A RESOLUTION APPROVING THE INSTALLATION OF
DRIVE-IN FACILITIES FOR THE CREDITBANKr A
FINANCIAL INSTITUTION, LOCATED AT 2800
BISCAYNE BOULEVARD, FOR ITS PROPERTY LOCATED
AT 253 NORTHEAST 28TH STREET AND 254
NORTHEAST 29TH STREET, MIAMI, FLORIDA, MORE
PARTICULARLY DESCRIBED HEREIN, AS PER PLANS
ON FILE, SUBJECT TO THE TELLER STRUCTURE, AS
INDICATED ON THE PLANS, BEING MOVED 5 FEET TO
THE EAST, SUBJECT TO A FIVE FOOT LANDSCAPE
BUFFER TO BE APPROVED BY THE PLANNING
DEPARMENT, AND FURTHER SUBJECT TO CITY
COMMISSION REVIEW; ZONED CR-3/7 COMMERCIAL
RESIDENTIAL (GENERAL). THIS SPECIAL
EXCEPTION IS FILED IN CONJUNCTION WITH
SPECIAL EXCEPTION REQUEST FOR REDUCTION IN
THE NUMBER OF RESERVOIR SPACES FOR A DRIVE-IN
FACILITY ON ABOVE SITE AND HAS A TIME
LIMITATION OF TWELVE MONTHS IN WHICH A
BUILDING PERMIT MUST BE OBTAINED.
WHEREAS, the Creditbank, a financial institution, located at
2800 Biscayne Boulevard, Miami, Florida, desires to install
drive-in facilities in conjunction with its financial institution
for its property located at 253 Northeast 28th Street and 254
Northeast 29th Street, Miami, Florida, more particularly
described herein; and
WHEREAS, the City Commission has determined that it wishes
to review all applications for the installation of drive-in
facilities; and
WHEREAS, the Miami Zoning Board at its meeting of
July 6, 1987, Item 20 following an advertised meeting, adopted
Resolution ZB 82-87 by a nine to zero (9-0) vote granting the
Special Exception subject to the approval of the City Commission
as listed in Ordinance 9500, as amended, the Zoning Ordinance of
the City of Miami, Schedule of District Regulations, Page 4 of 6,
CR-3 Commercial Residential (General), and CR-1 Commercial
Residential, (Neighborhood), Principal Uses and Structures, to
permit a drive-in facility for a financial institution 1pcRt+ed.at

its property located
at 253 Northeast 28th Street and 254 Northeast 29th Street,
Miami, Florida, also described as Lot 190 BANKERS PARK, as
recorded in Plat Book 2 at Page 53, of the Public Records of Dade
County, Florida, as per plans on file, subject to the teller
structure, as indicated on the plans, being moved 5 feet to the
east, subject to a five foot landscape buffer to be approved by
the Planning Department, and further subject to City Commission
review; zoned CR-3/7 Commercial Residential (General). This
Special Exception is filed in conjunction with a special
exception for reduction in the number of reservoir spaces for a
drive-in facility and has a time limitation of twelve months in
which a building permit must be obtained;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY
OF MIAMIp FLORIDA:
Section 1. The decision of the Miami Zoning Board in
granting the Special Exception as listed in Ordinance 9500, as
amended, the Zoning Ordinance of the City of Miami*, Schedule of
District Regulations, Page 4 of 6, CR-3 Commercial Residential
(General), and CR-1 Commercial Residential, (Neighborhood),
Principal Uses and Strt,4!-Lures, to permit a drive-in facility for
a financial institution located at 2800 Biscayne Boulevard, for
its property located at 253 Northeast 28th Street and 254
Northeast 29th Street, Miami, Florida, also described as Lot 19#
BANKERS PARK, as recorded in Plat Book 2 at Page 53, of the
Public Records of Dade County, Florida, as per plans on file,
subject to the teller structure, as indicated on the plans, being
moved 5 feet to the east and subject to City Commission review;
zoned CR-3/7 Commercial Residential (General), is hereby
approved. This Special Exception is filed in conjunction with a
special exception for reduction in the number of reservoir spaces
for a drive-in facility; subject to a time limitation of twelve
months in which a building permit must be obtainedl
Section 2. This Resolution shall be operative upon its
adoption and the provisions thereof,, unless otherwise indicated
herein, shall also become effective upon its adoption,

The number of teller windows should be reduced
to only one (1) in order to meet the minimum ten
(10) stacking spaces requirement. The small
proposed buffer of only two feet (2' ) between
the west drive-in teller window and the adjacent
existing multiple family residential building is
not enough and would create a negative impact on
the residential use.
The Planning Department is recommending that the
open space area to the east of the drive-thru
lane be shifted to the west and be fully
landscaped. By doing so, the curve of the
drive-thru lane would be flattffad, there would be
an easier circulation of vehicles and a
meaningful buffer would be created between the
drive-in tellers and the adjacent apartment
building. The Planning Department also does not
favor the emerging of three lanes into two as
proposed for the drive-in facility; unless there
is somebody there at peak hours, a situation of
conflict would be created among motorists.

APPLICATION FOR A CLASS D SPECIAL PERMIT OR SPECIAL EXCEPTION

Within the City generally, or within certain zoning districts, certain structures, uses,
and/or occupancies specified in this ordinance are of a nature requiring special and
- intensive review to determine whether or not they should be permitted in specific
locations, and if so, the special limitations, conditions, and safeguards which should
be applied as reasonably necessary to promote the general purposes of this Zoning
- Ordinance, and, in particular, to protect adjoining properties and the neighborhood
from avoidable potentiaUy adverse effects. It is further intended that the expertise
and judgement of the Zoning Board be exercised in making such determinations, in
accordance with the rules, considerations and limitations relating to Class D Special
Permits and Special Exceptions. (See Article 26.)
Formal public notice and hearing is not mandatory for Class D Special Permits, but is
mandatory for Special Exceptions. !n other respects, these classes of special permits
are the same.
The Zoning Board *wU be solely responsible for determinations on applications for
Class D Special Permits and Special Exceptions. AU applications in these classes of
special permits shall be referred to the director of the Department of Planning for his
recommendations and the director shall make any further referrals required by these
regulations.
