A RESOLUTION ESTABLISHING NOVEMBER 12t 1987 OR A RECONVENED MEETING, AS THE DATE POR A PUBLIC HEARING CONSIDERING ISSUANCE OF A 0MLOPMENT ORDER FOR THE DOWNTOWN MIAMI DEVELOPMENT OF REGIONAL IMPACT, ENCOMPASSING AN AREA OF THE CITY OF MIAMI UNbER THE JURISDICTION OF THE MIAMI DOWNTOWN DEVELOPMENT AUTHORITY, WITH THE EXCEPTION OF THE SOUTHEAST OVERTOWN/PARK WEST REDEVELOPMENT AREA, AS PROPOSED BY THE APPLICANT, THE DOWNTOWN DEVELOPMENT AUTHORITY OF THE CITY OF MIAMI, PLORIDA; AND DIRECTING THE CITY CLERK TO NOTIFY APPROPRIATE AGENCIES. WHEREAS, Chapter 380.06 Florida Statutes, "Florida Land and Water Management Act," requires local government to establish a certain date, and give public notice, for a local public hearing on an Application for Development Approval for a Development of Regional Impact prior to issuing a Development Order; and WHEREAS, by letter of August 14, 1987, the South Florida Regional Planning Council has notified the City of Miami that the Application for Development Approval contains sufficient information for their review and that a local public hearing could be scheduled for the Downtown Miami Development of Regional Impact encompassing an area of the City of Miami under the jurisdiction of the Miami Downtown Development Authority, with the exception of Southeast Overtown/Park West redevelopment area; and WHEREAS, Chapter 380.06 Florida Statutes requires local government to set a public hearing date at its next scheduled meeting after the receipt of such a letter and to give at least sixty (60) days notice of the hearing. NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. A public hearing shall be held at 3:30 P.M., Thursday, November 26, 1987, or at a reconvened meeting, in City Commission Chambers, 3500 Pan American Drive, Miami, Florida, 33133, concerning issuance of a Development Order for the Downtown Miami Development of Regional Impact, CITY COMMISSION X[EETING OF SEP 8 1987 ESowTION Wo. 8 7 -7CS• {EMIARKS: #—, area of the City of Miami under the 3urisdidtion of the Miami bowhtown Development Authority with the exdeption of the Southeast Ovettown/Park West redevelopment area# as proposed by the applicant# the Downtown Development Authority of the City of Miami# Florida. section 2. Agenda Item4i ty Commission Meeting September 8, 1987 RECOMMENDATION ?; It is respectfully requested that the Commission establish November 12, 1987 or an alternate date, as the date of the Development of Regional Impact public t' hearing for the Downtown Miami Development of Regional Impact Development Order, and directing the City Clerk to send this resolution to affected agencies, per the attached resolution. BACKGROUND The Planning Department in cooperation with the Downtown Development Authority and consultants, have prepared an Application for Development approval for Downtown Miami as an area -wide Development of Regional Impact. Per Chapter 380.06 F.S., local government is required to set a date certain and to give public notice 60 days in advance of a required public hearing on an Application for Development Approval for a Development of Regional Impact, prior to issuing a Development Order. By letter of August 14, 1987 (attached) the South Florida Regional Planning Council has stated that Application for Development Approval for the Downtown Miami Development of Regional Impact contained sufficient information for their review and would be tentatively scheduled on the Council agenda of October 5, 1987. Further, the letter stated that the Local Development of Regional Impact public hearing must be set at the next scheduled meeting of the Commission and advertised at least 60 days in advance of the hearing, per Chapter 380.06 F.S. It is requested that the Commission establish November 12, 1987, or an alternate date as the Development of Regional Impact public hearing date for consideration of the Downtown Miami Development of Regional Impact Development Order, which would allow for the required 60 day public notice. The hearing must be advertised at least sixty (60) days in advance of the hearing. The hearing notice must specify that the information and reports on the DRI Application may be revieved at the Council and/or City of Miami offices. The lav also requires that the notice of public hearing be transmitted to the Division of Resource Management, Florida Department of Community Affairs, and the South Florida Regional Planning Council. Receipt of that notice vill officially commence our fifty -day review period. At this time, the South Floria Regional Planning Council draft report and recommendations are tentatively scheduled to be presented for official action at the regular Council meeting in October, 1987. We are on a schedule to complete the staff Draft Impact Assessment Report and Recommendations by the end of August and plan to meet vith City staff in early September for reviev of this draft report.
