A RESOLUTION REVERSING THE HERITAGE CONSERVATION BOARD'S ACTIONS IN DENYING AN APPLICATION FOR A CERTIFICATE OF APPROPRIATENESS TO APPROVE EXTERIOR PAINT COLORS, PER APPLICATION DATED JULY 6, 1987 ON FILE IN THE PLANNING DEPARTMENT FOR THE FREEDOM TOWER, 600 BISCAYNE BOULEVARD, LOCATED WITHIN HC-1: GENERAL USE; CONSERVATION OVERLAY DISTRICT BASED UPON THE FINDINGS THAT THE PROPOSED 1951 COLORS ARE APPROPRIATE. WHEREAS, the Heritage Conservation Board at its meeting of September 3, 1987, Item No. 1, following an advertised hearing adopted Resolution No. HC-87-18, by a 5 to 3 vote, denying a Certificate of Appropriateness, as hereinafter set forth; but WHEREAS, the Appellant has taken an appeal from the Heritage Conservation Board's decision to the City Commission; and WHEREAS, the City C ;,nmission deems it advisable and in the best interest of the general welfare of the City of Miami and its inhabitants to reverse the actions of the Heritage Conservation board; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The Heritage Conservation Board's decision to deny a Certificate of Appropriateness for exterior paint colors per application dated July 6, 1987, on file in the planning department for the "Freedom Tower", 600 Biscayne Boulevard, located within HC-1, is hereby reversed. Section 2. It is hereby found that it is in the general welfare of the public and that the 1951 colors proposed per application dated July 6, 1987 on file in the Planning Department are appropriate. The Planning Department and the Heritage Conservation Officer have no recom>Aended preference as between the 1926 and 1951 paint color schemes for the Freedom Tower, both being equally acceptable under the Secretary of the Interior's "Standards for Rehabilitation". Box 330708 , Miami, Florida 33133 RE: Freedom Tower Dear Mr. McManus: By way of this letter, we are appealing to the city commission to reverse a decision of the City of Miami Heritage Conservation Board. At their meeting on September 3, 1987, the Heritage Conservation Board voted to deny a Certificate of Appropriateness for the facade restoration of the Freedom Tower. Their reason for denial was not consistent with the guidelines within the City of Miami Heritage Conservation ordinance. , The Heritage Conservation ordinance requires that the .basis for issuing a Certificate of Appropriateness, the des— cribed work shall comply with the U.S. Secretary of the Interior's "Standards For Rehabilitation". The work we are proposing complies precisely with the Secretary of the Interior's "Standards For Rehabilitation". This has been documented by the staff to the Heritage Conservation Board and a collateral letter from the State Preservation Office. Also, we have enclosed, for your review, a copy of a portion of the Secretary of the Interior's "Standards" and that portion of the Heritage Conservation ordinance that relates to this situation. Our application requested approval for the following: 1. Replace the existing aluminum awning windows in the tower portion with new aluminum double hung windows to match the configuration and color of the original windows. continued... - E 17 Ab Mr. Joseph McManus September 16, 1987 Page 2 2. Clean, repair, repoint, and waterproof the existing cast stone at the base of the tower. 3. Paint the stucco portion of the building body to match the color that the building has been since 1951, when the entire building exterior structure was rehabilitated. 4. Paint the simulated cast stone above the building base to match a synthesized color of the cast stone found at the base of the tower. 5. Restore, and repair the copper cupolas on the top portion of the tower. The Secretary of the Interior's "Standards" states "All buildings, structures and sites shall be recognized as products of their own time, and changes which may have taken place in the course of time are evidence of the history and development of a building, structure, or site and its environment. These changes may have acquired significance in their own right, and this significance shall be recognized and respected." This pertains precisely to this project. We are proposing to restore the facade of the Freedom Tower to the overlapping period that covered both the Miami News Building and the Freedom Tower. I agree that it would be beneficial for the Heritage Conservation Board to have an opportunity to see a sample of the colors applied to the building. As I indicated during our telephone conversation, as long as the colors selected are generally sympathetic to the historic character of the building, this aspect of the proposed project will be consistent with the Secretary of the Interior's Standards for Rehabilitation. In terms of compliance with the requirements of the federal rehabilita- tion tax incentives program, the color scheme described in your submission would be acceptable. However, because of the historic and architectural significance and visual prominence of the Freedom Tower, we strongly recommend that the new color scheme more accurately reflect the historic colors than the scheme presented. Of particular concern is the color to be applied to ornamental cast stone. Photographic documentation in our files indicates that the color depicted on the rendered elevation in your submission more closely replicates the visual character of the cast stone than the color chip presented. We recomstsend that You reevaluate this color selection. In the standard raim palette, color number 344 would appear to be a closer match to the color of the cast stone. The color selected for plain stucco wall surfaces is considered acceptable. In the absence of the original wood windows and in light of the dark sash color indicated by historic photographs, the window color you suggest is reasonable. The glass in the new windows should be clear. Tinted or reflective glass types are considered inappropriate for rehabilitation projects involving historic buildings. We 1 ars proposing to paint the cost stone only on the tower and cupids portion of the building only, because the cast atone has been exto Wively patched and previously painted in these area. The color attached to the application is the color Mr. Ferro suggested for the cast stone. I can not sp with is suggestion a it does not even come class to the color of cast stone. The color I have suggested represents a synthesis of all the color variations found in the test atone at the building base. The balcony deck at the 14th floor will be restored tc match ' the original finish,. which is quarry tile. If requested, a detail will be presented at the meeting. The request for submitting a copy of original drawing can only be a complied with the stipulation that they be returned to this office within one week. Copies of the original Schultz and Weaver drswinga were going to the owners on the stipulation that they would not be reproduced.
