RESOLUTION NO. 87-'939
A RESOLUTION ACCEPTING THE COMPLETED WORK
OF FRE CONSTRUCTION CO., INC. AT A TOTAL
COST OF $687,577.94 FOR DESIGN PLAZA
HIGHWAY IMPROVEMENT IN DESIGN PLAZA
HIGHWAY IMPROVEMENT DISTRICT H-4509 C.I.P.
PROJECT NO. 341098 AND AUTHORIZING A FINAL
PAYMENT OF $63,781.19
WHEREAS, there exist a contract dated June 11, 1986
between the City of Miami, Florida and FRE Construction Co.,
Inc. for DESIGN PLAZA HIGHWAY IMPROVEMENT; and
WHEREAS, the work, has been satisfactorily completed and
FRE Construction Co., Inc. has furnished the required documents
certifying that all bills for labor and materials have been
paid in full in connection with the aforesaid contract;and
WHEREAS, after a duly advertised public hearing held on
October 22, 1987, to hear objections by persons interested in
or affected by City Commission acceptance of the completed
construction of DESIGN PLAZA HIGHWAY IMPROVEMENT in DESIGN
PLAZA HIGHWAY IMPROVEMENT DISTRICT H-4509 C.I.P. Project No.
341098, no objections were sustained; and
WHEREAS, the City Manager and the Director of the
Department of Public Works recommend that the completed work be
accepted and final payment made to the contractor;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE
CITY OF MIAMI, FLORIDA:
Section 1. The completed work performed by FRE
Construction Co., Inc. for DESIGN PLAZA HIGHWAY IMPROVEMENT in
DESIGN PLAZA HIGHWAY IMPROVEMENT DISTRICT H-45n9 C.I.P. Project
No. 341098 is hereby accepted at a total cost of $687,577.94.

Section 2. The proper officials of the City of Miami are
hereby authorized to pay FRE Construction Co., Inc. a balance
of $63,781.19 as full and final payment for all work performed
and all materials furnished in connection with DESIGN PLAZA
HIGHWAY IMPROVEMENT in DESIGN PLAZA HIGHWAY IMPROVEMENT
DISTRICT H-4509 C.I.P. Project No. 341098.

RECOMMENDATION:
It is respectfully recommended that the City Commission adopt the
attached resolution accepting the completed work performed by FRE
Construction Co., Inc. at a total cost of $687,577.94 for DESIGN
PLAZA HIGHWAY IMPROVEMENT C.I.P. Project No. 341098 and
authorizing a final payment of $63,781.19.
BACKGROUND:
The Department of Public Works has determined that it is now in
order for the Commission to accept the completed work and
authorize final payment, after all conditions are met for Design
Plaza Highway Improvement C.I.P. Project No. 341098.
FRE construction Co., Inc. has completed the project consisting of
constructing 0.7 mile of street including clearing and grading,
asphaltic pavement, concrete curb b gutter, decorative paver
sidewalk, storm sewers and landscaping on N.E. 40 b 41 Streets
between N. Miami Avenue and N.E. 2 Avenue and on N.E. 1 Avenue
between 38 and 41 Streets.
The total payment to the contractor will be 55,529.56 less than
the original contract amount of $693,107.50 because not all of the
$50,000 Cash Allowance for Special Items was used.
