A RESOLUTION RATIFYING, APPROVING AND
CONFIRMING, BY A 4/5THS AFFIRMATIVE VOTE OF
THE MEMBERS OF THE CITY COMMISSION, THE
ACTION OF THE CITY MANAGER THAT THE
REQUIREMENTS FOR FORMAL COMPETITIVE SEALED
BIDS BE WAIVED AND THAT THE EMERGENCY
PURCHASE OF AUDIO VISUAL EQUIPMENT FROM GRAY
COMMUNICATIONS FOR THE POLICE DEPARTMENT IN
THE PROPOSED AMOUNT OF $17,592.00 BE
APPROVEDI USING FUNDS APPROPRIATED BY
ORDINANCE NO. 10249 FROM THE OFFICER STRESS
AND AWARENESS AND CRISIS INTERVENTION PROGRAM
REGION XIV FY'86-87 STATE OF FLORIDA LAW
ENFORCEMENT TRUST FUND.
WHEREAS, the State of Florida offered the City of Miami a
grant for the purchase of audio-visual equipment from the Law
Enforcement Training Trust Fund to facilitate the provision of
specific training courses for police officers in Dade and Monroe
Counties; and
WHEREAS, Emergency Ordinance No. 10249 authorized the City
Manager to accept the grant, the proceeds of which shall be used
for the acquisition of the aforesaid audio-visual equipment to be
used for the previously approved Officer Stress Awareness and
Crisis Intervention Training Program Courses for Police Officers
in Region XIV FY '86-87 grant; and
WHEREAS, the audio-visual equipment will be utilized
exclusively for the provision of approved Region XIV Training
Courses and although Region XIV will maintain ownership said
equipment will be housed and stored at the City of Miami Police
Department's Training Unit; and
WHEREAS, due to the June 30, 1987 deadline and in order to
insure against the loss of funding provided by Region XIV the
Police Department requested an emergency approval to waive the
bidding process and purchase the necessary equipment from Gray
Communications in the proposed amount of $17,592.00; and
WHEREAS, funds for this purchase are available in the
Officer Stress and Awareness and Crisis Intervention Program
Region XIV FY'86-87 State of Florida Law Enforcement Trust Fund;
and

WHEREAS, the Director of the Police Department has
determined the validity of this emergency purchase and
recommended the waiver of formal sealed bids, and acceptance of
the purchase from Gray Communication in the proposed amount of
$17,592.00; and
WHEREAS, this determination has been approved and adopted as
the findings of the Chief Procurement Officer and of the City
Manager;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY
OF MIAMI, FLORIDA:
Section 1. By an affirmative vote of four fifths (4/5ths)
of the Members of the City Commission, the City Manager's written
finding, that the purchase of audio-visual equipment to be used
by the Police Department's Training Unit with funds provided by a
grant from the State of Florida and appropriated by Ordinance No.
10249 constitutes an emergency is hereby ratified.
Section 2. The requirements for formal sealed bids for the
procurement of this equipment is hereby waived, and the purchase
from Gray Communications at a cost of $17,592.00 is hereby
approved with funds appropriated by Ordinance No. 10249 Officers
Stress and Awareness and Crisis Intervention Program Region XIV
FY'86-87 State of Florida Law Enforcement Training Trust Fund.

RECOMMENDATION:
It is, respectfully recommended that a resolution ratifying,
approving and confirming, by a 4/5ths affirmative vote of the
Members of the City Commission, the action of the City Manager in
the waiver of bid requirements and the emergency purchase of
audio visual equipment from Gray Communications for the Police
Department in the amount of $17,592.00. Funds were appropriated
by Emergency Ordinance No 10249 from the "Officer Stress
Awareness and Crisis Intervention Program", Region XIV-FY'86-87,
State of Florida Law Enforcement Training Trust Fund.
BACKGROUND:
The Miami Police Department has prepared the legislation required
to ratify, approve and confirm by a 4/5ths affirmative vote of
the City Commission, the action of the City Manager in the waiver
of bid requirements for the emergency purchase of audio-visual
equipment. Emergency Ordinance No. 10249 authorizing the City
Manager to accept the grant from the State of Florida was
approved on April 9, 1987. Due to the June 30, 1987, deadline
and in order to insure against the loss of funding provided by
Region XIV, the Police Department is requesting emergency
approval to waive the bidding process and purchase the necessary
equipment from Gray Communications in the amount of $17,592.

AN EMERGENCY ORDINANCE ESTABLISHING A SPECIAL
REVENUE FUND ENTITLED: "OFFICER STRESS 'AND
AWARENESS AND CRISIS INTERVENTION PROGRAM,
REGION XIV FY IS6-87", APPROPRIATING FUNDS
FOR ITS OPERATION IN AN•AMOUNT NOT TO EXCEED
$17#608; AUTHORIZING THE CITY MANAGER TO
ACCEPT THE $17,608 GRANT AWARD FROM THE STATE
OF FLORIDA: CONTAINING A REPEALER PROVISION
AND SEVERABILITY CLAUSE.
WHEREAS, the State of Florida has offered the City of Miami a
$17,608.00 grant for the purchase of audio-visual equipment from
the Law Enforcement Training Trust Fund to facilitate the
provision of specific training courses for police officers in
Dade and Monroe Counties; and
WHEREAS, the audio-visual equipment will be utilized to
record, edit and critique the courses conducted in Officer Stress
and Awareness and Crisis Intervention; and
WHEREAS, the audio-visual equipment will be utilized
exclusively for the provision of approved Region XIV Training
Courses; and
WHEREAS, although Region XIV will maintain ownership, said
equipment will be housed and stored at the City of Miami Police
Department's Training Unit; and
WHEREAS, the audio-visual equipment will be made available
for use by other Region XIV Agencies on an as -needed basis;
NOW, THEREFORE, -BE IT ORDAINED BY THE COMMISSION OF THE CITY
OF MIAMI, FLORIDA:
Section 1. The following Special Revenue Fund is hereby
established and resources are hereby,,jappropriated as described
herein:
FUND TITLE: "Officer Stress and Awareness and Crisis
Intervention Program Region XIV FY186-87".
RESOURCES: State of Florida Law Enforcement Training
Trust Fund $170608.
APPROPRIATIONS: Audio -Visual Equipment Total: $17,608.

Section 2. The City Manager is hereby authorized to accept
the grant as set forth in preamble to this ordinance and to enter
into the necessary contract(s) and/or agreement(s) for the
acceptance of said grant, the proceeds of which shall be used for
acquisition of the aforesaid audio-visual equipment to be used
for the previously approved Officer Stress Awareness and Crisis
Intervention Training Program Courses for Police Officers in
Region XiV PY 196-97 grant.
Section 3. All ordinance or parts of ordinances in conflict
herewith, insofar as they are in conflict, are hereby repealed.
Section 4. If any section# part of section, paragraph,
clause, phrase, or word of this ordinance is declared invalid the
remaining provisions of this ordinance shall not be affected.
Section S. This ordinance is hereby declared to be an
emergency measure on the grounds of urgent public need for the
preservation of peace, health, safety, and property of the City
of Miami and upon the necessary payments to its employees and
officers, payment of its debts, necessary and required purchases
of goods and supplies, and to generally carry on the functions
and duties of municipal affairs. ,
Section 6. The requirement of reading this ordinance on two
separate days is hereby dispensed with by a vote of not less than
four -fifths of the members of the Commission.
