1986 the Plat and
Street Committee approved the above tentative
plat subject to the following:
1. Public hearing for approval to close right-
of-way.
2. Show zoning reference.
3. Correct location sketch. - Shown adjoining
subdivisions.
4. Show owners name(s) and address(es).
S. Show Tract Division along Zoning district
lines.
6. Correct Surveyor's note
7. Show 25' radius NE 58 St. and NE Miami
Place.
8. Extensive water mains may be.reguired.
9. Shown dedications by note.
PLANNING DEPARTMENT APPROVAL IN ACCORD WITH THE CONDITIONS
e vacation and closure of portions of NE Miami
Court, NE Miami Place, NE 58th Terrace and NE
58th Street as described above, would not have
an adverse impact on the surrounding properties
since at present they only serve the abutting
properties that are all owned by the
Metropolitan Dade County School Board and the
City of Miami and they are not deemed necessary
for the overall public interest. The requested
vacation and closure of the above streets would
provide for a unified site needed for the
Toussaint L'Ouverture School facility.
Properties surrounding the school are adequately
served by adjacent public streets.
PUBLIC WORKS Approval. The Department concurs with the City
of Miami Plat and Street Committee's approval of
the vacation and closure of those streets,
subject to the satifaction of the required
conditions.
DADE COUNTY PUBLIC
WORKS No objections.
ZONING BOARD At its meeting of May 18, 1987, the Zoning Board
adopted Resolution ZB 64-87, by a 7 to 0 vote,
recommending approval of the above.
Two replies in favor and one objection were
received by mail. Eight proponents were present
at this meeting.
CITY COMMISSION At its meeting of June 25, 1987, the City
Commission deferred the above to its meeting of
July 25, 1987.

DETERMINING THE NECESSITY FOR- AND DIPECTING THE CCN1;u%,NATION OF
CERTAIN LANDS IN DADE COUNTY, FLORIDA FOR THE PURPOSE OF
CONSTRUCTING THEREON AN ELEMENTARY SCHOOL (STATE SCHOOL "Go')
WHEREAS, after due consideration and consultation it
has been found and determined that the construction of a new
elementary school in the Edison -Little River area of Dade County
is necessary due to the over -crowding of the elementary schools
serving this area; and
WHEREAS, due to the number of persons in the territory
intended to be, and which of necessity will be served by the said
above mentioned school, it has been found necessary and
determined to acquire additional lands for school buildings,
playgrounds, athletic field, and recreational facilities, as
hereinafter described;
NOW, THEREFORE, BE IT RESOLVED THAT:
(1) It is hereby determined and found necessary to
provide a new elementary school in that Edison -Little River area
of Dade County, located between N.E. Miami Place and N.E. 1st
Court from N.E. 59th Street to N.E. 57th Street.
(2) It is hereby determined and found necessary in
order to provide proper school buildings, playgrounds,
recreational and other facilities for the proper and adequate
maintenance of said new elementary school to acquire in fee
simple the following described lands situated in Dade County,
Florida, to wit:
Blocks 14, 15, and 16 of Dixie Highway Tract,
according to the Plat thereof as recorded in
Plat Book 5 at Page 24 of the Public Records
of Dade County, Florida.
(3) The Board has. surveyed and located the area of
construction of the said elementary school, which it intends in
good faith to construct.
(4) The board's attorneys be, and they are hereby
authorized and directed to institute and prosecute to conclusion
condemnation proceedings by which to acquire said last above
described lands with all convenient speed.
(5) The said attorneys be, and they' are hereby
authorized and directed to incur all necessary expenses by way of
surveys, appraisals, abstracts of title, and in acquiring of
other information necessary to institute and maintain said
condemnation proceedings.

MEETING WITH NEIGHBORING PROPERTY OWNERS
Dear Property Owner,
As you are probably aware, the Dade County School Board recently
completed the acquisition of properties adjacent to the present Lemon
City Park site for purposes of constructing a new elementary school,
Toussaint L' Ouverture Elementary. The Board is in the process of
replatting the site in preparation for construction. This process
entails the closure of some streets within the acquisition area.
A search of the Dade County Public Records indicates that you own
property within a 375' radius of the aforementioned site. In an attempt
to address any concerns you may have concerning this project and the
proposed street closures, a meeting has been scheduled for flay 7,
1987 at 7:30 p.m. to discuss the project with you. It will be held
at Edison Park Elementary, located at 500 NW 67th Street, in the
cafetorium.

November 5, 1986, approved the above tentative plat subject to
the following revisions being made to the tentative plat,
additional information being provided and/or variances being
granted. Please be advised that the processing of your
tentative plat cannot proceed until these conditions have been
satisfied.

1. State and local laws require the installation of various

2. The alteration, relocation or installation of utilities
such as storm and sanitary sewers, electric, telephone,
water, etc., caused by this plat will be at the property
owner's expense. Also, utility easements may be required
on the property being platted.
3. A building permit will not be issued on the property being
platted until the final plat is recorded. Also, the
Certificate of Occupancy for any building con Truction will
be issued only after all the required subdivision
improvements have been completed.
4. Approval for fire flow requirements must be obtained from
the Fire, Rescue and Inspection Services Department prior
to the issuance of a building permit.
5. Additional items must be provided to the City of Miami
Department of Public Works before the final plat is
submitted to the City Commission for approval. You will be
notified in writing as to what these items are after the
amount of the bond has been determined for the necessary
subdivision improvements.
6. Tentative plat approval is only valid for one (1) year from
the date of the Plat and Street Committee Meeting at which
