AN ORDINANCE RELATING TO FUTURE CONSTRUCTION CONTRACTS AFFECTING THE CITY OF MIAMI; PROVIDING THAT ALL PUBLIC CONTRACTS SHALL REQUIRE THE USE OF LOCAL RESIDENTS AS NEW OR REPLACEMENT LABORERS, MECHANICS OR APPRENTICES; REQUIRING POSTING OF NOTICE OF COMPLIANCE WITH THIS ORDINANCE; PROVIDING; EXCEPTIONS WHEN SUCH LOCAL RESIDENTS ARE NOT AVAILABLE, OR ARE INCAPABLE OF PERFORMING THE PARTICULAR TYPE OF WORK INVOLVED; CONTAINING A REPEALER PROVISION AND A SEVERABILITY CLAUSE; PROVIDING FOR INCLUSION IN THE CITY CODE. BE IT ORDAINED BY THE, COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. In all contracts let by the City of Miami which are funded in whole or in part with City funds or funds which the City expends or administers in accordance with the terms of a grant or otherwise, for the erection, construction, alteration, demolition, or repair of any public building or any other kind of public work or improvement within the geographical limits of. the City of Miami, the contractor and/or subcontractor shall employ, subsequent to the execution of such contract as new or replacement employees of said contractor and/or subcontractor, only bona -fide residents of the City of Miami as laborers, mechanics or apprentices. In the event City of Miami residents are not available or are incapable of performing the work involved, the contractor and/or subcontractor shall then employ bona -fide Dade County residents as laborers, mechanics or apprentices. Section 2. "Local Residents" Defined. A person is deemed to be a local resident if he or she is a resident of the City of Miami or Dade County. .Section 3. Notice Requirement. On the date work commences on a City of Miami public works construction project to which this Ordinance applies, the contractor or subcontractor shall be required to post a notice in a prominent place at the work site stating the fact of compliance with this Ordinance. Section 4. Exemption. The provisions of. this Ordinance shall not apply to any existing contract or construction project in which a Notice for Bids or Request For. Proposals has been advertised in the public media prior to the effective date of this Ordinance. The requirements of this Ordinance shall not apply if City of Miami or Dade County residents are not available, or are incapable of performing the particular type of work involved, if so determined by the City Manager.. Section 5. All ordinances, or parts of ordinances insofar as they are inconsistent or in conflict with the provisions of this Ordinance are hereby repealed. Section 6. If any section, part of section, paragraph, clause, phrase or word of this Ordinance is declared invalid, the remaining provisions of this Ordinance shall not be affected. This Ordinance shall be operative and the provisions thereof, unless otherwise indicated, shall become effective in accordance with City Charter provisions. Section 7. It is the intention of the City Commission that the provisions of this Ordinance shall become and be made a part of the Code of the City of Miami, Florida, as amended, which provisions may be renumbered or relettered and the word "Ordinance" may be changed to "section", "article", or other appropriate word to accomplish such intentions; further the provisions of this Ordinance shall be interpreted in pari materia with the provisions of Ordinance Number 10032.
