ZB 62-87, by a seven to zero (7-0) vote, RECOMMENDING APPROVAL of a change of zoning classification, as hereinafter set forth; and WHEREAS, the City Commission after careful consideration of this matter deems it advisable and in the best interest of the general welfare of the City of Miami and its inhabitants to grant this change of zoning classification as hereinafter set forth; NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF '.I'HE CITY OF MIAMI, FLORIDA: Section 1. The Zoning Atlas of Ordinance No. 9500, the zoning ordinance of the City of Miami, Florida, is hereby amended by changing the zoning classification of approximately 1720-177.0 Northwest 34th Street and approximately 1721-1757 Northwest 33rd Street, Miami, Florida, more particularly described as Lots 1--5 and 12-18, inclusive, Block 1, LAVONIA PARK, as recorded in Plat Book 9 at Page 113 of the Public Records of Dade County, Florida, from RG-1/3 General :Residential (One and Two Family) to RG-3,/6 General Residential. Section 2. Zoning Atlas of Zoning Ordinance 9500, as amended, the Zoning Ordinance of the City of Miami to RG-3/6 General Residential. RECOMMENDATIONS PLANNING DEPARTMENT APPROVAL. The proposed change would not be in conformity with the adopted Miami Comprehensive Neighborhood Plan and would require a plan amendment. The applicant has applied to the Planning Advisory Board for a plan amendment and has been recommended for approval by the Planning Department. The proposed change is not contrary to the established land use pattern. The proposed change would not create an isolated district unrelated to adjacent and nearby districts, the requested RG-3/6 General Residential would be a good buffer between the CR-3/7 Commercial -Residential (General) district facing SW 17th Avenue and the RG-1/3 One and Two Family Residential district. The change suggested would ngt be out of scale with the needs of the neighborhood, 10:303 Existing district boundaries are illogically drawn in relation to existing conditions on the property proposed for change. If would seem more logical to divide the district at the center of NW 18th Avenue, which would probably mean that if a similar request is made for Lots 6, 7, 8, 9, 10 and 11, the Planning Department would probably recommend approval. Changing conditions in the area make the proposed change necessary. The proposed change would not adversely influence living conditions in the neighborhood. There is substantial reasons why the property cannot be used in accord with existing zoning. The desired proposed use for Community Based Residential Facility (CBRF) would be limited to only six (6) residents including staff under present zoning classification which is infeasible for the existing subject site. PUBLIC WORKS The existing sanitary sewer system had sufficient capacity to serve this property if it is rezoned to RG-3/6. However, if other RG-1/3 properties in the area are rezoned to RG-3/6 the sanitary sewer system could overload. -DADE COUNTY PUBLIC WORKS No comments. ZONING BOARD At its meeting of April 20, 1987 the Zoning Board adopted Resolution ZB 53-87 by a 8 to 1 vote,continuing the item to May 4,'1987. At its meeting of May 4, 1987 the Zoning Board adopted Resolution ZB 55-87, by a 9 to 0 vote, continuing the item to May 18, 1987. At its meeting of May 18, 1987, the Zoning Board adopted Resolution ZB 62-87, by a 7 to 0 vote, recommending approval of the above. One reply in favor was received by mail. Two proponents were present at this meeting. Pankey Pastor The Ailapattah Baptist Church has been providing for the spiritual, emotional and material needs of this community in a vital way for over fffty years. It has served as an extended family for singles, widows and homeless people in the community. In the past few years, the changes in the neighborhood have been reflected in the significant decline in the church attendance. However, the church is still able to provide for this neighborhood's needs by convert- ing the two existing educational buildings (excluding the sanctuary) to a community based residential facility. The existing zoning, RG 1/3, would prohibit the conversion of the existing buildings from an inferior use to a much -in -demand use. The change of zoning to RG 3/6 is the minimum district which would allow the existing buildings to be converted to a community based residential facility, in which we propose to provide care for elderly citizens of our neighborhood and our community at large. The existing sanctuary would not be included in this conversion, and would continue to operate in serving our congregation's needs and caring for individuals in our neighborhood. The conversion of the other two buildings would allow them to be used in a way which would continue to -benefit the Ailapattah community. This request is designed only for the already existing structures and not toward any increase in building size. To encourage the members of the Allapattah Baptist Church to join another Bible believing, fundamental Baptist Church by November 2, 1980. 2. To receive no further active members to the Allapattah Baptist Church, effective August 28, 1980. 3. To transfer to the status of an inactive member with no further voting rights all present active members of Allapattah Baptist Church who have not moved their membership to another church by Sunday, November 2, 1980. 4. To make all further decisions for the Allapattah Baptist Church, Inc., by a majority vote of the Board of Directors with no res- pect given to membership of the Allapattah Baptist Church. The Moderator, James Culpepper, gave as a word of explanation the following: "Because of the many problems confronting us at this time, the riots, the members moving out of community, the difficulty in getting new members to come into our community, and the tremendous debt load that we are carrying, we believe these moves are in the best interest for all concerned --our church, the Allapattah Baptist Church, Inc., the creditors who have been so faithful in working with us these last five years, and the members of the Allapattah Baptist Church who have given so sacrificially and so faithfully during this critical time." After much discussion the recommendations were accepted by the entire congregation. A vote was taken on each item and each item was accept by a unanimous vote.
