WHEREAS, the Miami. Zoning Board, at its meeting of May 18, ,1987, Item No. 10, following an advertised hearing, adopted Resolution No. Z13 70-87, by a seven to zero (7-0) vote, RECOMMENDING APPROVAL of a change of zoning classification, as hereinafter set forth; and WHEREAS, the City Commission after careful consideration of this matter deems it advisable and in the best interest of the general welfare of the City of Miami and its inhabitants to grant this change of zoning classification as hereinafter set forth; NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The Zoning Atlas of Ordinance No. 9500, the zoning ordinance of the City of 1•1i.ami, Florida, is hereby amended by changing the zoning classification of approximately 1500 Northwest 35th Street, Miami, Florida, more particularly described as Lots 16, 17 and 18, Block 2, BEVERLY HEIGHTS, as recorded in Plat Book 6 at Page 164 of the Public Records of Dade County, Florida, from CR-3/7 Commercial Residential (General) to CG-1/7 General Commercial. Section 2. Section 3. Page No. 20.of the Zoning Atlas, made a part of Ordinance No. 9500 by reference and description in Article 3, Section 300 of said Ordinance, is hereby amended to reflect the changes made necessary by these amendments. Section 4. All ordinances or parts of ordinances insofar as they are inconsistent or in conflict with the provisions of this ordinance are hereby repealed. Section 5. If any section, part of section, paragraph, clause, phrase, or word of this ordinance is declared invalid, the remaining provisions of this ordinance shall not be affected. -2 1-0. RECOMMENDATIONS PLANNING DEPARTMENT DENIAL. The proposed change would be in coM17T% t with the adopted Miami Comprehensive Plan and would require a modification of the plan. A plan amendment request to the Planning Advisory Board is needed. Existing district boundaries are logically drawn in relation to existing conditions on the subject property and there have been no changing conditions in the area that make the passage of the proposed change necessary. The proposed change would constitute a grant of special privilege to an individual owner as contrasted with protection of the public welfare. There are no substantial reasons why the property cannot be used in accord with existing zoning. RE: Application for Amendment to Zoning Atlas Items #9 and #10 This request is to allow the King Cole Plumbing Corp. to relocate its existing facilities currently operating in North Miami Beach, Florida to the City of Miami. Present zoning for the property in question which is located at 1500 N. W. 35th Street, Miami, Florida, permits retail sales of our plumbing supplies to the general public, however, prohibits the operating of a plumbing contracti-ng company which occasionally includes minor and incidental repair work, JI of which, however, is performed within an enclosed building. It should be further noted that the operation of our business does not involve the use of any powered machinery and as such, enables us to operate a small, clean established business in a quiet manner without any disturbance to the surrounding neighborhoods. Additionally it has customarily been a general practice at King Cole Plumbing Corp. , to hire its work force consisting of approximately 20 people from the immediate residential neighborhood. As such our request,, if granted, would provide additional jobs and income to the local community. Furthermore, our business, by its nature, would operate in a more restrictive manner than the requested zoning district allows. We would also be willing to provide a voluntary restrictive covenant not only with respect to the operation of our business, but in addition, as to any reasonable ascetic improvements required by your department, The current zoning designation is not appropriate for the operation of our business in that it unreasonably restricts this quiet, clean and productive bus- iness from operating in an area directly across the street from a CG 1-7 zone wherein other businesses are providing services which create a far more odious impact on the neighborhood than would King Cole Plumbing Corp.
